property. After field checking the home, we agree that a better address

suggested. Effective immediately, the address of 11128 SW 78th our office
initially assigned is invalid and 11100 SW 78th Avenue is effective.

Dear Mr. Voght,
As discussed on the morning of January 27, 1989, the floor beam in question
is not over -span. The beam is a 4" x 8" DF #2 which will support the
required 40 lbs. DL and 10 lbs. LL up to a span of 11.53 ft., as evidenced
by the calculations given you. The existing span is 10 ft. -0 in. +/ -.
As this is within loading limits for this use, I feel the requirements
of the Uniform Building Code and the State of Oregon Building Code have
been met.

Re: YOUR FIRM'S RESPONSE TO Our Request for Construction and Warranty
Corrections /Repair by your LETTER OF December 1, 1988. (Copy
Enclosed)
We do not agree with your action /conclusion on correction of the
construction and warranty items!
Since we have received your response, we have had an independent
certified partial structural inspection conducted. A copy of this
Inspection Report (Dated December 8, 1988) is ATTACHED. (The cost of
this inspection will be reimbursed to us by either you, the Builder, the
Cri:�y of T gard3• & /or FHA!) . Multiple G;i -ty -of�..:T.iga•rd & FHA construction
inspections failed to report the FIRE /LIFE SAFETY and STRUCTURAL UB code
violations and a certificate of occupancy was issued.
The Report shows that the b ^i`ld nag- T-i-n.spe;pt -ior-► missed structural defects
and that the home construction DOES NOT fully meet UBC building code:
improper fire wall construction- Fire /Life Safety requirements and a
missing floor support causing an overspan.
Structural shifts in the home already have occurred that have required
at least 3/8" be removed off the top of one door so that it could be
closed. Also there has been, and is, water under the house as the
result of an improper drainage situation, and as a result, there is an
ineffective vapor barrier condition.
It is now over 8- months, and we, the OWNER, refuse to BE PUT OFF ANY
LONGER. Your INACTION AS THE BUILDER, DENYING THERE ARE PROBLEMS, OR
REFUSING TO MAKE NECESSARY CODE CORRECTIONS AND THE NEEDED REPAIRS AS
GUARANTEED UNDER THE BUILDER'S ONE -YEAR WARRANTY has got to come to a
screeching halt!
THEREFORE, before conditions /relations further erode :
1. All corrections shall be made by the BUILDER, under your construction
responsibilities and by our homeowner's one -year warranty, within 21
days of certified receipt of this Notice, including re- inspections
(without expense to the Owner).
2. Provide evidence to the Owner that the appropriate corrections have

issued and received ; and iz yv,; ,cohp co-r o-n L6:t te sent as
notification to the Owner's lending institutions, and the involved
governmental agencies.
3. That at least, the following construction corrections and warranty -
covered repairs shall be satisfactorily made:
A. Correct the foundation support and fire /life safety construction
conditions. Assure a proper draft seal along wall footing on the
inner garage wall. Also finish other dry wall coverage in the
garage as requested and promised. Resolve the moisture situation.
Put in place, the missing floor foundation support. -
n. Re -seal tub /shower wall crack in upstairs bathroom.
C. Completely repair poor plaster condition on the living room
ceiling in the bay window section. Repair /Patch /Paint the plaster
cracks and bulges (from popped nails) on spots throughout the
house.

Dear Paul and Pat:
Upon conducting a partial structural inspection of"the
crawl area and garage wall adjoining the staircase of
your residence, I found that a support post for the
floor beam system is missing. Also, a hazardous
condition exists in that the garage firewall adjoining
the staircase does not provide a fire -stop in
accordance with Oregon Amended UBC Section 2516 2(c),
page 203, and Section 4304 (a) and (b), page 613.
This condition exists due to the misalignment of the
concrete foundation wall to the wood- framed firewall.
It, in my opinion, does not constitute a structural
problem, but it does, however, result in a draft which
does not comply with building codes.

RE: Final Check List
Dear Mr. And Mrs. Vogt,
Pat and I have discussed the items in your letter dated 11 -30 -88
and we feel that items 3 and 4 are warrantable but items 1 and 2
are not.
We will schedule our drywall subcontractor to take care of items
3'and 4 as soon as possible. He will contact you and make an
appointment.
