A sign permit application must be completed. Since you already have a sign permit application on file for the NW corner of SW 123rd and SW Gaarde,you can use it unless any dimension has changed. Sign permit applications for freestanding signs must be accompanied by two copies of both a site plan and a plan depicting the sign itself. Both sets of plans must be drawn to a standard engineer or architect scale. The site plan should ideally delineate the visual clearance area triangle clearly. Regardless whether the visual clearance triangle is delineated, the plans must depict the location of the sign outside the visual clearance triangle area. The plan depicting the sign itself must also be drawn to a standard scale and portray the construction dimensions as well as the copy. It is customary to see a sign easement recorded on subdivision plats; sign easements assure the applicant and the city that the sign will be maintained for years to come. Since there is no sign easement recorded for the area in question, you have two options available to you. While I earlier left a message that a sign easement must be recorded, I have been informed this is not the case. A sign easement will help assure you,the applicant, that the sign will be maintained for years to come. You also have the option of recording this agreement on the deed so future owners will become responsible; this option is more of a civil agreement rather than a recorded item. Since you are the applicant and the present owner, we will process the sign permit without any proof of easement or deed agreement; we only want to ensure you are aware of the options available to you to arrange for maintenance of the sign for years to come. I also telephoned your office at 1030AM. While we have yet to converse,I thought something in writing might help address your concerns and provide documentation should you desire an appeal. With regard to the proposed sign location at the NW corner of SW 121st and SW Gaarde, it is not my opinion this is the entry point to a subdivision. The City of Tigard comprehensive plan transportation map (adopted June 11, 1991)clearly identifies both SW Gaarde and SW 121st north of SW Gaarde as major collectors; I would consider the NW corner of this intersection the intersection of two major collector streets and not the entry point to any particular subdivision. While I realize your desire is to advertise the location of Eagle Pointe subdivision, and recognize your assertion that three lots in Eagle Pointe are south of Gaarde, I do not concur the location you described adheres to TMC 18.114.130.A.3. There are also other lots south of Gaarde which are not in Eagle Pointe subdivision. Since this is considered a Director's decision, any appeal will be heard by the Planning Commission. The code allows one permanent, freestanding sign at each entry point to a platted subdivision. The location indicated is not an entry point to the Eagle Pointe subdivision. This is considered a notice of denial for this sign permit application. The sign permit applications for signs "B"(NE corner of SW 123rd and SW Gaarde) and"C" (NW corner of SW 123rd and SW Gaarde)would jointly violate TMC 18.114.130.A.3. Since the code allows one permanent, freestanding sign at each entry point to a platted subdivision, one sign permit application could be evaluated. In order to comply with our application requirements,the drawings of the sign and site need to be drawn to scale and clearly indicate the placement of the sign. In addition, owner approval must be included as the areas indicated have easements for visual clearance but there is no indication of an easement for a sign. I will hold both"B"and"C" sign permit applications on my desk awaiting your response; when I receive your response and appropriate documentation,the unaffected sign permit application will be considered denied. For example, if you apply for"C", "B" will be denied and if you apply for"B", "C"will be denied. I will also hold on to the building permit application pending your instruction. Since no building review has been completed,you are eligible for a complete refund of all monies paid on receipt number 96-281868; the monies paid were strictly related to the building permit application assigned the plan check number 7-82C. Since it is conceivable you might opt to place this structure at another location, it seems reasonable to hold on to it pending your decision.
