13 Floor plans. Show all dimensions, room identification, window size, location of smoke detectors, water heater,
furnace, ventilation fans, plumbing fixtures, balconies and decks 30 inches above grade, etc.
14 Cross section(s) and details. Show all framing- member sizes and spacing such as floor beams, headers, joists, sub -floor,
wall construction, roof construction. More than one cross section may be required to clearly portray construction. Show
details of all wall and roof sheathing, roofing, roof slope, ceiling height, siding material, footings and foundation, stairs,
fireplace construction, thermal insulation, etc.
15 Elevation views. Provide elevations for new construction; minimum of two elevations for additions and remodels.
Exterior elevations must reflect the actual grade if the change in grade is greater than four foot at building envelope.
Full -size sheet addendums showing foundation elevations with cross references are acceptable.
16 Wall bracing (prescriptive path) and /or lateral analysis plans. Must indicate details and locations; for
non - prescriptive path analysis provide specifications and calculations to engineering standards.
17 Floor /roof framing. Provide plans for all floors /roof assemblies, indicating member sizing, spacing, and bearing
locations. Show attic ventilation.
18 Basement and retaining walls. Provide cross sections and details showing placement of rebar. For engineered
systems, see item 22, "Engineer's calculations."
19 Beam calculations. Provide two sets of calculations using current code design values for all beams and multiple joists
over 10 feet long and/or any beam/joist carrying a non - uniform load.
20 Manufactured floor /roof truss design details.
21 Energy Code compliance. Identify the prescriptive path or provide calculations. A gas - piping schematic is required
for four or more appliances.
22 Engineer's calculations. When required or provided, (i.e., shear wall, roof truss) shall be stamped by an engineer or
architect licensed in Oregon and shall be shown to be applicable to the project under review.

The City of King City Planning Commission held a public hearing on July 30, 2003 to
consider the application. The Commission's decision is based on the facts, findings
and conclusions noted below.
GENERAL INFORMATION
Application

BACKGROUND INFORMATION
Site Conditions
The property is undeveloped and the eastern frontage abuts S. W. 131 Avenue. A
common paved driveway access is located along the south side of the property. This
driveway serves the subject property along with three developed lots to the west and
south. The site is wooded, containing a significant number of mature deciduous and
conifer trees.
A 0.42 -acre wetland was identified on the site as part of the West King City Study Area
Goal 5 Safe Harbor Report. This report indicates that because it is less than one -half
acre in size, it is not locally significant and did not need to be inventoried or assessed
under state land use rules. As a result, this wetland is shown in Figure 1 of Chapter
16.142 of the King City Community Development Code (CDC), but it is not subject to
any city regulation. However, it is subject to Oregon Division of State Lands (ODSL)
regulations. The applicant has contacted ODSL about constructing the proposed
house.

S. W. 131 Avenue is a public street, which is improved with a two-lane paved surface
and a gravel shoulder along the property frontage. Sidewalks and curbs are located
along much of the east side of S. W. 131 Avenue north to S. W. Fischer Road. S. W.
131 Avenue is a Washington County street, which is designated as a local street in

front of the subject property. The designation changes to a neighborhood route
between S. W. Jacob Court and S. W. Fischer Road.
• Project Description
The applicant proposes to construct one single family residence on the property. The
residence is permitted outright, and normally only a building permit is required.
However, a variance application is necessary because two setback standards of the R-
9 Zone (CDC Chapter 16.84) will not be met by the proposal.
The property is one of a group of four lots that are each approximately one acre. They
all share a common access drive to S. W. 131 Avenue. The other three parcels are
developed with single family residences, and the style of development for these three
properties, as well as the properties to the south, is typical of acreage residences.
Homes are relatively large with significant building setbacks from property lines.
In keeping with this development character, the applicant is proposing a residence with
a 140 -foot front yard setback, side yard setbacks in excess of 20 feet, and a rear yard
of approximately 150 feet The R -9 Zone is intended for a higher density residential
neighborhood with lot sizes in the 2,000 to 5,000 square foot range. The proposed
home design and its location on the property meet all of the R -9 Zone standards except
for two:
• A front yard setback of 140 feet where a maximum of 26 feet is required; and
• A garage door that is 17 feet forward of the front of the house where a
maximum distance of 6 feet is required.
The applicant is requesting a variance from these two setback standards. The
applicant has submitted a narrative and site plan in support of the variance.
Although not part of the variance application, the applicant is aware that an ODSL
permit may be required. In addition, a tree removal permit from the city will be required
in advance of a building or grading permit if more than 2 trees of 6 inches in diameter
are to be removed.
FINDINGS AND CONCLUSIONS
Variances to CDC provisions may be allowed if justification can be shown. Section
16.164.050 states that a variance may be approved if a number of criteria can, in the
opinion of the Planning Commission, be satisfied. These criteria are:
1. It will equally or better satisfy the requirement in question;
2. Special circumstances apply;
3. The use (single family residence) is allowed in the applicable zone;
4. Public facilities (e.g., streets) or natural features (e.g., wetlands) will not be
adversely affected by the requested variance; and

5. The variance is the minimum departure from the applicable standard to alleviate
the hardship.
The Planning Commission finds that the variance meets the criteria based on the
following findings.
1. The two R -9 Zone setback requirements at issue were recently adopted by the
city to help implement the West King City Plan. The minimum front yard
setback, the maximum distance that a garage may extend in front of the house,
and other design standards are all intended to provide more pleasing and
consistently designed neighborhoods. However, because the standards were
developed with relatively high density neighborhoods in mind, they do not
necessarily work well for acreage homesites. In fact, meeting the front yard
setback requirement of the R -9 Zone would be inconsistent with the character of
existing development on the south end of S. W. 131 Avenue.
2. Special circumstances apply because the subject property was created and
surrounding properties developed under Washington County regulations. The
property was recently annexed, and the two R -9 Zone standards, which are the
subject of this variance, were adopted in June 2002. Therefore, the character
of the immediate area was already formed as more of a semi -rural environment
by the time the current rules took effect.
The R -9 Zone requirements were created with new development in mind. This
is because the largest undeveloped property belonging to Matrix Development
will clearly be subdivided according to the new R -9 Zone standards. The
remaining smaller parcels, with the exception of the subject property, were
developed with homes. The West King City Plan assumed these properties
would gradually redevelop at higher densities in the future. The new R -9 Zone
standards were not designed for new homes on larger existing lots.
3. A single family residence is a permitted use in the R -9 zone.
4. Public facilities will not be affected by this variance. Although not necessarily
related, it also does not appear that natural features will be affected by the
request. If anything, removing the maximum front yard setback requirement will
offer additional flexibility to site the house in a manner to better avoid trees and
potential wetland areas on the site.
5. The proposed variance is the minimum to alleviate the hardship caused by the
regulations. The variance will enable the applicant to construct a home, which
is consistent with the housing styles and site locations in the surrounding
neighborhood. The proposed home meets all other applicable setback and
design requirements of the R -9 Zone.

DECISION
Based_ upon the above facts, findings, and conclusions, the Planning Commission
APPROVES-the proposed variance application subject to the following conditions:
1. The applicant shall provide verification to the City Manager that all necessary
permits have been obtained, including:
a. Washington County access approval to S. W. 131 Avenue, if applicable.
b. ODSL permit approval regarding development on or near the identified
wetland (Figure 1, CDC Chapter 16.142).
c. Tree removal permit, if applicable, from the City Manager.
2. This approval shall be valid if exercised within one year of the final approval date
of this application.

Due to an intergovernmental agreement with the City of Tigard, many bt ilding related permits
for projects in King City are issued and inspected by the City of Tigard.
If your permit application DOES NOT REQUIRE PLAN REVIEW, sii!aply complete the
appropriate application legibly and submit it to the King City staff The Ling City staff will
collect all fees and fax the application to the City of Tigard. City of Tigaa d staff will then create
the permit, issue the permit, and perform inspections, Please indicate on i ae permit application
whether you would like the Tigard staff to call you when the permit is rea jiy for issuance or
whether you prefer it to be mailed without any notification. Any incomplrfrce or illegible
application will be returned to King City staff for correction and no proce<sing will occur until a
complete, legible application is received.
If your permit application DOES REQUIRE ,PLAIN REVIEW, this form ;must be signed by a
King City staff person. King City staff will simply sign this form indicatirj land use approval,
Take this signed form to the City of Tigard Development Services Counter llocated at 13125 SW
Hall Blvd, Tigard, to submit applications and plans. Development Serviced Technicians are
available at 639 -4171 Ext. 304 should you bave any questions concerning s ibmirral
requirements. All permit fees will be assessed and collected at the City. of "Cgard.

To King City Planning Commission:
This narrative is a request for a variance in order to build a single- family home on my
one -acre lot that was recently annexed into King City and rezoned to R-9.
The proposed home will require two variance approvals from the Planning Commission:
1) A front yard setback of 140 feet where a maximum of 26 feet is permitted, and
2) A garage that is located 17 feet forward of the remainder of the house where the
garage must be no more than 6 feet forward of the house.
This property is located between one -acre home sites with all of the neighbors having a
single - family home on their acre. My plan ties into this area perfectly and maintains the
same flow as the surrounding neighbors area.
The R -9 designation setbacks where primarily adopted to create consistency with in the
very small lots. This property has always been owned with the intent to just build one
home within the entire acre until this recent R -9 zone change.
With the exception of the variance, this proposed use meets all of the standards of the
King City Municipal Code to the greatest extent, which is developing a single residential
home.
There is no adverse affect of placing this home behind the setbacks. Actually, it helps
since I am able to leave some great trees that under the current regulation would be in the
area of the foundation. My objective is to leave the most amounts of trees possible and
especially the largest. Currently, the house is placed in the least amount of populated tree
area.
There is no hidden agenda with this variance proposal; I am simply trying .I:o build a
single - family home in an area of other single- family homes with one -acre lots. In
addition, I have included where future development could occur and still meet the 80%
capacity of seven possible lots.
Thank you very much for your consideration into this matter, and I look forward to
enhancing this beautiful piece of property while still maintaining it's natural beauty.
