Dear Ms. Mulalley:
This letter is in response to your request for Minor Modification (.MMD2010- 00012) approval to construct a 195
square foot building on an existing substation site. The building will house control and relay racks and other
ancillary equipment needed to safely operate and protect the substation. A search of City records revealed another
Minor Modification (MMD97- 00003) was issued in 1997 for co-location of antennas for an existing monopole.
Accordin to the Tigard mapping system, the proposed location of the building may be within a Clean Water
Services �CWS) vegetated corridor and is within the CWS potential impact area. Therefore, the applicant is being
conditioned to provide a CWS Service Provider Letter approving the location of the building.
Analysis of Modification Request:
Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the
requested modification meets any of the major modification criteria, that the request shall be reviewed
as a new Conditional Use application."
Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if
one (1) or more of the changes listed below have been proposed:
1. A change in land use; The existing use of this site is Basic Utilities. The use is not proposed to change.
2. A 10% increase in dwelling unit density; The site is not developed with a residential use; therefore, this
criterion is not applicable.
3. A change in the type and /or location of access ways and parking areas where off -site traffic
would be affected; The proposal is to construct a small building near the rear of the site. No changes
are proposed to the access ways. There is no parking on -site. This standard is satisfied.
4. An increase in the floor area proposed for non - residential use by more than 10% where previously
specified; The request is to construct a 195 square foot control house on a concrete foundation. The
appli cant states that the size of the substation is 2.11 acres. This is the total site size. According to aerial
photos, the existing equipment takes up about 14,000 square feet. The addition of this structure will
result in an overall increase of approximately 1.4 %. This standard is met.

5. A reduction of more than 10% of the area reserved for common open space and /or usable open
space; This site does not have any dedicated open space. This standard does not apply.
6. A reduction of specified setback requirements by more than 20 %; The applicant is not asking for a
reduction of setbacks. This standard is not applicable.
7. An elimination of project amenities by more than 10% where previously specified provided such
as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions; Most of the site is
covered with gravel. The new building is proposed within a gravel area. This proposal does not affect
any on -site recreational facilities, screening, or landscaping. In fact the building will provide screening for
control equipment to be installed. This standard is satisfied.
8. A 10% increase in the approved density; The proposed modification request does not involve
residential development; therefore, no increase to density is involved in the request.
Conclusion
This request is determined to be a minor modification to an existing site. The Director's designee has determined
that the proposed minor modification of this existing site will continue to promote the general welfare of the Caty
and will not be significantly detrimental, nor injurious to surrounding properties provided that, development
which occurs after this decision complies with all applicable local, state, and federal laws and the condition of
approval below:
THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO
THE FOLLOWING CONDITION AND LIMITATIONS. PLEASE SUBMIT A COPY OF THIS
LETTER WITH YOUR BUILDING PERMIT APPLICATION.
1. Prior to issuance of the building permit, the applicant shall submit a Clean Water Services (CWS)
Service Provider Letter to the Planning Division (attention: Cheryl Caines, 503- 718 - 2437).

Minor Modifications:
Minor Modifications are processed for permitted uses and
conditional uses. To review a modification as a Minor
Modification, the Director must first find that the expansion
or change does not invoke one or more of the criteria
discussed within Section 18.360.050(B) – Site Development
Review or Section 18.330.020(B)(2) – Conditional Use. If the
modification exceeds the maximum allowed under any one or
more of the criteria, a Major Modification review is required.
Major Modifications are processed in the same manner as a
new Site Development Review or Conditional Use Permit.

Request: PGE is requesting a Type I Minor Modification of a

following dimensions: 13' x 15' x 11' within the confines of

CHAPTER 18.330
CONDITIONAL USE
18.330.010 Purpose
A. Purpose. The purpose of this chapter is to provide standards and procedures under which a
conditional use may be permitted, enlarged or altered if the site is appropriate and if other
appropriate conditions of approval can be met. There are certain uses which due to the
nature of the impacts on surrounding land uses and public facilities require a case -by -case
review and anal
PGE Response:
PGE is submitting an application for a Type 1 Minor Modification of a Conditional Use, per a
conversation with Tigard Planning on 4122110. This application is being submitted to allow for
placement of a control house with dimensions of 13'x 15'x 11 ' tall within the confines of the
existing substation graveled, fenced area.
18.330.020 Approval Process
B. Major modification of approved or existing conditional use.
2. The Director shall determine that a major modification(s) has resulted if one or
more of the changes listed below have been proposed:
a. A change in land use;
PGE Response: The addition of a control house will not change the existing land use of the site;
it is simply an addition to already existing substation equipment within the existing fenced,
graveled substation yard, therefore this change should not apply.
b. A 10% increase in dwelling unit density;
PGE Response: No dwellings currently exist on -site nor or any proposed, as this site houses and
electrical substation; therefore this change should not apply.
C. A change in the type and/or location of access ways and parking areas
where off -site traffic would be affected;
PGE Response: No changes are proposed to the site access or on -site parking as a result of the
addition of the control house; therefore this change should not apply. Existing substation access
will remain along the east property line of the site off a frontage road, therefore this change
should not apply.
d. An increase in the floor area proposed for non - residential use by more

PGE Response: The control house will be 195 sq. ft. in size at a height of H'. This structure will
be placed on a concrete foundation. The total size of the substation site is 2.11 acres. The
addition of this structure will encompass .002 acres of the 2.11 site, which is an overall increase
of I increase in use of the site; therefore this change should not apply as we are well under the
10% threshold.
e. A reduction of more than 10% of the area reserved for common open
space and/or usable open space;

PGE Response: This site does not have any dedicated common open space, as this is a secure
site with a fence around the perimeter with a locked gate and is only accessible to PGE personnel,
as this is a substation. The addition of the control house to the site will result in a reduction of
less than I% of the remaining usable open space, which in this case is the fenced, graveled area;
therefore this change should not apply.
f. A reduction of specified setback requirements by more than 20 %;
PGE Response: There are no setbacks impacted by this proposal, as the control house will be
placed within the fenced area; therefore this change should not apply.
g. An elimination of project amenities by more than 10% where
previously specified provided such as:
(1) Recreational facilities;
(2) Screening; or
(3) Landscaping provisions; and
PGE Response: This change should not apply to this request, as there are no recreational
facilities on -site and the placement of the control house will be within the existing fenced area
where PGE has already established screening and landscaping to City Code requirements when
the substation was constructed.
h. A 10% increase in the approved density.
PGE Response: As previously mentioned, the addition of this control house will impact the site
less than 1 % of the total size of the site. Density will not be impacted and this change should not
apply to this request.
C. Minor Modification of approved or existing conditional use.
1. Any modification which is not within the description of a major modification as
provided in Subsection B above shall be considered a minor modification.
2. An application may request approval of a minor modification by means of a Type I
procedure, as regulated by Section 18.390.030, using approval criteria in
Subsection C.3 below.
3. A minor modification shall he approved, approved with conditions, or denied
following the Director's review based on findings that:
a. The proposed development is in compliance with all application
requirements of this title; and
b. The modification is not a major modification as defined in
Subsection A above.
PGE Response:
PGE does not meet any of the changes listed in 18.330.020.B.2 (a -h); therefore we are subject
to] 8.330.020. C with our proposal to install a control house on -site, which is the purpose of this
application. PGE will adhere to the Director's findings based on review of our application.

D. Phased development approval. As part of the approval process, the Hearings Officer shall
approve a time schedule for developing a site in phases over a period of time of one year,
but in no case shall the total time period for all phases be greater than three years without
reapplying for conditional use review.
PGE Response:
This proposal is a one -time installation and does not necessitate further development of the site;
therefore phased development approval should not apply.
E. Approval en riod. Conditional use approval by the Hearings Officer shall be effective for a
period of 1 -1/2 years from the date of approval.
PGE Response:
Once approval is received, and any conditions of approval are met, PGE plans to install the new
control house on -site and within the 1 -1/2 year timeframe of the effective date of the approval.
18.330.030 Approval Standards and Conditions of Approval
A. Approval standards. The Hearings Officer shall approve, approve with conditions, or deny
an application for a conditional use to enlarge or alter a conditional use based on findings
of fact with respect to each of the following criteria:
1. The site size and dimensions provide adequate area for the needs of the proposed
use;
2. The impacts of the proposed use of the site can be accommodated considering size,
shape, location, topography, and natural features;
3. All required public facilities have adequate capacity to serve the proposal;
4. The applicable requirements of the zoning district are met except as modified by
this chapter;
5. The applicable requirements of 18.330.050; and
6. The supplementary requirements set forth in other chapters of this code including
but not limited to Chapter 18.780, Signs, and Chapter 18.360, Site Development
Review, if applicable, are met.

PGE Response:
1. The current size of the tax lot is 2.11 acres, which the majority of the site is fenced and
graveled. Inside the perimeter of the fence there is more than sufficient room to install the
control house. Please refer to the aerial drawing in this narrative for a depiction of the
current site configuration.
2. The site is graveled entirely within the fenced perimeter and the addition of the control
house will not impact size, shape, location, topography or natural features.
3. The purpose of adding the control house to this site is to house the control and relay racks
and other ancillary equipment needed to safely operate and protect the substation.
Existing facilities are on -site and are adequate to operate the equipment in the control
house. No other public facilities are required on -site, as this is an existing substation.
4. PGE is in compliance with the applicable requirements of the zoning district with this
application.
5. 18.330.050 is not applicable to this application, as we are not requesting a variance and
the additional development standards are not specific to utilities.
6. PGE has reviewed Chapter 18.780, Signs, and finds Inds that this section of the Code is not
relevant to this application, as no new signs are being proposed as part of this application.
PGE has reviewed Chapter 18.360, Site Development Review, and has found that
18.360.060 Minor Modification to Approved Plans or Existing Development does apply
and by means of this application we are in compliance with this portion of the code.
Accompanying this application is three copies of the proposed modified site development
plan and this narrative which indicates the rationale for the proposed modification
addressing the changes listed in Section 18.360.050.B, which are not applicable to this
application, as we do not meet any of the evaluation criteria to be considered a major
modification to a conditional use.
B. Conditions of approval. The Hearings Officer may impose conditions on the approval of a
conditional use, which are found necessary to ensure the use is compatible with other uses
in the vicinity, and that the impact of the proposed use on the surrounding uses and public
facilities is minimized.
PGE Response:
PGE will adhere to the decision set forth by the City of Tigard in its review of this application.
18.330.040 Additional Submittal Requirements
A. Additional submission requirements. In addition to the submission requirements required
in Chapter 18.390, Decision - Making Procedures, an application for conditional use
approval must include the following additional information in graphic, tabular and/or
narrative form.

This section of the Code is not applicable, as this is a request for a minor modification of a
conditional use, and based upon the discussion with Tigard Planning on 4123110 PGE only needs
to submit the required elements for a Minor Modification — Type I Application.

18.330.050 Additional Development Standards for Conditional Use Types
A. Concurrent variance application(s). A conditional use permit shall not grant variances to
the regulations otherwise prescribed by this title. A variance application(s) may be filed in
conjunction with the conditional use application and both applications may be heard at the
same hearing.
B. Additional development standards.

additional development standards.
