• 1 Exhibit "A" - r • NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0001 SENSITIVE LANDS REVIEW SLR 95 -0001 LOT LINE ADJUSTMENT MIS 95 -0004 Brock -Dixon / Gotter APPLICATION: A request for the following development applications: 1) Lot Line adjustment between two parcels; 2) Minor Land Partition approval to divide one parcel of approximately 24,829 square feet into three parcels of approximately 7,500 , 7,500 and 7,500 square feet; and 3) Sensitive Lands Review to construct storm drainage improvements within wetland area. ZONE: R-4.5 (Residential, 4.5 units per acre). LOCATION: (WCTM 1S1 35DB, tax Tots 8600 and 100) North side of SW North Dakota Street and east of SW 93rd Avenue. APPLICABLE LAW: Community Development Code Chapters 18.50, 18.84.040(D), 18.88.040(C)(1), 18.162.040, 18.162.050, 18.162.060, 18.164 DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED Minor Land Partition MLP 95 -0001 / Sensitive Lands Review SLR 95- 0001 / Lot Line Adjustment MIS 95 -0004 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I - CONDITIONS OF APPROVAL: THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO RECORDING THE FINAL PLAT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON, ENGINEERING DIVISION: 1. The applicant shall obtain a street opening permit for the driveway construction in SW North Dakota Street at a location to be approved by the City Engineer. Forms are available at the City public counter. STAFF CONTACT: Diane Jelderks, Engineering Department (639 -4171) 2. A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds and /or shown on the final partition plat. The agreement shall be approved by the Engineering Department prior to recording. STAFF CONTACT: Diande Jelderks, Engineering Department (639- 4171). 3. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the 1 impervious area within the public right -of -way. The second part is paid at Building Permit issuance which is for each individual lot. 4. Final Plat Application Submission Requirements: A. Three copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. STAFF CONTACT: John Hadley, Engineering Department (639- 4171). 5. The applicant shall provide a copy of the recorded storm drainage easement for the off -site drainage. STAFF CONTACT: John Hadley, Engineering Department (639- 4171). 6. A revised site plan shall be submitted which shows the provision of an emergency vehicle turnaround. This access shall be a level, hammerhead configured, paved surface with each leg of the hammerhead having a minimum depth of 40 feet and a minimum width of 20 feet. The applicant shall submit this plan for review and approval from the Tualatin Valley Fire District. 7. The applicant shall demonstrate compliance with the Protected Solar Building Line Option for Solar Accessibility. A lot complies with this section if a solar building line is used to protect solar access as follows: A) a protected solar building line is designated on the plat or in documents recorded with the plat; and B) the protected solar building line is oriented within 30 degrees of a true east -west access; and C) there is at least 70 feet between the protected solar building line and the middle of the north -south dimension of the lot to the south, measured along a line perpendicular to the protected solar building line; and D) there is at least 45 feet between the protected solar building line and the northern edge of the buildable area of the lot, or habitable structures are situated so that at least 80 percent of their ground floor south wall will not be shaded by structures of non - exempt vegetation. 8. A screening plan shall be submitted which shows how tax lot 8500 shall be screened along the flag lot access drive. Screening shall comply with section 18.100.080 and 18.100.090. NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 2 - o . . • PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED: 9. Provide the Engineering Department with a recorded mylar copy of the partition plat; or if not recorded with Washington County but has been approved by the City of Tigard the applicant shall have 30 days after recording with Washington County to submit the copy. 10. The applicant shall construct a minimum 5 foot fence along the length of the 25 foot wetland buffer. 11. The applicant shall replant native vegetation where vegetation has been disturbed during construction of the drainage system. A replanting plan shall be submitted for review and approval. 12. The applicant shall provide a tree inventory and submit a tree removal permit for any trees greater than 6 inches in diameter measured 4 feet off the ground which may be impacted by this proposal. SECTION II - FINDINGS OF FACT: 1. Vicinity Information The subject site is located east of SW 93rd Avenue, west of SW 92nd Avenue and north of SW North Dakota Street. Properties to the south, east and west are zoned R- 4.5 (Residential, 4.5 units per acre). Properties to the north are zoned R -12 (Residential, 12 units per acre). 2. Site Information and Proposal Description This site is approximately 24,829 square feet in size. The site is vacant with frontage on SW North Dakota Street. The site slopes down from the its frontage on SW North Dakota Street from an elevation of 188 to an elevation of 170 at the north property boundary. A wetland area has been delineated on the property to the north, with a portion of this boundary adjacent to the north property of the proposed partition. The applicant requests for the following development applications: 1) Lot Line adjustment between two parcels; 2) Minor Land Partition approval to divide one parcel of approximately 24,829 square feet into three parcels of approximately 7,500 square feet each; and 3) Sensitive Lands Review to construct storm drainage improvements within wetland area. The lot line adjustment will adjust the northern NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 3 • property boundary of tax lot 8600 to match a portion of the boundary of the delineated wetland. This adjusted property will then be partitioned into 3 Tots. 3. Agency Comments The City of Tigard Maintenance Services Department has reviewed this proposal and has offered the following comments: The catch basin and storm sewer line to the wetland should be made private as they serve only the driveways and are not related to the public system. The sanitary sewer line and pump should be designated private. The Unified Sewerage Agency has reviewed this proposal and has offered the following comments: Public storm and sanitary sewers should be made available to each lot. The Tualatin Valley Fire District has reviewed this proposal and has offered the following comments: The applicant shall provide for an emergency vehicle turnaround between parcels 2 and 3, per Tualatin Valley Fire and Rescue ordinance and fire code. General Telephone and Electronics has reviewed this proposal and has offered the following comments: Developer to coordinate utility placement for all utilities. The City of Tigard Building Division, City of Tigard Water Department, and Portland General Electric have reviewed this proposal and have no objection to it. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 4 • • • 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's comprehensive plan in that the newly created lots will continue to allow for residential development. This proposal supports the Low Density Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A is satisfied as the proposed lot widths for parcels 1, 2 and 3 are approximately 85, 85, and 70 feet respectively, exceeding the minimum 50 foot lot width requirement in the R -4.5 zone. Criteria B is satisfied as this partition would create lots of approximately 7,500 square feet each, satisfying the 7,500 square foot minimum lot size requirement. The proposed lot frontage of lot 1 is approximately 85 feet. Proposed lots 2 and 3 shall have a 15 foot legally recorded access easement to SW North Dakota Street, thereby satisfying the minimum 15 foot frontage requirement of Criteria C. Criteria D shall be satisfied as setbacks will be reviewed when the lots are built upon. Criteria E is not applicable to parcel 1 as this lot is not a flag lot. Criteria E shall be satisfied on parcels 2 and 3 as setbacks will be determined and reviewed when the lots are built upon. Criteria F shall be satisfied as the applicant shall provide a screening plan which screens tax lot 8500 in accordance with this requirement. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H is not applicable to lot 1. Criteria H shall be satisfied for lots 2 and 3 as a joint use and maintenance agreement shall be recorded with the plat for the common driveway. Criteria I shall be satisfied on lot 1 when the lot is built upon. The site plan indicates that Tots 2 and 3 shall be served by a 15 foot access drive with 10 feet of pavement, thereby satisfying access requirements (18.108.070.A). In addition, access drives in excess of 150 feet in length shall provide for an emergency vehicle turnaround. This access shall be a level, hammerhead configured, paved surface with each leg of the hammerhead NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 6 • having a minimum depth of 40 feet and a minimum width of 20 feet. A revised site plan shall be submitted which provides for an emergency vehicle turnaround in accordance with this criteria. Criteria J is not applicable to these Tots as they are not within the floodplain. Section 18.88.010(Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. As proposed, none of the lots meet the basic lot requirement. As an alternative the applicant can comply with this section using the Protected Solar Building Line Option. A lot complies with this section if a solar building line is used to protect solar access as follows: A) a protected solar building line is designated on the plat or in documents recorded with the plat; and B) the protected solar building line is oriented within 30 degrees of a true east -west access; and C) there is at least 70 feet between the protected solar building line and the middle of the north -south dimension of the lot to the south, measured along a line perpendicular to the protected solar building line; and D) there is at least 45 feet between the protected solar building line and the northern edge of the buildable area of the lot, or habitable structures are situated so that at least 80 percent of their ground floor south wall will not be shaded by structures of non - exempt vegetation. None of the proposed lots meet the basic requirement. The applicant shall comply with the protected solar building line option. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: Access to the parcels is proposed by a common use driveway within a 15 foot wide easement that would connect to SW North Dakota Street, a local residential street. The existing street right -of -way width is 50 feet and no further dedications are required. However, the street has not been improved to City standards and the applicant should be required to sign an agreement to waive the property owner's right to oppose or remonstrate against the formation of a future Local Improvement District to improve SW North Dakota Street. 2. Sanitary Sewer: The existing 8" sewer located in SW North Dakota Street has sufficient capacity for the proposed development. The applicant proposes to construct a gravity service NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 7 . �► • lateral from Lot 1, contiguous to SW North Dakota Street, to the existing main, and provide private sewer pumps and separate force main sewer pipe connections for the two rear Tots. The closest sewer main that would serve all lots with a gravity sewer lateral would require an extension across the property to the north, across a wetland. The City has received pre - application information from proponents of development of this adjacent site and a gravity sewer may be available soon. The applicant is encouraged to meet with the adjacent property owners in order to work out an agreement that would provide gravity sewer service to all the proposed lots. 3. Storm Sewer: The property slopes in a northerly direction towards the wetland on the adjoining property to the north, as mentioned above. The drainage from the proposed residential construction, as proposed by the applicant, will provide for an underground storm drain system that will deposit the water onto the adjacent property in an easement obtained by the applicant. The underground system would end in an approved rip -rap structure that would reduce the velocity and dissapate the energy of the flow, in accordance with the requirements of the City and Unified Sewerage Agency. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in -lieu be required. SECTION IV - FINDINGS AND CONCLUSIONS - Sensitive Lands Review Chapter 18.84.040(D) states that the Director shall approve or approve with conditions an application request for sensitive lands permit within wetlands based upon findings that all of the following criteria have been satisfied: 1. The proposed landform alteration or development is neither on wetland in an area designated as significant wetland on the Comprehensive Plan Floodplain and Wetland Map nor is within 25 feet of such a wetland. The proposed drainage line is not in an area NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 8 • • designated as significant wetland on the Comprehensive Plan Floodplain and Wetland Map. 2. The extent and nature of the proposed landform alteration or development will not create site disturbances to an extent greater than the minimum required for the use. The applicant is proposing to excavate and replace approximately 1 cubic yard of storm drain utility line backfill material and install a 3 foot by 3 foot by 1 foot rock outfall pad in Tess than .001 acres of wetland. The applicant will perform all related work manually and will replant all removed vegetation. The work will be the minimum amount of work necessary to install storm drain improvements. Fifty cubic yards of fill is the standard for Division of State Lands review and a fill permit under the Uniform Building Code. 3. Any encroachment or change in on -site or off -site drainage which would adversely impact wetland characteristics have been mitigated. Drainage will not be impacted by this proposal and native vegetation shall be replanted in the area of work. 4. Where natural vegetation has been removed due to landform alteration or development, erosion control provisions of the Surface Water Management program of Washington County must be met and areas not covered by structures or impervious surfaces will be replanted in like or similar species in accordance with Chapter 18.100, Landscaping and Screening. The applicant will be required replant native vegetation in the area of work. 5. All other sensitive lands requirements of this chapter have been met. Other sections are not applicable as this parcel does not contain steep slopes, drainageways or floodplains. 6. The provisions of Chapter 118.150, Tree Removal, shall be met. The applicant shall submit a tree inventory and submit a tree removal permit for any trees greater than 6 inches in diameter measured 4 feet off the ground which may be impacted by this proposal. 7. Physical Limitations and Natural Hazards, Floodplains and Wetlands, Natural Areas, and Parks, Recreation and Open Space policies of the Comprehensive Plan have been satisfied. The applicable Comprehensive Plan Policies are satisfied as follows: NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 9 • • Policy 3.1.1 provides that the City shall not allow development in areas meeting the definition of wetlands under chapter 18.26 except where it can be shown that established and proven engineering techniques related to a specific site plan will make the area suitable for the proposed development. (Note: This policy does not apply to lands designated as significant wetlands on the floodplain and wetlands map.) Policy 3.1.1 shall be satisfied as the applicant is proposing minor drainage work within the wetland area and will be providing a 25 foot buffer for home construction. Policy 3.2.4 provides that the City shall prohibit development within areas designated as significant wetlands on the floodplain and wetlands map. No development shall occur on property adjacent to areas designated as significant wetlands on the floodplain and wetlands map within 25 feet of the designated wetlands area. Development on property adjacent to significant wetlands shall be allowed under the planned development section of the code. This wetland is not designated as a significant wetland on the floodplain and wetlands map and a 25 foot buffer has been provided from the edge of the delineated wetland. In addition, the City of Tigard has adopted Unified Sewerage agency R &O 91 -47. Chapter 6.08.3 states that a division of land adjacent to sensitive areas shall preserve and maintain an undisturbed corridor for a buffer wide enough to protect the water quality functioning of the sensitive area. The undisturbed corridor shall be a minimum of 25 feet wide, measured horizontally, from the defined boundaries of the sensitive area. In order to provide adequate protection of the buffer and wetland area, the applicant will be required to construct a minimum 5 foot fence along the length of the buffer area. SECTION V - FINDINGS AND CONCLUSION - LOT LINE ADJUSTMENT Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; NOTICE OF DECISION MLP 95- 0001 /SLR 94- 0003 /MIS 95 -0004 - GOTTER Page 10 • • • • 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will adjust lot lines, however an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500 square foot minimum lot size and the 50 foot average minimum lot width requirements of the R-4.5 zone. Development improvements on the proposed tax Tots will be reviewed when it is developed. In addition to meeting the above standards, a lot line adjustment must also meet the following criteria applicable to lots created through the minor land partition process. This criteria is addressed in Section 18.162.050 above. SECTION VI - DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 95 -0001 / Sensitive Lands Review SLR 95 -0001 / Lot Line Adjustment MIS 95 -0004 subject to the conditions listed in Section I at the beginning of this decision. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE DATE OF THIS DECISION. 1. Navigation. No activity may cause more than a minimal adverse effect on navigation. 2. Proper maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. 3. Erosion and siltation controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest practicable date. 4. Aquatic life movements. No activity may substantially disrupt the movement of those species of aquatic Ilfe indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's primary purpose Is to Impound water. 5. Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to minimize soil disturbance. • 6. Regional and case -by -case conditions. The activity must comply with any regional conditions which may have been added by the division engineer and any case specific conditions added by the Corps. . 7. Wild and Scenic Rivers. No activity may occur in a component of. the National Wild and Scenic River System; or in a river officially designated by Congress as a "study river° for possible inclusion in the system, while the river is in an official study status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service. • 8. Tribal rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved • water rights and treaty fishing and hunting rights. • • 9. Water quality certification. In certain states, an individual state water quality certification must be obtained or waived. 10. Coastal zone management. Incertain states, an individual state coastal zone management consistency concurrence must be obtained or waived. 11. Endangered Species. Historic properties. No activity which may affect Historic properties listed, or eligible for listing, in the National Register of Historic Places is authorized, until the DE has complied with the provisions of 33 CFR 325, Appendix C. The prospective permittee must notify the district engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall not begin the activity until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the State Historic Preservation Office (SHPO) and the National Register of Historic Places. 13. Monitoring Reports. A copy of the mitigation monitoring reports prepared for the authorized project shall be forwarded to the Portland District, Corps of Engineers, Regulatory Branch. • Enclosure 2 • • SPECIAL CONDITIONS: In addition to the General Conditions, the following conditions apply only to activities that involve the discharge of dredged or fill material and shall be followed for authorization by the nationwide permits to be valid: 1. Water supply intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is for repair of the public water supply intake structures or adjacent bank stabilization. 2. Shellfish production. No discharge of dredged or f111 material may occur In areas of shellfish production, unless the discharge Is directly related to a shellfish harvesting activity authorized by nationwide permit. 3. Suitable material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, debris, car bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts. 4. Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e. on- site), unless the DE has approved a'compensation mitigation plan for the specific regulated activity. 5. Spawning areas. Fills in spawning areas in spawning seasons must be avoided to the maximum extent practicable. 6. Obstruction of high flows. To the maximum extent practicable, discharges must not permanentiy'restrict or impede the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). • 7. Adverse impacts from Impoundments. If the discharge creates an Impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and/or the restriction of Its flow shall be minimized to the maximum extent practicable. 8. Waterfowl areas. Discharges into breeding areas for waterfowl must be avoided to the maximum extent practicable. 9. Removal of temporary fills. Any temporary fills must be removed In their entirety and the affected areas returned to their preexisting elevation. 10. Water Quality Certification has been granted by Oregon Department of Environmental Quality for Nationwide Permit 12 provided the fill volume within waters of the United States does not exceed 500 cubic yards or occur in an estuary, and subject to the following conditions: 10a. All in -water work, including temporary fills, shall occur within the Oregon Department of Fish and Wildlife in- water work period. 10b. Turbidity shall not exceed 10% above natural stream levels, and in no case shall the turbidity increase adversely affect an identified beneficial use as defined in OAR 340 -41. The turbidity standard may be exceeded for limited duration, provided all practicable erosion control measures are Implemented, Including: 1) use of filter bags, sediment fences, leave strips or berms, or other measures sufficient to prevent offsite movement of soil, 2) use of impervious material to cover stockpiles when left unattended or during storm events, 3) graveled construction access roads to prevent movement of material offsite via construction vehicles, 4) sediment traps or catch basins to settle out suspended solids prior to water entering ditches or waterways, 5) placement of waste materials and spoils above the bankiine and/or In approved disposal areas. 10c. All areas of soil disturbance shall be seeded or otherwise revegetated with native species as soon as practicable upon project completion to prevent subsequent erosion. 10d. The approximately 3.5 acre property is northeast and the area bounded Saw. 95th Avenue and S.W. North Dakota Street to Avenue on the west. Field work was conducted on August 31, 1994. 2.0 METHODOLOGY AND SOURCE MATERIALS 2.1 The Federal Manual The primary source document used in our investigation was the "Corps of Engineers Wetlands Delineation Manual," Technical Report Y -87 -1 (Environmental Laboratory 1987). This manual is currently recognized by both the Oregon Division of State Lands and the Army Corps of Engineers for the delineation of wetlands within Oregon. The 1987 manual provides technical criteria, field indicators, and recommended procedures to be used in determining whether an area is a jurisdictional wetland. The manual requires three technical criteria in undisturbed situations before areas can be considered wetland under federal or state jurisdiction. These criteria are hydric soils, hydrophytic vegetation, and wetland hydrology. Hydric soils are those that have formed exclusively under wet conditions (soils which characteristically have high water tables, soils which are ponded or are frequently flooded, or soils which are otherwise saturated for extended periods during the growing season). Hydrophytic vegetation consists of those plant species that have adapted to growing in substrates which are periodically deficient of oxygen due to saturated soil conditions. Five basic groups of vegetation are recognized based on their frequency of occurrence in wetlands. These categories, referred to as the "wetland indicator status," are as follows: obligate wetland plants (OBL) are estimated to occur almost exclusively in wetlands (> 99%); facultative wetland (FACW) plants are estimated to occur 67-99% of the time in wetlands; facultative (FAC) plants. occur equally in wetlands and non- wetlands (34 -66 %); and facultative upland (FACU) plants usually . occur in non - wetlands (67 -99 %). If a species is not assigned to one of the four groups described above it is assumed to be an obligate upland (UPL) plant, which is estimated to occur almost exclusively in non - wetlands (>99%). The wetland hydrology criterion can be met, however, if saturation within the major portion of the root .zone is present for only 5 percent of the growing season depending on the wetland status of the plant community. The growing season for any given site or location is determined from U.S. Soil Conservation Service data and information. 2.2 Field Methodology Prior to beginning field work, a compilation of available information and data was conducted. This included a review of soil series boundaries, the U.S.G.S. topographic quadrangle, and the U.S. Fish and Wildlife Service National Wetland Inventory map. These efforts were made to develop a preliminary indication of where potential wetland may exist and to facilitate the on -site gathering of data. Observations of soils, vegetation, and hydrology were made using the "Routine Onsite" method of the manual. One -foot diameter soil pits were excavated to a depth of 18- inches in selected locations. The soil profiles were examined for hydric soils and wetland hydrology field indicators. In addition; a visual percent -cover estimate of the dominant species of the plant community for a 30 -foot radius area was performed using soil pit locations as a center of reference. Data were recorded in the field and subsequently transferred to standard wetland delineation data sheets (included in the Appendix). Data were collected for representative sampling locations; however, numerous soil pits were excavated between these data points to verify changes in the three parameters. 3.0 PRESENT SITE CHARACTERISTICS • 3.1 Topography The project site is located within the lower Fanno Creek drainage. Its topography is mostly flat to gently sloping, generally toward the northeast. Surrounding properties are gently to moderately sloping generally toward the north. A wide, very shallow swale is oriented from the southwest corner to the northeast. Elevations within the property boundaries range from approximately 175 to 170 NGVD. 3.2 Hydrology Hydrologic activity on the site is restricted to the southwest to northeast swale. This broad, mostly flat area collects and transports surface and ground water to the northeast side of the property. The swale drains into a shallow ditch that borders Highway 217 at the foot of the roadbed slope. The area is drained by a culvert under the highway that flows into Ash Creek across the highway and north of the site. Surface flows are intermittent and associated with storm events, though groundwater seepage from adjacent slopes keeps soils saturated in the lower reaches of the swale through the early summer. Page 2 • The Wetland hydrology criterion was largely satisfied by wetland drainage patterns and other evidence of hydrology such as matted plant material, algal mats and, active oxidized root channels in the upper soil layers within the drainage swale. 3.3 Soils Two soil types, Aloha silt loam, (map unit 1) and Cove silty clay loam (map unit 13) have been mapped by the Soil Conservation Service (SCS 1982) as occurring on the project site (Figure 2). Cove silty clay loam has been listed as hydric by the SCS (1989) and Aloha silt loam has inclusions of Huberly soil which is also listed as hydric (SCS 1989). Aloha silt loam is a somewhat poorly drained soil with moderately slow permeability that formed in alluvium or lacustrine silt on broad, smooth valley terraces. The soil is classified as a fine -silty, mixed, mesic Aquic Xerochrept. Typically, the surface layer is dark brown silt loam approximately 8 inches thick. The subsoil is dark -brown and dark yellowish- brown, mottled silt loam about 38 inches in thickness. The substratum is dark yellowish- brown, mottled silt loam and very fine sandy loam about 19 inches thick. Cove silty clay loam is a poorly drained soil with very slow permeability that formed in recent clayey alluvium on flood plains. The soil is classified as a fine, montmorillonitic, mesic Vertic Haplaquoll. Typically, the surface layer is very dark gray, mottled silty clay loam approximately 8 inches thick. The subsoil is very dark gray, gleyed and mottled clay about 32 inches in thickness. The substratum is very dark gray clay to a depth of 60 inches or more. Soils sampled on the site were primarily comprised of silt loam and silty clay loam, with colors ranging from black (10YR 3/1) in the wetter areas to very dark grayish brown (10YR 3/2) in other areas. Mottling was apparent at sampling sites within the swale. 3.4 Vegetation The project site is dominated by a relatively mature mixed deciduous /coniferous forest that has not been significantly disturbed for at least 40 years. The mix of species indicates primarily wetland conditions, with the exception of those in the northwestern and southeastern corners of the site. The tree canopy is dominated by Oregon ash (Fraxinus latifolia)(FACW). The shrub /woody vine understory includes holly (Ilex spp.)(UPL), hazelnut (Corylus cornuta)(UPL), serviceberry (Amalanchier alnifolia)(FACU), snowberry (Symphoricarpos albus)(FACU), Indian plum (Oemleria cerasiformis)(FACU), California dewberry (Rubus ursinus)(FACU), Himalayan blackberry (Rubus discolor)(FACU) clustered rose (Rosa pisocarpa)(FAC), twinberry honeysuckle (Lonicera involucrata)(FAC +) and red -osier dogwood (Cornus stolonifera)(FACW). Species common in transitional to more upland areas include sword fern (Polystichum munitum)(UPL), English ivy (Hedera helix)(UPL), velvetgrass (Holcus lanatus)(FAC), Dewey 's sedge (Carex deweyana)(FACU), and catchweed bedstraw (FACU). 4.0 DISCUSSION AND CONCLUSIONS The U.S. Fish and Wildlife Service, as part of the National Wetland Inventory (NWI) program, has not mapped wetland within the project area (USFWS 1982) (Figure 3). The NWI maps were generated primarily on the basis of interpretation of color infrared aerial photographs (scale of 1:58,000), with selected "ground truthing" only conducted to confirm the interpretations. Our investigation of hydric soils, wetland hydrology, and hydrophytic vegetation . has determined that approximately 47,291 square feet, or 1.09 acres, of the project site is potentially jurisdictional wetland (Figure 4). The wetland is restricted to a shallow Swale that occurs as a broad band oriented from the southwest corner to the northeast corner in the center of the site. At the northeast property line surface flows enter a shallow ditch bordering Highway 217 and a culvert oriented northeast under the highway. The presence of Oregon ash higher in the drainageway may indicate the prevalence of wetter conditions in previous years. Offsite residential development upslope has probably influenced runoff frequency and duration in the swale. It should be noted that wetland boundaries determined by SRI /SHAPIRO do not become jurisdictional until the U.S. Army Corps of Engineers and the Oregon Division of State Lands review and approve our work. • • SRI /SHAPIRO, Inc. TT8130 — Publish March 16, 1995. • • MEMORANDUM CITY OF TIGARD TO: Will D'Andrea March 1, 1995 FROM: Michael Anderson, Development Review Engineer SUBJECT: MLP 95- 0001 /MIS 95- 0004 /SLR 95 -0001 DIXON -DART /ROYAL OAKS Applicant is requesting approval to divide Tax Lots 1S1 35DB 100 & 8600, a parcel located on SW North Dakota Street, easterly of SW 93rd Avenue, into three parcels with areas of 7500 sft each. Findings: 1. Streets: Access to the parcels is proposed by a common use driveway within a 15 foot wide easement that would connect to SW North Dakota Street, a local residential street. The existing street right -of -way width is 50 feet and no further dedications are required. However, the street has not been improved to City standards and the applicant should be required to sign an agreement to waive the property owner's right to oppose or remonstrate against the formation of a future Local Improvement District to improve SW North Dakota Street. 2. Sanitary Sewer: The existing 8" sewer located in SW North Dakota Street has sufficient capacity for the proposed development. The applicant proposes to construct a gravity service lateral from Lot 1, contiguous to SW North Dakota Street, to the existing main, and provide private sewer pumps and separate force main sewer pipe connections for the two rear lots. The closest sewer main that would serve all lots with a gravity sewer lateral would require an extension across the property to the north, across a wetland. The City has received pre- application information from proponents of development of this adjacent site and a gravity sewer may be available soon. The applicant is encouraged to meet with the adjacent property owners in order to work out an agreement that would provide gravity sewer service to all the proposed lots. 3. Storm Sewer: The property slopes in a northerly direction towards the wetland on the adjoining property to the north, as mentioned above. The drainage from the proposed residential construction, as proposed by the applicant, will provide for an underground storm drain system that will deposit the water onto the adjacent property in an easement obtained by the applicant. The underground system would end in an approved rip -rap structure that would reduce the velocity and dissapate the energy of the flow, in accordance with the requirements of the City and Unified Sewerage Agency. ENGINEERING COMMENTS MLP 95 -01 DIXON- HART /ROYAL OAKS PAGE 1 • • The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. 1. The applicant shall obtain a street opening permit for the driveway construction in SW North Dakota Street at a location to be approved by the City Engineer.
