The Alberta Rider house driveway was decided as part of the Alberta Rider School application. That was
a Type III Hearings Officer decision. We cannot modify that decision. No appeal was made so the
decision is final. According to the development code under conditional uses a change in the type and /or
location of access ways and parking areas where off -site traffic would be affected is a major modification
(18.330.030 B. 2 c.). That means to modify the HO's decision requires a complete hearing process
including pre -app, neighborhood meeting, application and hearing review by the HO. The problem with
even considering it was the School District used the closing of the driveway in its argument for approval
of their emergency access which is about 80 feet away. If the for the school is completed, the need for
the emergency access will likely go away but there are separation issues even for the existing Alberta
Rider driveways. The whole thing would be an adjustment to 18.705 H. Access Management standards
which requires a 200 foot separation and I don't know how it can meet the standards. It looks like street
access to the Alpine View subdivision across the street as well as single family home driveways may
come into play also. It is possible that if the emergency access went away and the Alberta Rider
driveways could be rebuilt to meet the separation standard on the Rider property but that does not take
into account the streets or driveway across the street. To repeat the adjustment would be a major
modification to the conditional use permit approved by the HO. Too much information I know!

RE Citation and Penalties for Use or Occupancy Without Certificate of Occupancy.
This responds to your question to Susan Ross of our office concerning our authority and basis for
issuing a Summons and Complaint and seeking penalties of up to $250.00 per day, per violation,
in cases of the use or occupancy of a structure, such as the Alberta Rider School, when it has not
yet received a Certificate of Occupancy or the final inspection approval required for same.
The 2004 Oregon Structural Specialty Code (OSSC) provides, in Section 110.1, that "No
building or structure shall be used or occupied ... until the building official has issued a
certificate of occupancy therefor as provided herein."
OSSC 112.1 provides that "it shall be unlawful for any person, firm, or corporation to ... occupy
any building, structure, or equipment regulated by this code, or cause same to be done, in conflict
with or in violation of any of the provisions of this code."
Tigard Municipal Code (TMC) Chapter 14.04.030 State Codes Adopted adopts the State codes,
including the OSSC.
TMC 14.04.090.1 provides that "no person shall ... occupy or maintain a building or structure in
the City, or cause the same to be done, contrary to or in violation of this chapter."
TMC 14.04.090.5 provides that "violation of a provision of this chapter constitutes a Class 1
civil infraction ..." and 14.04.090.6 provides that "each day that a violation of a provision of this
chapter exists constitutes a separate violation."
TMC 1.16.410 provides that "the civil penalty to be assessed for a specific infraction shall be as
follows: 1. For Class 1 infractions, an amount not to exceed two hundred fifty dollars."
Accordingly, if a structure such as the Alberta Rider School is put into use or is occupied prior to
receiving a Certificate of Occupancy the City of Tigard may issue a Summons and Complaint for
the occupancy violation and seek an award of penalties up to $250.00 per day, per violation.
Please be advised that it is our general policy and practice to serve such Summonses and seek
such penalties in cases where the potential violation and penalties have been explicitly discussed

and particularly in cases where a Temporary Certificate of Occupancy and Voluntary
Compliance Agreement has been discussed or has been entered into and then violated.
I am the City's Building Codes Enforcement Officer and it is my responsibility to serve such
Summonses and seek such penalties in the appropriate circumstances.
It is my understanding, however, that there should be no great difficulty in completing the
outstanding items under BUP2004 -00529 within the thirty (30) day period of the proposed
Temporary Certificate of Occupancy and Voluntary Compliance Agreement and, accordingly, I
hope and expect that this discussion of the authority for citation and penalties will be purely
academic and informational. If you have any questions about any of the above comments, please

I agreed to assist their representative in a solution to this double payment by contacting
Clean Water Services and finding what your policy and role would be in making a refund
to the Tigard- Tualatin School District of the Water Quantity SDC that was paid to you in
March. Are there certain forms necessary to request a refund?

6. Accessible walkways and routes shall not exceed a running slope of 1 unit vertical in
20 units horizontal (5% slope). Cross slopes shall not exceed 1 unit vertical in 50
units horizontal (2% slope).
7. Accessible parking spaces and access aisles shall be located on a surface with a slope

Dear Jer:
This letter is regarding Condition No. 13 of the Alberta Rider Elementary School
land use approval; more specifically, the condition which requires elimination of
the east Rider driveway off of Bull Mountain Road.
A meeting was held several weeks ago and a discussion ensued regarding this
condition; no conclusion was reached at that time. I have learned, however, that
if the School District is considering an appeal for the driveway to remain, it would
be a very long and complicated process. First and foremost, the appeal period
has long expired.
Because the driveway was decided as part of the Conditional Use application,
the condition is part of a Type III Hearings Officer decision. We cannot modify
that decision. In order to modify the Hearings Officer decision, a complete
hearing process, including pre -app meeting, neighborhood meeting, application
and hearing review by the Hearings Officer would be required. The School
District used this driveway closing in argument for approval of their emergency
access which is approximately 80 feet away. Should the emergency access go
away once the school is completed, there are separate issues regarding the
Rider driveway.
It would fall under an adjustment to 18.705 H. Access Management Standards,
which requires a 200 -foot separation which may not be achievable in this case.
There are clear review criteria for this adjustment, including that there are no
other alternative access points and it is not possible to share access. As a result,
it would be difficult, if not impossible, to meet the approval criteria. Also
consideration would have to be the street access to the Alpine View Subdivision
as well as other driveways across the street.

CONDITIONS OF APPROVAL
CUP 2003 -00012
THE FOLLOWING PLANNING CONDITIONS ARE REQUIRED TO BE MET
PRIOR TO ISSUANCE OF A SITE PERMIT:
1. The applicant shall place the following note on all construction documents:
"The City of Tigard Noise Ordinance prohibits construction activity in excess of 40
decibels between 9:00 p.m. and 7:00 a.m. Monday through Friday, and between
9:00 p.m. and 8:00 a.m. on Saturday and Sunday.
2. The applicant shall submit a final tree removal and protection plan that identifies
the trees to be removed and the trees to be protected. Mitigation will then be based
on the final tabulation of trees removed to those retained, per Section 18.790.030.
3. The applicant shall provide the City Arborist with a construction sequence
including installation and removal of tree protection devices, clearing, grading and
paving.
4. The applicant shall notify the City Arborist when tree protection measures are in
place so that he may verify that the measures will function properly prior to
construction.
5. The applicant shall submit permit drawings that clearly indicate the visual
clearance areas for all intersections and access points along with recommendations
by the applicant's engineer to achieve clear vision and adequate site distance.
THE FOLLOWING ENGINEERING CONDITIONS ARE REQUIRED TO BE
MET PRIOR TO ISSUANCE OF A SITE PERMIT:
MET 6. A Public Facility Improvement (PFI) permit is required for this
project to cover street improvements and any other work in the public right -of-
way. Eight (8) sets of detailed public improvement plans shall be submitted for
review to the Engineering Department. NOTE: These plans are in addition to any
drawings required by the Building Division and should only include sheets relevant
to the public improvements. Public Facility Improvement (PFI) permit plans shall
conform to City of Tigard Public Improvement Design Standards, which are
available at City Hall and at the city's webpage www.ci.tigard.or.us.
MET 7. The PFI permit plan submittal shall include the exact legal name,
address and telephone number of the individual or corporate entity who will be
designated as the "Permittee" and who will provide the financial assurance for the
public improvements. For example, specify if the entity is a Corporation, LLC,
limited partnership, etc. Also specify the state within which the entity is
incorporated and provide the name of the corporate contact person. Failure to
provide accurate information to the Engineering Department will delay processing
of project documents.
8. Additional right -of -way shall be dedicated to the public along the frontage of Bull
Mountain Road to increase the right -of -way to 37 feet from the centerline. The
description shall be tied to the existing right -of -way centerline. The dedication
document shall be on city forms. Instructions are available from the Engineering
Department.
MET 9. The applicant shall submit construction plans to the Engineering
Department as part of the Public Facility Improvement permit, which indicate that
they will construct a half - street improvement along the frontage of Bull Mountain
Road. The improvements adjacent to this site shall include
A. City standard pavement section for a Collector street from curb to centerline
equal to 23 feet;
B. Pavement tapers needed to tie the new improvement back into the existing
edge of pavement shall be built beyond the site frontage;
C. Concrete curb, or curb and gutter as needed;
D. Storm drainage, including any off -site storm drainage necessary to convey
surface and /or subsurface runoff;
E. Six-foot concrete sidewalk with a planter strip;
F. Street trees in the planter strip spaced per TDC requirements. Species
selection shall be as recommended by the City Arborist. Such trees shall be
installed prior to final building inspection.
G. Street striping;
H. Streetlight layout by applicant's engineer, to be approved by City Engineer;
I. Underground utilities;
J. Street signs, if applicable;
K. Driveway apron, if applicable;
L. Adjustments in vertical and /or horizontal alignment to construct SW Bull
Mountain Road in a safe manner, as approved by the Engineering
Department.
MET 10. The applicant's plans shall show installation of bicycle striping, markers,
legends and mini - arrows along the Bull Mountain Road frontage.
1i. Prior to commencing onsite improvements, the applicant's design and
construction plans shall include the left -turn lane with loo -foot of storage for west-
bound traffic on Bull Mountain Road at the intersection of 1 33rd Avenue, if the design
has not already been completed by others. (Note: Need assurances by Venture
Properties).

+12. Right -of -way shall be dedicated to the public for at least a cul -de -sac termination
of the "F" Street stub on the site as approved by the city. The applicant's Public Facility
Improvement permit construction drawings shall indicate that improvements, including
at least traffic control devices, concrete sidewalks, driveways aprons, curbs, asphaltic
concrete pavement, street trees, streetlights and underground utilities, shall be installed
to complete a permanent termination of ,,F Street as a cul -de -sac on the site.
Improvements shall be designed and constructed to local street standards. This
condition shall not preclude and expressly authorizes dedication and improvement of an
extension of F Street from the south edge of' the site along the west edge of the site to
the east -west public access road to dimensions, and standards approved by the city.
MET 13. The applicant's plan shall show the east Rider driveway eliminated.
MET 14. The applicant's plans shall show the proposed access onto Bull Mountain
Road as an emergency only access. That access shall be gated or otherwise improved
to prevent general public motor vehicle access, but shall be accessible to emergency
services providers, pedestrians and bicyclists. The access may be used for general
public motor vehicle access only during an emergency or when otherwise approved for
that purpose by the Planning Manager. Case Note: No emergency access proposed.
15. Deleted
16. A profile of Bull Mountain Road shall be required, extending 30o feet either side of
the subject site showing the existing grade and proposed future grade.
17. Sanitary sewer and storm drainage details shall be provided as part of the Public
Facility Improvement (PFI) permit plans. Calculations and a topographic map of the
storm drainage basin and sanitary sewer service area shall be provided as a supplement
to the Public Facility Improvement permit plans. Calculations shall be based on full
development of the serviceable area. The location and capacity of existing, proposed,
and future lines shall be addressed.
19. The applicant shall provide a public sanitary sewer main from the intersection of
133rd Avenue and the new east -west street to the stub shown in F Street on the approved
Summit Ridge subdivision plans. Note: Assurance required by Venture.
20. The applicant shall extend the public storm sewer in the east -west street to the
intersection with 133rd Avenue. Note: Assurance required by Venture.
21. Prior to construction, the applicant's design engineer shall submit documentation
of Clean Water Services (CWS) approval of the proposed storm sewer system for review
by the city (Kim McMillan).
22. Any extension of public water lines shall be shown on the proposed Public
Facility Improvement (PFI) permit construction drawings and shall be reviewed and
approved by the City's Water Department, as part of the Engineering Department plan
review. NOTE: An estimated 12% of the water system costs must be on deposit with the
Water Department prior to approval of the PFI permit plans from the Engineering
Department and construction of public water lines.
23. The applicant's plans shall be revised to show a new, public 12 -inch line
connecting to the io -inch line in Bull Mountain Road. This 12 -inch line will need to be
public in order to serve properties beyond the borders of this site. The 12 -inch line
needs to be connected to the waterline shown in F Street on the approved Summit Ridge
plans. A public waterline also needs to be extended the full length of the new east -west
street, from the site to 133rd Avenue. A minimum 15 -foot public easement will be
required where the waterline is located outside of the public right -of -way.
24. The applicant shall provide an on -site water quality facility as required by Clean
Water Services Design and Construction Standards (adopted by Resolution and Order
No. 00 -7). Final plans and calculations shall be submitted to the Engineering
Department (Kim McMillan) for review and approval prior to issuance of the site
permit. In addition, a proposed maintenance plan shall be submitted along with the
plans and calculations for review and approval. The applicant shall also provide the City
with approval from CWS for the water quality facility.
25. An erosion control plan shall be provided as part of the Public Facility
Improvement (PFI) permit drawings. The plan shall conform to the "Erosion
Prevention and Sediment Control Design and Planning Manual, February 2003
edition ".
28. The applicant shall obtain a 1200 -C General Permit issued by the City of Tigard
pursuant to ORS 468.740 and the Federal Clean Water Act.
29. The applicant shall submit preliminary sight distance certification for all
driveways and intersections related to this development. Included with the preliminary
certification shall be a detailed list of improvements required to produce adequate sight
distance.
37. Prior to submittal of permits, the applicant shall pay an addressing fee according
to the rate at the time of payment. Contact Shirley Treat, Engineering.
THE FOLLOWING PLANNING CONDITIONS ARE REQUIRED TO BE MET
PRIOR TO ISSUANCE OF A BUILDING PERMIT:
32. Prior to issuance of building permits, the applicant shall submit a final lighting
plan that indicates the lighting levels for the pathways on site. Ensure that all lighting
on site will not cause glare (measured as 1 foot candle at the property line) to adjacent
properties. This plan shall also address glare onto abutting properties from outdoor
field lighting, if applicable. Lights shall be generally oriented towards the school
building and not toward the abutting properties. The lighting plan shall include
photometric data to demonstrate compliance with the requirement.
33. Screening shall be provided on all sides of the project that abut residential
property. This requirement may be waived for those properties where the applicant has
secured written authorization from these abutting property owners to forgo this
screening.
34. . Prior to issuance of building permits, the applicant shall submit a revised
landscaping plan that shows:
A. Street trees along both sides of West Access Road and one side of SW Bull
Mountain Road, and the F Street cul -de -sac (or the eastside of an extended F
Street). Species selection shall be as recommended by the City Forester and
planted at the required spacing. Such trees shall be installed prior to final
building inspection.
B. Additional screening (vegetation or a siglfobscuring fence) along the western
edge of the bus loading area and the eastern edge of the parking area.
C. Dimensions of the landscape islands to demonstrate that tree planting areas have
a minimum three feet of width.
35. The applicant shall satisfy the requirements of Section I of Washington County's
Land Use and Transportation Department's letters dated June 3 and May 25, 2004, and
provide written confirmation from the county that their requirements have been
satisfied.
36. The applicant shall revise the site plan to indicate how Section 18.755.050
compliance will be attained.
THE FOLLOWING ENGINEERING CONDITIONS ARE REQUIRED TO BE
MET PRIOR TO ISSUANCE OF A BUILDING PERMIT:
38. During issuance of the building permits, the applicant shall pay the standard
water quantity fee (fee amounts will be the latest approved by CWS).

THE FOLLOWING PLANNING CONDITIONS ARE REQUIRED TO BE MET
DURING CONSTRUCTION OF THE PROJECT OR PRIOR TO FINAL
INSPECTION /OCCUPANCY:
30. Deleted. Refer to condition #48.
31. Lights and an amplified sound system for the playfield shall not be provided.
39. Applicant shall obtain annexation approval.
4o. The applicant shall ensure that the recommendations of the project arborist
regarding tree care have been implemented.
41. The applicant shall satisfy the requirements of Section II of Washington County's
Land Use and Transportation Department's letters dated June 3 and May 24, 2004.
47. Prior to placement of any signs on site, the applicant shall apply for a sign permit
and supply staff with the appropriate plans to verify compliance with TDC Chapter
18.780.
48. At any time after the school begins operations, if the planning manager finds that
the noise level at the south property line of the school exceeds an Leq of 60 dBA, he or
she may require the applicant to install noise attenuation measures to reduce noise
levels to 60 dBA or may schedule of public hearing before the hearings officer to
consider whether such requirements should be imposed.
THE FOLLOWING ENGINEERING CONDITIONS ARE REQUIRED TO BE
MET DURING CONSTRUCTION OF THE PROJECT OR PRIOR TO FINAL
INSPECTION /OCCUPANCY:
18. During construction, the applicant shall provide connection of proposed
buildings to the public sanitary sewage system. A connection permit is required to
connect to the existing public sanitary sewer system. (Note: Need assurances by
Venture Properties).
26. A final grading plan shall be submitted showing the existing and proposed
contours. The plan shall detail the provisions for surface drainage of all impervious
areas, and show that they will be graded to insure that surface drainage is directed to the
street or a public storm drainage system approved by the Engineering Department. For
situations where the back portions of the lot drains away from a street and toward
•
adjacent lots, appropriate private storm drainage lines shall be provided to sufficiently
contain and convey runoff.
27. The applicant shall incorporate the recommendations from the submitted
geotechnical report by URS Corporation, dated July 2003, into the final grading plan.
The geotechnical engineer shall be employed by the applicant throughout the entire
.construction period to ensure that all grading, including cuts and fills, are constructed in
accordance with the approved plan and Appendix Chapter 33 of the Uniform Building
Code.
42. The applicant shall complete the required public improvements, obtain
conditional acceptance from the City, and provide a one -year maintenance assurance for
said improvements.
43. The applicant shall either place the existing overhead utility lines along SW Bull
Mountain Road underground as a part of this project, or they shall pay the fee in -lieu of
undergrounding. The fee shall be calculated by the frontage of the site that is parallel to
the utility lines and will be $35 per lineal foot. If the fee option is chosen, the amount
will be $20,667.50 and it shall be paid prior to final building inspection.
44. The ensure compliance with Clean Water Services design and construction
standards, the applicant shall employ the design engineer responsible for the design and
specifications of the private water quality facility to perform construction and visual
observation of the water quality facility for compliance with the design and
specifications. These inspections shall be made at significant stages, and at completion
of the construction. Prior to final building inspection, the design engineer shall provide
the City of Tigard Inspection Supervisor (Hap Watkins, Building Division) with written
confirmation that the water quality facility is in compliance with the design and
specifications.
45. The applicant's geotechnical engineer shall submit a final report to the Building
Division that indicates all grading work on this site was inspected by said geotechnical
engineer, and that it was completed in accordance with Appendix Chapter 33 of the
Uniform Building Code.
46. Final sight distance certification for all intersections and driveways associated
with this development shall be provided by the applicant's engineer.

passenger side of the parking space except that two adjacent accessible parking spaces
may share a common access aisle. ORS 447.233, 1104.1
Clarify the excavation volumes and impervious areas on the second sheet of the permit
application.

The plan review was performed under the State of Oregon Structural Specialty Code (OSSC)
1998 edition; and the Tualatin Valley Fire & Rescue Ordinance 99 -01 (TVFR99 -01) 1999
edition. The submitted plans are approved subject to the following.
EROSION
1. Erosion control measures shall be in place prior to excavation or grading.
FIRE
2. The private fire service main shall be at least 30 inches below grade.
3. The private fire service main shall be flushed thoroughly before connection to the
system riser in order to remove foreign materials that might have entered the main
during the course the installation. The flow rate shall not be less than the water
demand rate of the system.
4. All piping shall be inspected prior to backfill.
FIRE DEPARTMENT ACCESS
5. The driveway is considered a fire department access roadway. The driveway, to the
point of the "Hammer Head" turnaround, shall be capable of supporting a 12,500
pound wheel point load and a gross vehicle weight of 50,000 pounds.

ACCESSIBILITY
6. Accessible walkways and routes shall not exceed a running slope of 1 unit vertical in
20 units horizontal (5% slope). Cross slopes shall not exceed 1 unit vertical in 50
units horizontal (2% slope).
7. Accessible parking spaces and access aisles shall be located on a surface with a slope
not to exceed 1 unit vertical in 50 units horizontal in all directions. 1104.4.3 OSSC
Approved Plans: 1 set of approved plans, bearing the City of Tigard approval stamp, shall
be maintained on the jobsite. The plans shall be available to the Building Division inspectors
throughout all phases of construction. 106.4.2 OSSC
American with Disabilities Act (ADA): It shall be the responsibility of the Architect,
Engineer, Designer, Contractor, Owner and Lessee to research the applicability of the ADA
requirements for the structure. The City of Tigard reviews the plans and inspects the structure
only for compliance with Chapter 11 of the OSSC which may not include all of the
requirements of the ADA
Premises Identification: Approved numbers or addresses shall be provided for all new
buildings in such a position as to be plainly visible and legible from the street or road
fronting the property.
