Tax lot 2S114AB -01201 (16283 SW 92nd Avenue, Parcel A) has a deed
encumbrance of perpetual private agreement to allow tax lots 2S114AB -01202
and 2S114AB -01200 access of 10 feet north from the south property line of tax
lot 2S114AB -01201 This easement is a private easement that does not facilitate
the location of any public (City of Tigard, etc.) utility, rather it allows the two flag
lots a 30 -foot wide access -way (ingress & egress) and for water, sanitary or
storm sewer construction of building laterals. There is also a 5 -foot dedicated
public easement on Parcel A at the east property line adjacent to 92nd Avenue.
The new fence located at 16283 SW 92nd Avenue encloses that private
easement and is a violation of the deed similar to trespass. The City of Tigard
does not recognize private easements, regardless of initiation by
subdivision /partition plat or deed encumbrance. This means that the fence
location is a private or civil matter.
Prior to 1983, land partitions were recorded with the tax assessor's office,
but not reviewed for zoning and /or building code violations. This is one reason
why the easement is not shown on the Washington County tax assessor's maps.

Department Code Enforcement Officer may contact the owner of record by mail
or in person if necessary. Chapter 18 of the Community Development/Municipal
Code is enforced at the time of building improvements or development for future
use (i.e., your building permit MST97 -0527) when complaints are received. To
date, no complaints have been received.
