DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION PAGE 1 OF 4 LLA2010 -00004 - KERNAN LOT LINE ADJUSTNIENT CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED: UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE CHERYL CAINES IN THE PLANNING DIVISION AT 503 - 639 -4171. The applicant shall verify the correct Book number for Parcel 2 and modify the proposed Property Line Adjustment Survey map to reflect the correct Book number prior to recording (Book 874 is shown, but the City Surveyor noted it should be 854 to match the deed). 2. Following recording, the applicant shall provide evidence to the City that the Lot Line Adjustment survey map was recorded within 18 months of this decision. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information & Proposal Description: The site is located on the north side of Fonner Street, just west of the intersection and is made up of two parcels. Parcel 1 is a flag lot located north of Parcel 2. The applicant is proposing to adjust one K line, which will reconfigure two separate parcels (Parcels 1 & 2). This adjustment is to match the flag portion of Parcel 2 with a driveway that has been 1n use since 1965 and utilize an existing parking pad for a turn- around or additional parking on Parcel 2. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; two (2) lots exist and two (2) lots will remain after the proposed adjustment. The R-4.5 zone has a minimum lot size of 7,500 square feet. In any event, the lots will be 14,676 and 18,331 square feet after the adjustment. Therefore, this standard is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The resulting lot sizes will remain above the minim required in the R-4.5 zone. There are homes located on both sites. The home on Parcel 1 meets current setbacks, and the proposed adjustment moves property lines further from the home. The rear and eastern side yards are being reduced on Parcel 2. The new setbacks, as shown on the site plan are: 29.11 feet - rear and 5.61 feet side. Therefore, this standard has been satisfied. NOTICE OF TYPE I DECISION PAGE 2 OF 4 LLA2010 -00004 - KERNAN LOT LINE ADJUSTMENT The resulting parcels are in conformity with the dimensional standards of the zoning district, including: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15_ foot wide access easement; and Setbacks shall be as required by the applicable zoning district. Minimum lot size and setbacks have been previously discussed. The average minimum lot width is 50 feet for the R-4.5 zone. Parcel 1 averages 90 feet and Parcel 2 averages approximately 68 feet. Parcel 2 has frontage on SW Fonner Street. Parcel 1 is an existing flag lot and is accessed by a 10 -foot flag to SW Fonner Street. It is unknown when the parcel was created, but land survey records show both the home and parcel existed in 1972. The applicant is proposing to slightly widen the flag, but it will not meet the 15 -foot requirement. This standard does not apply to this application since it is for a lot line adjustment rather than a partition. The flag portion of Parcel 1 is included in the lot area. Excluding this area, the minim lot size of 7,500 square feet is still met. With regard to flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The proposed lot line adjustment involves an existing flag lot. These standards are not applicable since the site is developed with a single- family residence and screening, in the form of fences, is provided along the eastern lot line along the driveway. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire- fighting capabilities. No new accessways are being created with this application. This criterion is satisfied. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant states that no new development is taking place and that there is no need for any new easements. This criterion is satisfied. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. No new accessways are proposed with this application. Each site will continue to have access to SW Fonner Street. NOTICE OF TYPE I DECISION PAGE 3 OF 4 LLA2010 -00004 - KERNAN LOT LINE ADJUSTMENT Exemptions from dedications: A lot line adJJ'ustment is not considered a development action for purposes of determining whether floodplain, greenway, or right -of -way dedication is required. Floodplain, greenway and right -of -way dedication is not required as part of this application. Therefore, this standard does not apply. Variances to development standards: An ap lication for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met or can be as conditioned. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was posted at City Hall and mailed to: • The applicant and owners • Affected government agencies Final Decision A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The parcel at 10905 SW Fonner St. is a flag lot behind 10915 SW Fonner St. A sliver of the driveway for 10905 SW Fonner St. is actually owned by the owners of 10915 SW Fonner St., and it has been that way for the last 45 years. This lot -line change corrects this problem. b. The former owner of the parcel at 10915 SW Fonner St. installed an asphalt parking pad on which to park his motorhome. That parking pad is located alongside the driveway leading to 10905 SW Fonner St., and it looks like it is a part of that property. The owners of the parcel at 10905 SW Fonner St. have offered to purchase the parking pad from the owners of 10915 SW Fonner St., and the owners of 10915 have agreed to this change pending the city's approval of a lot -line adjustment. This parking pad will be used as a turn- around point and for additional parking by the owners at 10905 SW Fonner St. A2. Reducing the lot size of 10915 SW Fonner St. will not violate the size development or zoning district regulations.
