Dear Chuck:
First, I wanted to draw your attention to the conditions of
approval for these two applications and let you know that we do
have applications for building permits for these two school sites.
If you- have -not received copies of these two decisions (CUP 91 -00
and CUP 91- 0003), please let me know and I will be glad to send
them to you.
Second, you will find enclosed with this letter 1) copies of the
worksheets used to calculate the Traffic Impact Fee for the
portable classroom structures described above 2) three Payment
Option Forms (one for each school site).
Please note there are two options available to you for payment of
the Traffic Impact Fees (TIFs). The first is to pay in cash or
with a check at the time you pick up the building permit for each
portable structure. The second is to arrange to make installment
payments. Because the calculated TIF is less than $5000.00 payment
may not be deferred to occupancy. No previous credit is avaiable
to apply to this project.
Please review the conditions of approval and complete the payment
option forms and return them to me as soon as possible. The
conditions of approval must be satisfied prior to issuance of the
building permits.
You may appeal the calculated TIF to the Washington County Hearings
Officer. An appeal must be filed within 14 days of the date of
This notification. The appeal must be accepted by the City of
Tigard Recorder. If you need more information about the appeal

CONDITIONAL USE PERMIT - CUP 91 -0003
TWALITY JUNIOR HIGH SCHOOL
TIGARD SCHOOL DISTRICT 23J - OWNER /APPLICANT
APPLICATION: The applicant seeks approval for a Minor Modification
to an existing Conditional Use to allow placement of one 1,680
square foot portable classroom structure on the Twality Junior High
School site. ZONE: R -4.5 (Residential, 4.5 units /acre) LOCATION:
14650 SW 97th Avenue (WCTM 2S1 11BD, tax lot 2700).
DECISION: Notice is hereby given that the Planning Director's
designee for the City of Tigard has APPROVED the above request
subject to certain conditions. The findings and conclusions on
which the decision is based are noted below:
A. FINDINGS OF FACT
1. Background Information
Twality Junior High School received it's original site
development review approval in the late 1950's and has
been expanded several times. In 1982 a Site Development
Review request to add 4,460 square feet onto an existing
66,858 square foot building was approved by the Director.
A Temporary Use Permit was approved in 1988 (TUP 88 -07)
to allow the location of a temporary classroom structure
on this site.
2. Vicinity Information
The subject site is surrounded on the north, east and
south sides by R -4.5 low - density residential zoning (4.5
units per acre) . The properties which are located to the
west of Twality Junior High School are zoned R -3.5
(Residential, 3.5 units per acre). Templeton Elementary
School is located due south of the site.
Twality Junior High School lies on the east side of SW
97th Avenue. Southwest 97th Avenue is a two -lane road
and is functionally classified as a collector street.
Southwest Inez Street borders a portion of the site on
its' northern boundary.
3. Site Information and Proposal Description
The subject site is occupied by the Twality Junior High
School. In addition to the school building there is an
existing portable classroom structure and a large open
recreation area and track located to the east, tennis
courts and a parking area to the north, and an additional

parking area to the south. The balance of the site is
mostly landscaped and grass- covered.
The school district proposes to expand the Junior High
School operations at this site through the installation
of a two classroom modular building. The modular
building is proposed to be located to the northeast of
the existing school building. Access to the two new
portable classrooms is from a paved walkway which
encircles the northern classroom wing and a new six foot
wide asphaltic walkway.
Expansion of a school within the R -4.5 zoning district
requires Conditional Use approval. Conditional Use
review is conducted by the City's land use Hearings
Officer. However, this application is classified as a
minor modification to an existing conditional use because
the modular unit will add less than 10% additional floor
area to the existing structure(s) (Code Section
18.130.050 -060). This application is therefore subject
to a staff review and not a Hearings Officer review.
4. Agency and NPO comments
The City of Tigard Building Division has reviewed the
proposal and has offered the following comments:
1. Public Improvements:
After reviewing the proposal the Engineering
Department has determined that all existing public
improvements, streets, storm drainage, and sanitary
sewer systems are adequate to handle this
development and do not require additional
upgrading.
2. Storm sewer:
The Unified Sewerage Agency has established and the
City has agreed to enforce, Resolution 90 -43
Surface Water Management Regulations, requiring
construction of on -site water quality facilities or
fees in -lieu of their construction. The applicant
has not proposed any such on -site water quality
facility and based on the size and location of the
development a on -site facility should not be
required. In addition, even though this is a
temporary structure, as explained by the applicant,
the Resolution requires that the fee be paid for
any development that will be in place for more than
a one year period; therefor a fee in -lieu of their
construction of a water quality facility should be

required.
The City of Tigard Building Department has reviewed the
proposal and has offered the following comments:
1. Building permits shall be required prior to the
placement and /or construction of the modular unit
on the site. The building may need to be relocated
as per Fire District comments.
Tualatin Valley Fire and Rescue District has reviewed the
proposal and has offered the following comments:
1. The Fire District has reviewed this proposal with a
Design Architect. Revisions will be made as to the
location of the modular building or the building
will be protected with automatic sprinklers.
Neighborhood Planning Organization #6 has reviewed the
proposal and has offered no comments or objections.
No other comments have been received.
B. ANALYSIS AND CONCLUSION ^
Applicable Approval Criteria: Community Development Code
Chapters 18.50.040, 18.130.060(C), 18.130.150(C)(9), and
Comprehensive Plan Policy 2.1.1.
The applicable criteria for approval of a minor modification
to an existing approved conditional use are contained in Code
Section 18.130.060 (C). They are as follows:
1) No Code provisions will be violated; and
2) The modification is not a major modification.
The proposed addition of a portable classroom building on the
site of the Twality Junior High School is consistent with the
above criteria. Section 18.50.040 lists schools as a
conditional use in the R -4.5 zoning district. The site was
approved for this use_ in the late 1950's; prior to the
incorporation of the City of Tigard. Subsequent reviews have
confirmed the use of this site as a school facility.
The proposal satisfies the setback, lot coverage, and building
height requirements of the R -4.5 zoning district and Section
18.130.150 (C)(9) (Locational Criteria: Schools). Adequate
landscaping already exists on the site. The site provides
adequate area for the needs of the existing school buildings
as well as the proposed modular building. The only utility
connection that must be made for the proposed building is for

electricity. Other public service providers have not
indicated that they would be unable to serve the new modular
building.
Existing site improvements satisfy other applicable Community
Development Code requirements. Existing trees satisfy the
code requirement for parking area trees (Section 18.100.110).
Adequate access and internal circulation are provided for by
the existing access and driveway which directs the bulk of
school traffic, including all school bus traffic, away from
the parking area northern and southern ends of the site.
Adequate vision clearance is provided at all driveway /road
intersections. Pedestrian access to the school is provided by
the public sidewalk along S.W. 97th Avenue.
Code Section 18.106.030(B)(9)(b) addresses the parking
standards required to provide adequate parking at junior high
schools. This code section requires 1.5 spaces for every
employee, plus 1 space for each 100 square feet of floor area
in the auditorium or other assembly or 1 space for each 8
seats, whichever is greater. This criterion was not addressed
within the applicant's narrative or supplemental information,
nor was this information-readily attainable by the City.
Therefore, this code requirement shall be addressed through
the conditions or approval.
It is required that the parking areas provide at least one
appropriately sized and located handicapped parking space for
every 50 standard parking spaces (Section 18.106.020(N)).
This standard was not addressed within the information
provided in the application materials. Additionally, Code
Section 18.106.020(P) requires that a minimum of one secured
bicycle rack space be provided for every 15 automobile parking
spaces. The applicants' proposal did not address this
requirement within the submitted application materials.
Therefore, the code requirements for automobile and bicycle
parking shall be addressed through the conditions of approval.
The proposed expanded use complies with applicable plan
policies as follows:
1. Policy 2.1.1 is satisfied because NPO #6 -has been
informed of the proposal and has been given an
opportunity to comment on the proposal. In addition,
notice of the proposal and the opportunity to comment on
the proposal has been sent to nearby property owners.
C. RECOMMENDATION:
The Planning Director's designee for the City of Tigard
approves Conditional Use Permit CUP 91 -0003 allowing placement
of a portable modular classroom on the Twality Junior High

School site SUBJECT TO THE FOLLOWING CONDITIONS:
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE
ISSUANCE OF A BUILDING PERMIT FOR INSTALLATION OF THE PROPOSED
MODULAR BUILDINGS.
1. The applicant shall submit verification that adequate on-
site automobile and bicycle parking is available for both
the existing and temporary modular structures. STAFF

2. The applicant shall pay the fee in- lieu -of, for water
quality, prior to obtaining building permits. STAFF
CONTACT: Chris Davies, Engineering Division 639 -4171.
3. Building permits shall be required prior to the placement
or construction of the modular classroom structure on the
site. STAFF CONTACT: Brad Roast, Building Division 639-
4171.
4. The location of the modular classroom unit shall be
revised or the modular classroom shall be provided with
automatic sprinklers. STAFF CONTACT: Gene Birchell,
Fire Marshall 526 -2538.
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE
FINAL DECISION DATE NOTED BELOW.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at
City Hall and mailed to:

x Owners of record within the required distance
x The affected Neighborhood Planning Organization
x Affected government agencies
2. Final Decision: THE DECISION SHALL BE FINAL ON 6/19/91
UNLESS AN APPEAL IS FILED.
3. Appeal: Any party to the decision may appeal this
decision in accordance with Section 18.32.290(A) and
Section 18.32.370 of the Community Development Code which
provides that a written appeal must be filed with the
City Recorder within 10 days after notice is given and
sent. Appeal fee schedule and forms are available at
Tigard City Hall, 13125 SW Hall Blvd., Tigard, Oregon.
The deadline for filing of an appeal is 3:30 p.m. 6/19/91

2. Due to location on property and access requirements not
available as required by the Fire Code, this Plans
Examiner understands that automatic sprinklers will be
installed in this unit as an alternate. Automatic
sprinkler plans shall be submitted to this office in
not less than 3 copies for review and approval prior to
installation. Other comments about sprinkler
installation will be made at that time.
3. Approved Plans on Job Site: One set of approved plans
bearing the stamps of the building department issuing
the construction permit and this office must be
maintained on the project site throughout all phases of
construction and must be made available to building and
fire inspectors for reference during required
