Page 649, Washington County Records, to have and to hold the above - described real property and easement rights unto the Public forever for the uses and purposes hereinabove stated; provided, however, that grantors retain for themselves and for their assigns the right in perpetuity to claim the real property herein dedicated and the real property described in Exhibit "B" hereof which is attached hereto and is by this reference 1 - GREENWAY DEDICATION l 6 made a. part hereof, one:k<parcel for planning purposes and fulfilling landscaping requirements of the City of Tigard and any other governmental body having jurisdiction hereof, dealing for that sole purpose, with both parcels as a whole. The said easement is for the benefit of the realty described in said Exhibit "B ". The grantors hereby covenant that, (i) they are the owners in fee simple, (ii) they will pay all taxes and assessments due and owing on the property, (iii) the pro- perty is free of all liens and encumbrances and they have good and legal right to grant the rights above - described except: 1. The aforedescribed easement. 2. The property is within and subject to the sta- tutory power of assessment of the Unified Sewerage Agency of Washington County, Oregon. 3. The property is subject to an easement, including the terms, rights and provisions thereof for a sewer granted to Safeguard Automotive Corporation and recorded August 24, 1972 in Book 884, Page 224, located upon the easterly 30' of the property.
