ZONING
DESIGNATION: I -P: Industrial Park District. The I -P zoning district provides appropriate
locations for combining light manufacturing, office and small-scale commercial
uses, e.g., restaurants, personal services and fitness centers, in a campus -like
setting. Only those light industrial uses with no off -site impacts, e.g., noise,
glare, odor, vibration, are permitted in the I -P zone. In addition to mandatory
site development review, design and development standards in the I -P zone
have been adopted to insure that developments will be well- integrated,
attractively landscaped, and pedestrian - friendly.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject parcels are located at 16060 and 16580 SW 85`" Avenue and is part of the Durham
Advanced Wastewater Treatment Facility and its associated offices. The site has indirect access off 85`
Avenue via the RV Dump Station Loop. The site is part of an existing conditional use approval for
Basic Utilities.
Proposal Description:
Construction of a 2,037 square foot addition onto the west side of an existing headworks building in
order to accommodate new wastewater screens and grit processing equipment. Associated with the
addition is reconstruction of the entrance gate and drive aisle, resulting in the conversion of
approximately 4,500 square feet of existing landscaping to impervious surface.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
MINOR MODIFICATION TO CONDITIONAL USE: Section 18.330.20.B contains the
following criteria for approval of a request for Minor Modification of a Conditional Use:
Section 18.330.020.B.2 states that the Director shall determine that a major modification has
resulted if one or more of the changes listed below have been proposed:
a. A change in land use;
The subject property has a conditional use classification of Basic Utilities. No change in land
use is proposed as part of this project.
b. A ten % increase in dwelling unit density;
The proposed project does not affect dwelling unit density.
A change in the type and /or location of access ways and parking areas where off -site
traffic would be affected;
The project will not impact off -site traffic. The reconstructed entrance gate and drive -aisle are
only accessible from an existing, in -plant access road.
d. An increase in the floor area proposed for non - residential use by more than 10 %where
previously specified;
The project would result in the addition of 2,037 additional square feet of process structure, on
a 105 acre facility containing 749,981 existing square feet of process structures. The expansion
represents 0.3 percent increase in structural floor area.
e. A reduction of more than 10% of the area reserved for common open space and /or
usable open space;
The project will result in the conversion of approximately 4,500 square feet of landscaped area
to impervious surfaces, representing far less than 10% of the common and /or usable open
space for the entire facility.

f. A reduction of spc led setback requirements by more to �, 20 %;
This project will have no impact on setbacks from the public rights -of -way. The headworks
building expansion reduces the distance from the building to the property line with Tigard High
School from approximately 385 feet to 345 feet. As part of the Durham Phase 4 project
however, Clean Water Services (CWS) built a landscape berm on the west perimeter of the
property to reduce impacts.
g, An elimination of project amenities by more than 10 % where previously specified,
such as:
1. Recreational facilities;
The project will not change the amount of landscaped area and water features that the
general publi c is all owed to use. Although the total amount of landscape and treed
areas wiIl be reduced by 4,500 sqquare feet, the impacted area is not in the vicinity of the
publicly accessible area east of 85 Avenue.
2. Screening;
The view of the headworks building from the in -plan access road will not appreciable
change because the entrance will be the same size, only shifted to the west.
3. Landscaping provisions;
As discussed above, the project will result in a small net reduction in landscaped area
but will not impact publicly accessible recreation facilities or screening.
h. A 10 % increase in the approved density;
There is no approved density associated with the conditional use of Basic Utilities.
FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a
conditional use have been met.

In addition, the Director must find that the proposed
change is in compliance with all applicable requirements of
Title 18 of the Tigard Development Code. To complete
this review, the Applicant's proposal must include a
discussion indicating how the site expansion /change will
continue to comply with the maximum setback, building
height, parking, and landscaping standards. Other
requirements of this title such as clear vision, solid waste
storage, non - conforming situations, signs, and tree
removal may also be applicable depending on the type and
location of the proposed modifications.

district in the State of Oregon, Grantee, the following described real property!
A parcel of land situated in the southeast one - quarter of the
northwest one - quarter of Section 13, Tnwrship 2 South, Range t
Vast of the Willamette Neridinn, Washington County, Oregon,
more particularly described as follows:
Beginning at the northwest corner of the southeast nne - qunrter
of the northwest one- qunrter of the aforesaid Section 131 thence
easterly along the north line of the southeast one. - qunrter of the
northwest nne- quarter of Section 13, n distance of 202.2 feet more
or less, to the northerly right of way line of the Oregon Electric

said facilities within the said two -year period, Grantor shall have
the right, for a period of one year from and after the expiration

consideration paid by Grantee, without further ion- onsation for any

of Grantorfs intent to repurchase sold premises. Upon the service

Applicant's Statement/Narrative
Summary of Prop Changes.
Purpose. Clean Water Services (CWS) is designing a project to rehabilitate process
equipment within the CWS's existing Headworks Building of the Durham Advanced
Wastewater Treatment Facility located at 16060 SW 85` Avenue. The project also
includes a small (approximately 2037 square foot) building expansion to house new
process equipment. The purpose of these improvements is to improve the process
efficiency of the wastewater screening unit process. The extent of processing (washing
and dewatering of the screened material) will be improved in order to meet the ultimate
landfilling requirements of the material.
Current Situation. CWS's Headworks building houses tankage and equipment that screen
undesirable debris and grit and rocks out of wastewater for ultimate landfill disposal. The
existing equipment in this building is approximately 20 years old, is subject to a fairly
high degree of wear, and is in need of replacement.
Proposed Changes. CWS is proposing to replace the existing wastewater screens and grit
processing equipment in place with new more efficient equipment. In addition, new
screenings washing and compacting equipment will be added in an expansion of the
existing building to the west. The proposed building addition and associated sitework is
shown on the attached drawings. The addition will require reconstruction of the entrance
drive and gate also as shown on the attached Drawings.
Compliance of Proposed Changes with 18.330.020(B)(2) Criteria.
Below are itemized responses to the criteria indicated in 18.330.020(B)(2):
a. A change in land use: No change in land use is proposed. This portion of the
overall Durham Facility is zoned I -R (Industrial Park) and is a `basic utility' use
according to the Community Development Code — the Clean Water Services
Durham Wastewater Treatment Facility.
b. An 10% increase in dwelling unit density: There are no dwelling units on site and
this site is not residential.
c. A change in the tvDe and location of access ways and parking areas where off -site
traffic would be affected: There is no impact on offsite traffic. This project
includes only reconstruction of the building entrance which has access off of an
existing private in -plant road.
d. An increase in the floor area proposed for non - residential use by more than 10%
where previously specified: The use is a 105 acre treatment facility with an
existing conditional use. There is currently 749,981 square feet of process
structures on the site. The Headworks building expansion of 2037 square feet
represents and 0.3 precent increase in plan area.
e. A r eduction of more than 10% of the area reserved for common ope space and/or
usable open space: The reconstruction of the entrance results in a net conversion
of approximately 4500 square feet of currently landscaped area to impervious
area. This is well less than one percent of the common/usable open /space of the
plant site.
f. A reduction of specified setback requirements by more than 20 %: This project
has no impact on setbacks from the public rights -of -way. The headworks building
expansion reduces the distance from the building to the property line with Tigard
High School from approximately 385 feet to 345 feet. As part of the Durham
Phase 4 project however CWS built a landscape berm on the west property
perimeter to mitigate impacts.
g. An elimination of project amenities by more than 10% where previously
specified provided such as: Recreational facilities screening, or landscaping
provisions:
o Recreational Facilities: The Durham Facility provides a significant amount
of grassed, treed and garden landscaped area and water features that the
general public is allowed to use. This project will not change the amount
of such area. Although the total amount of treatment plant landscaped area
will slightly decrease (by approximately 4500 square feet), the impacted
area is not in the vicinity of the public accessible area east of 85` Avenue.
• Screening The view of the Headworks building from the in -plant access
road will not appreciably change because the entrance will be the same
size only shifted to the west. The landscaping along the access will be
similar to, and an extension of, what currently exists.
• Landscaping: Per the above two items, this project results in a small net
reduction in landscaped area but no impact on recreational facilities and
screening.
