TEMPORARY CONSTRUCTION PERMIT
Frontier Communications Northwest, Inc., a Washington corporation, ( "Grantor "),
3 grants unto the City of Tigard ( "Grantee "), a Temporary Construction Permit for the
purpose of modifying a driveway transition(s) to join the grade of Burnham Street. The
(7) new grade will be crated because of the construction of the Burnham Street Improvement
Project adjacent to the property identified as 2S102DB 00100 situated in the City of
Tigard, Washington County, State of Oregon.
0 DESCRIPTION OF CONSTRUCTION PERMITTED: The Grantee is permitted to
n remove the existing driveway transition within the permitted area depicted on Exhibit "A"
U , and to construct a new driveway transition with material similar to the one that currently
exists. Grantee is also permitted to remove existing landscaping to construct access to the
adjacent Frontier property, which is described on Exhibit `B" and to construct new curbs
and to re- stripe the parking area shown on Exhibit "C."
A. THE TRUE CONSIDERATION for this conveyance is Zero Dollars ($0).
However, the actual consideration consists of or includes other property or value given or
promised which is the whole consideration.
B. IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title, or interest except those expressly stated in this easement, nor otherwise prevent

Grantor from the full use and dominion there over; provided, however, that such use shall
not interfere with the uses and purposes of the intent of the easement.
The rights granted by this easement shall be for a two year period of use that begins 21
days after written notice from the Grantee to the owner(s) of the initiation of work. Rights

will terminate upon Grantee issuance of certificate of completion of construction or five
years from the signing of this document, whichever is sooner.
