A building inspector with the city of Tigard has denied an occupancy at final inspection based on an interpretation that a flared bottom step does not constitute a winder. The approved drawing of the home is attached. Since the approach to the base of the stairs is 90 degrees to the run, it is more comfortable to use with the last step at a slight wind. This home has been built in many jurisdictions over an extended time without this being questioned, so I am in hopes we are correct. Section 314.4 does not specify a location or number of winders permitted, nor does it prohibit the bottom step from winding. I am appealing to you to assist in resolving this issue as soon as possible, to allow my buyers to occupy their new home in a timely manner, without extensive remodeling to the stairs and entry.
