Clarification on glass located inside corridor on whether% hour rated or sprinkler protected. OSSC 1004.3.4.3.2.2. 2. Clarification on where the fire resistive construction details as designed per UL are located in the revised plans. OSSC 106.3 3. Clarification on exit sign located on library side at computer room access. Occupant load on computer room based of this sign will require two exits from computer room. Therefore, remove sign or provide second exit from computer room. OSSC 1004.2.3.3 4. Clarification on play area at West and East ends of school on whether yards enclosed or not. The requirement for dispersal/gate hardware will be required if enclosed. OSSC 1006.3.5, 1007.3.11 Please provide an item by item response. There are no concealed overhangs on the project., Sheets A9.2W and A9.2E show general note 28 with a dashed line poche on stud walls that extend up to the roof metal decking. These poche walls are typically surrounding each classroom that are not masonry walls going to roof metal decking. Therefore, each classroom (and Activity space) has a "Draft Stop ". AREA SEPARATION WALLS: 904.2.4.2 states all El occupancies must have less than 20,000 s_f. actual area or be sprinklered. Area separation walls would be required in order to not use sprinkler credit. Sprinkler credit needs to be used for substitution of 1 -hr construction to allow 2 stories. Both EEA and the City agree that the integrity of the Area Separation Walls become deteriorated over time and during construction due to the amount of penetrations required in a building of this type. It is further agreed that additional sprinklers and non - combustible construction create more reliable safety conditions. Therefore no area separation walls are included, however Type 11 and additional sprinklers are integrated. 2. Once the meeting began at 9:00 a.m., the following conditions of approval were reviewed and discussed. The result of discussion is listing under each applicable condition. THE FOLLOWING PLANNING CONDITIONS ARE REQUIRED TO BE MET PRIOR TO ISSUANCE OFA SITE PERMIT: 2. The applicant shall submit a final tree removal and protection plan that identifies the trees to be removed and the trees to be protected. Mitigation will then be based on the final tabulation of trees removed to those retained, per Section 18.790.030. Result: This plan was on the construction plans submitted to Building Department last November. A separate plan showing the tree removal and protection plan needs to be submitted to the Planning Department to meet this condition. • 4. The applicant shall notify the City Arborist when tree protection measures are in place so that he may verify that the measures will function properly prior to construction. Access Spacing Standard, refer to code chapter 187.05 14. The applicant's plans shall show the proposed access onto Bull Mountain Road as an emergency only access. That access shall be gated or otherwise improved to prevent general public motor vehicle access, but shall be accessible to emergency services providers, pedestrians and bicyclists. The access may be used for general public motor vehicle access only during an emergency or when otherwise approved for that purpose by the Planning Manager. Case Note: No emergency access proposed. Result: Once the construction easements and right -of -way copies are submitted to the city (Kim McMillan), the PFI permit for 132nd can be issued and this condition signed off. The construction and acceptance of 132nd will eliminate the need for Bull Mountain Road (emergency) access. 17. Sanitary sewer and storm drainage details shall be provided as part of the Public Facility Improvement (PFI) permit plans. Calculations and a topographic map of the storm drainage basin and sanitary sewer service area shall be provided as a supplement to the Public Facility Improvement permit plans. Calculations shall be based on full development of the serviceable area. The location and capacity of existing, proposed, and future lines shall be addressed. The applicant shall submit preliminary sight distance certification for all driveways and intersections related to this development. One, they must review and approve the plans to issue permits for the sewer lateral connection from the school to the public sewer in Summit Ridge. They must also review and approve plans for the storm and sewer lines to be constructed in the public streets (132 and Batterson Street). These plans are currently under review by CWS. • As you recognize, the city has cooperated to the fullest extent to allow your contractor to go forward with certain aspects of construction on the site. Extensive site work, footings and retaining walls have been allowed to proceed ahead of normal permit sequence. We are coming to a point that the public facilities plans must be completed. This requires submission of all construction and permanent easements and right of way dedications. The City Council has an agenda item this month for a significant increase in Parks SDC's. The increase is proposed to be higher than the normal end of the year increase. I recognize that it is prior to annexation, but I do encourage the School District to pay the Parks SDC prior to final occupancy as the increase will go into effect January 1, 2005. In the matter of the Hold Harmless agreement we are requiring before work progresses, I am attaching a sample format for the School District to follow, personalizing the form to fit the needs of the project. We understand that the City reserves its full authority to review, approve, approve with conditions or deny the District's site development application pursuant to the City Development Code, and that the City's authorization to proceed with the site development work should not be construed as a commitment that the City will approve or will not modify the District's site development plan. I think our meeting provided us the opportunity to get on the same page and dispel some of the misconceptions and inaccuracies that the applicant appears to be promoting. For example, the applicant's statements that the review time at Clean Water Services (CWS) is six weeks and we were taking an extraordinary amount of time to review the engineering plans are based on either ignorance or a distorted view of reality. As I mentioned in our meeting, our review time is currently running two weeks. Before the holidays, it was one week. The Alberta Rider plans came into our office on Dec. 29, 2004. The plans were reviewed for completeness and entered them into our system on Dec. 30, 2004. I personally finished the review on January 7, 2005. If this timeline equals 6 weeks, I need to sign up for a refresher math class at PCC. Our initial review of the engineering plans resulted in a number of redlines that Westlake is now working on correcting. The two major issues from the standpoint of CWS are: 1. Lack of a storm sewer easement at the storm sewer connection point with Summit Ridge Since the storm sewer in Summit Ridge is now within the City of Tigard, the easement from Summit Ridge will be to the City of Tigard, not CWS. 2. Probable downstream capacity limitations for the runoff from the school property I anticipate Westlake's next plan submittal will clarify the capacity issue. If detention is needed, CWS will review the detention to insure it meets our Design and Construction Standards. The City of Tigard may also want to review the detention, which will be a private system, to insure it does not conflict with any aspect of the plumbing code. With these considerations in mind, I recommend the City no grant an on -site plumbing permit until the easement issue is addressed and the engineering plans from Westlake are nearly ready to approve with only minor redlines remaining. In addition, we recommend no walls or other structures above ground level be allowed until we have approved Westlake's engineering plans and issued our connection permit. - Please call or email me if you have any questions. Revised plans and structural calculations have been received and are being reviewed by Ray Miller's office in anticipation of approval for a Foundation /Footing permit. Robinson Construction would like to receive a permit, inspection and begin pouring footings on December 22. This is dependent upon whether the revision review is correct and completed, and the city is working diligently to assist in meeting this schedule. Ultimately, it will depend upon all of the corrections being complete so the plan review may be completed. Engineering still needs approvable plans for Bull Mountain and say the plans for J Street look good. They will also need right -of -way documents in order to eventually issue the PFI permit. Jim asked attendants if they felt the meetings were worthwhile and the notes received helpful. All agreed that the meetings were very important in order to keep the project on track, communication open, and continued cooperation between all parties. Also, they all wanted to continue receiving the meeting notes. Redlines were returned to Westlake from CWS. It was agreed that at this point with verbal approval from CWS that the city would proceed with issuance of the underslab plumbing permit. Pat attempted to contact Terry Keys from CWS for verbal approval but he was not available. Pat will ask him to contact Brian Blalock with verbal approval and the plumbing permit can be issued at that time. The final profile for Bull Mountain Road will be worked up today as Mike White from the city is meeting with Pat and Bernard from Westlake. Significant progress is being made on right -of - ways and easements. Stephen Poage related to Craig that he needed the information regarding easements and right -of -ways for the school board meeting on the 20` of January. Also, a "Petition to Annex" will be sent to Mr. Poage for action. In all, the meeting was constructive and it seems the required conditions for Alberta Rider are moving along. At our weekly meeting this Tuesday, the city was told the Clean Water Services permit was `ready to go' and could be released by merely a telephone call from CWS to our Plans Examiner Supervisor, Brian Blalock. Brian received an email yesterday from Terry Keyes, Development Services Manager at Clean Water Services. He stated that the plans were not approved and the permit not ready to issue. He recommended the city not grant an on -site plumbing permit until an easement issue is addressed and the engineering plans from Westlake are ready to approve, with only minor redlines remaining. Terry also recommends no walls or other structures above ground -level be allowed until Westlake plans are approved and their connection permit issued. DRAFT STOPS: OSSC 708.3.1.2.2 exception requires a draft stop every 100' or 9,000 s.f. of attic or concealed overhang. The exception was satisfied via the "alternative understanding letter" by providing sprinkler heads into concealed spaces as shown in the specifications (15300, 1.03,F,3). There are no concealed overhangs on the project.. Sheets A9.2W and A9.2E show general note 28 with a dashed line poche on stud walls that extend up to the roof metal decking. These poche walls are typically surrounding each classroom that are not masonry walls going to roof metal decking. Therefore, each classroom (and Activity space) has a "Draft Stop ". The library has a soffit wall on grid N allowing the library attic to be less than 9,000 s.f. and 100' east -west. The Administration area between Grids 3 and 6 as well as Grids A and J are also split up by the general note 28 to be much less than even 3,000 s.f. or 60' in any direction. The Gym and Multipurpose have no attics since they are exposed structure. The Kitchen is less than even 3,000 s.f. due to the occupancy separation from the Music room attic. The main entry and corridors are split up to be less than 9,000 s.f. or 100' in any direction via grids 3, 6, 7, 10, 12. There is also a draft stop around the Stage Attic, making the area between grids 7 and 12 as well as grids H and L less than even 3,000 s.f. 2. UL ASSEMBLIES DETAILS: UL listings are on sheets A3.2S and A3.1S for each wall type. See attached UL cut sheets showing which variations are used. 3. At our weekly meeting this Tuesday, the city was told the Clean Water Services permit was `ready to go' and could be . released by merely a telephone call from CWS to our Plans Examiner Supervisor, Brian Blalock. Brian received an email yesterday from Terry Keyes, Development Services Manager at Clean Water Services. He stated that the plans were not approved and the permit not ready to issue. He recommended the city not grant an on -site plumbing permit until an easement issue is addressed and the engineering plans from Westlake are ready to approve, with only minor redlines remaining. Terry also recommends no walls or other structures above ground -level be allowed until Westlake plans are approved and their connection permit issued. The two major issues Terry pointed out from the standpoint of CWS are: 1. Lack of a storm sewer easement at the storm sewer connection point with Summit Ridge. The easement from Summit Ridge will be to the City of Tigard, not to CWS; 2. Probable downstream capacity limitations for the runoff from the school property. Westlake will need to clarify the capacity issue to determine if on- site detention is needed. The permit was submitted to CWS on December 29, 2004, and the plan review time has been very quick. It is very important, however, that you are aware of what may be a critical holdup on the project's progression. The City of Tigard cannot issue further permits until Clean Water Services has had their requirements met and the permit issued. No response to that letter had been received by meeting time. Engineering has received the plans for J Street and 132 Avenue and are reviewing those. It is still critical for them to receive approvable plans for Bull Mountain Road. Once this has been achieved, and the easements and right -of -ways in place, the construction portion can move beyond the footing /foundation stage. Robinson Construction is in the process of pouring the lower foundation and will have work through approximately next Wednesday, February 2. In order for the undersiab plumbing and electrical permits to be issued and work to be done in those disciplines, it is necessary to secure the CWS permit. That permit was submitted to CWS on December 29. Cornerstone Management, representing the school district, is coordinating with CWS to secure the permit as soon as possible. Brian Blalock will contact Terry Keyes at Clean Water Services to offer any help or information they may possibly need from the city to get the permit approved and issued. The city does not want to see construction progress being held up, and at this point the CWS permit seems to be the stumbling block. Prepared by Sue Ross, 503 - 718 -2453 Alberta Rider Elementary School Update February 25, 2005 Tigard- Tualatin School District requested Conditional Use approval to construct the 67,000 square foot proposed Alberta Rider Elementary School. The Land Use decision was approved on July 12, 2004 by the Hearings Officer, and appealed by an adjacent property owner on August 24 due to various issues. The appeal was withdrawn on September 10 and the Hearings Officer's final order approving the school became final on September 10, 2004. Alberta Rider had 48 conditions of approval. (copy of conditions attached) Due to complex issues surrounding the development and construction of Alberta Rider Elementary School, Jim Hendryx felt it would show good intention to begin weekly meetings that involved the representatives of the School District, Management Company (Cornerstone), Contractor (Robinson), Engineer (Westlake), and the City of Tigard staff involved in the project. Weekly meetings began December 8, 2004 with the purpose to clear up questions and frustrations and to help establish a foundation for clear communication and cooperation between our entities to make this upcoming construction process a positive project. At the time, there were quite a few outstanding items to be completed for the project prior to Site Permit Issuance, Public Facilities Improvement permit (PFI from Engineering) issuance and any construction. During a meeting in early November, the City agreed to let the school proceed as follows: • Plans and permit applications could be submitted to the Building Division (this procedure is not usually allowed until certain conditions are met) • Although the submitted permits would go through the plan review process until approved to issue, the school was given approval to go ahead with some limited site work: • preparation of site prior to site permit issuance • rock the access road(s) and approximately 50 -feet around the building site footprint; • A Hold Harmless Agreement would be immediately submitted to the City of Tigard by the Tigard/Tualatin School District, covering any and all work and activity on the site. (This agreement was received 12/16/04 - copy of agreement attached) Alberta Rider Elementary School Update February 25, 2005 Page 2 • The Parks Systems Development Charge was calculated and pre -paid (allowing the school to avoid large 1/1/05 increase) • Annexation agreement would be submitted to the city. This was approved by the School Board on December 9, 2004. As of this date (2/25/05), annexation submittal has NOT been made. To assist the school district in constructing Alberta Rider in a timely manner, these approvals were done out of development sequence as a courtesy to the school district, and also due to the tremendous amount of activity on Bull Mountain and easement and right -of -way requirements that involve not only the school project but other projects approved in the area. • Due to this reliance on other projects (Arbor Summit I and II, Summit Ridge, Bella Vista) for some of the required right -of -ways and easements, the City has strived to make concessions for the school to have a limited amount of construction underway prior to actual approval of certain conditions. Permits that have been issued in this consideration are Site, Footing /Foundation, Phase I Structural, and temporary Electrical service. Contractors installed and buried underslab plumbing without permits or inspections. A CWS permit was finally issued and the plumbing permit picked up February 15, 2005. • Suggestions for better coordination and things that potentially will save the school money have come up and acted upon. Stephen Poage agreed, along with West Hills Development, to bid the Bull Mountain Road street improvements as one document and hire one contractor (as opposed to the original two) to do the work. This alone has the potential of saving many dollars and was a suggestion from the City's Engineering Department. It also allowed the City to go ahead with the issuance of a Phase I Structural permit, which kept the contractor from having to lay off his crew. (copy of agreement attached) Meetings that were continuing weekly and were successful at solving the 'What's Next ? ?" questions have been unattended by any representative of the school district's project. They have virtually ignored meeting notices and telephone calls. The meetings were progressive and accomplished keeping the lines of communication open between the City and the School District. • Due to confusion by a rep of Cornerstone Management, they thought they were being charged for these meetings because of a billing from Engineering. That is when correspondence was sent by Stephen Poage ordering his `team' to stop attending the meetings. (copy of letter attached). The charges are for Engineering services from the start of the project to the present. Information explaining all charges were personally delivered to Stephen Poage at the TTSD office. Sandburg Street Tigard OR 97223 Dear Steve: This letter serves to review fees and Conditions of Approval that are outstanding for the Alberta Rider Elementary School Project. I am attaching a current listing of fees outstanding, along with remaining Conditions of Approval. The building permit for fire/life safety portion of the building has been ready to issue since March 18. However, as you can see by the attached Conditions of Approval, there are still 14 conditions that need to be met prior to issuance of further permits. It is important to state that you were permitted to proceed with construction with the understanding that your conditions would be met as soon as practical. Several months have gone by without progress toward meeting all of the applicable conditions. The city has cooperated to the fullest extent to allow your contractor to go forward with certain aspects of construction on the site. An extensive amount of construction has proceeded ahead of normal permit sequence and in some cases without permit. We are coming to a point that the public facilities plans must be completed. This requires submission of all construction and permanent easements and right of way dedications. We want to see the project continue forward and not be delayed. We had been holding successful weekly meetings for project status and I encourage your participation to attend a meeting I have scheduled for Tuesday, May 10 at 2:00 p.m. to review where we are at with the project. The City will notify via email all those who previously attended with the same invitation. Steve, I have always strived to ensure good communications throughout the project. However, I was disappointed to see the article in the Oregonian stating that the school opening is "delayed by a dispute with the city over a nearby road and permit problems ". I am sorry that the School Board members were informed that was the case as we know the problems with securing permits are more complicated than merely stating the City has held the project up. Hendryx, Community Development Director cc: Alberta Rider Project Team Members On Friday, April 22, 2005 at approximately 9:3o a.m. a site visit was made to Alberta Rider Elementary School project site by Jim Hendryx, City of Tigard Community .Development Director, and Gary Lampella, City of Tigard Building Official. Mr. Lampella reports that he observed work being performed that had yet to be permitted by the City of Tigard. The building permit application issued to Robinson Construction was to construct a structural shell only. However, Mr. Lampella observed structural work being done within the interior and at the exterior, including non- structural stud walls and HVAC work. This scope of work was not covered in the structural shell permit. Mr. Lampella also states that the contractors are now doing exterior site waterlines without the benefit of a permit. He states he verbally instructed the foreman of the site (Dave Haggard) to stop any work on non - permitted areas. May 20, 2005 Jer Pratton, ED D Tigard - Tualatin School District 6960 S.W. Sandburg Street Tigard OR 97223 Dear Jer: This letter is regarding Condition No. 13 of the Alberta Rider Elementary School land use approval; more specifically, the condition which requires elimination of the east Rider driveway off of Bull Mountain Road. A meeting was held several weeks ago and a discussion ensued regarding this condition; no conclusion was reached at that time. I have learned, however, that if the School District is considering an appeal for the driveway to remain, it would be a very long and complicated process. First and foremost, the appeal period has long expired. Because the driveway was decided as part of the Conditional Use application, the condition is part of a Type III Hearings Officer decision. We cannot modify that decision. In order to modify the Hearings Officer decision, a complete hearing process, including pre -app meeting, neighborhood meeting, application and hearing review by the Hearings Officer would be required. The School District used this driveway closing in argument for approval of their emergency access which is approximately 80 feet away. Should the emergency access go away once the school is completed, there are separate issues regarding the Rider driveway. It would fall under an adjustment to 18.705 H. Access Management Standards, which requires a 200 -foot separation which may not be achievable in this case. There are clear review criteria for this adjustment, including that there are no other alternative access points and it is not possible to share access. As a result, it would be difficult, if not impossible, to meet the approval criteria. Also consideration would have to be the street access to the Alpine View Subdivision as well as other driveways across the street. The meeting was progressive and we agreed to meeting weekly for the time being to keep that line of communication open. Daily activity with the project will be logged and then a weekly update written and copied to the interested parties. Attached is this week's update. Regarding your inquiry of the actual Parks Systems Development Fee, the fee is based upon the number of employees that will be employed at Alberta Rider. The City Council has an agenda item this month for a significant increase in Parks SDC's. The increase is proposed to be higher than the normal end of the year increase. I recognize that it is prior to annexation, but I do encourage the School District to pay the Parks SDC prior to final occupancy as the increase will go into effect January 1, 2005. In the matter of the Hold Harmless agreement we are requiring before work progresses, I am attaching a sample format for the School District to follow, personalizing the form to fit the needs of the project. In addition, the underslab electrical is being reviewed by the Building Division. The Transmittal form used by the Building Division was discussed and noted the importance of using this when revisions /documents are being submitted. One, they must review and approve the plans to issue permits for the sewer lateral connection from the school to the public sewer in Summit Ridge. They must also review and approve plans for the storm and sewer lines to be constructed in the public streets (132 and Batterson Street). These plans are currently under review by CWS. As you recognize, the city has cooperated to the fullest extent to allow your contractor to go forward with certain aspects of construction on the site. Extensive site work, footings and retaining walls have been allowed to proceed ahead of normal permit sequence. We are coming to a point that the public facilities plans must be completed. This requires submission of all construction and permanent easements and right of way dedications. In addition, without the proper permits from CWS, we cannot issue plumbing permits or continue to allow further construction activities beyond what has been permitted above (ie foundations, etc.). The applicant shall place the following note on all construction documents: "The City of Tigard Noise Ordinance prohibits construction activity in excess of 40 decibels between 9:00 p.m. and 7:00 a.m. Monday through Friday, and between 9:00 p.m. and 8:00 a.m. on Saturday and Sunday. 2. The applicant shall submit a final tree removal and protection plan that identifies the trees to be removed and the trees to be protected. Storm drainage, including any off -site storm drainage necessary to convey surface and /or subsurface runoff; E. Six-foot concrete sidewalk with a planter strip; F. Street trees in the planter strip spaced per TDC requirements. Species selection shall be as recommended by the City Arborist. Such trees shall be installed prior to final building inspection. G. The applicant shall provide an on -site water quality facility as required by Clean Water Services Design and Construction Standards (adopted by Resolution and Order No. 00 -7). Final plans and calculations shall be submitted to the Engineering Department (Kim McMillan) for review and approval prior to issuance of the site permit. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $35 per lineal foot. The ensure compliance with Clean Water Services design and construction standards, the applicant shall employ the design engineer responsible for the design and specifications of the private water quality facility to perform construction and visual observation of the water quality facility for compliance with the design and specifications. The nameplate data for the elevator motor is 20HP, 27 RLA @ 480V 3phase, Code letter H, control transformer load is 2A @ 480V, full load "up" high speed 40A (motor plus control transformer) @ 480V- 3phase. The only load data I see for the elevator is under "Load Summary — MDP" which indicates a 40 amp load. This would seem to mean that the 125 amp breaker on the 100 amp circuit is beyond what would be required for motor starting current. Please provide electrical data on the elevator equipment and the disconnect module. Also either change the main feeder breaker to 100 amp or show me the calculations for oversizing it. 25. Sheet E6.1 — Details 1 & 2 — All grounding electrodes available on the premises shall be bonded together to form the grounding electrode system (NEC 250.50). There is more than one way to do this. If it is done within the service enclosure of 4MDP as shown in 2/E6.1, then another set of grounding electrode conductors would also have to be run from each electrode to the 2MDP service. Your bonding the two services together does not meet the requirements. You should be aware that there is an Oregon amendment to the NEC that allows another design for this type of grounding situation. Therefore, the three exits required by a new occupant load would meet the code requirements for size and spacing of the exits. On the other hand the exit system in the multi - purpose room was designed on the occupant load it now accommodate, in order to increase this load one of the direct exits to the outside would need to accommodate the new occupant load factor. Therefore, one of the doors that lead out side would need to be at least 53 inches or more in order to get the occupant load increase.
