Dear Mr. Wentz:
This letter is in response to your request for Minor Modification (MMD2010- 00016) approval to construct a 560
square foot building on the Tigard High School site. The building will be used as additional storage for the
Clothes Closet, which is an organization of the school district foundation that provides shoes and clothing to
needy families. The proposed location is within a gravel drive adjacent to another building being used for the
Clothes Closet. Since there are other access aisles on the site, placement within this underutilized, gravel drive
will not hinder circulation. A search of City records revealed several land use applications over the years. These
include Conditional Use Permits for additions, a Development Code Amendment to allow bus parking on -site,
Minor Modifications for bus parking and modular classrooms, and a Minor Land Partition.
Analysis of Modification Request:
Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the
requested modification meets any of the major modification criteria, that the request shall be reviewed
as a new Conditional Use application."
Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted
if one (1) or more of the changes listed below have been proposed:
1. A change in land use; The existing use of this site is a school. The use is not proposed to change. The
proposed accessory building will be used for storing materials for a school district foundation.
2. A 10% increase in dwelling unit density; The site is not developed with a residential use; therefore, this
criterion is not applicable.
3. A change in the type and /or location of access ways and parking areas where off -site traffic
would be affected; The proposal is to construct a small building near the eastern boundary of the site.
No changes are proposed to the driveways used to access the site. On -site parking will not be affected.
This standard is satisfied.
4. An increase in the floor area proposed for non - residential use by more than 10% where previously
specified; The request is to construct a 560 square foot accessory building on -site. Accessory structures
are limited to 528 square feet within residential zones, unless the site size is 2.5 acres or larger. The
school site is 43.20 acres, thus the building may be 1,000 square feet. The applicant did not provide
information on existing building square footages. City records show an approved addition in 2006 of

more than 72,000 square feet. Ten percent of this addition alone would be 7,200 square feet. The
addition of this structure will not result in an overall increase of more than 10 %. This standard is met.
5. A reduction of more than 10% of the area reserved for common open space and /or usable open
space; The building is proposed within a gravel area and is therefore not common or usable open space.
This standard is satisfied.
6. A reduction of specified setback requirements by more than 20 %; The applicant is not asking for a
reduction of setbacks. The required setback for an accessory structure is 5 feet and 10 feet is proposed.
This standard is not applicable.
7. An elimination of project amenities by more than 10% where previously specified provided such
as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions; The new building is
proposed within a gravel area. This proposal does not affect any on -site recreational facilities, screening,
or landscaping. This standard is satisfied.
A 10% increase in the approved density; The proposed modification request does not involve
residential development; therefore, no increase to density is involved in the request.
Conclusion
This request is determined to be a minor modification to an existing site. The Directors designee has
determined that the proposed minor modification of this existing site will continue to promote the general
welfare of the City and will not be significantly detrimental, not injurious to surrounding properties provided
that, development which occurs after this decision complies with all applicable local, state, and federal laws.

SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION.
THIS REQUEST FOR MINOR MODIFICATION APPROVAL IS HEREBY GRANTED.

Subject: Caring Closet Application for Minor Mod
Hello: Just clearing up a few loose ends here. It may be that you have been part of the Email
exchange regarding the "Caring Closet" building that is proposed to be built at the High School.
It is a new building of about 20x28 that will require minor modification land use approval. They
will likely come in the first week in June with a minor mod application. Council has determined
that the City will pay the minor modification fee and City Admin has identified Residential
Services /Agency Set Aside (Social Services: 590) as the source. $6,000 was budgeted this FY.
Please work with Finance - IT on how to get the appropriate fee amount transferred. Please see
attached the material provided by Liz Newton.

Re: Minor Modification
The minor modification request is to add a storage building to the east side of the
existing Clothes Closet. The Clothes Closet is a Tigard - Tualatin School District
Foundation organization that provides shoes and clothing to needy families. During
the past year, more than 1400 families have been served by the Closet.
Due to a steady flow of donations from private and business contributors, the Closet
is in the happy position of needing additional storage. Not only does the Closet
occasionally receive a large shipment of items, but they also try to keep seasonal
items appropriately stored.
When I met with the city planning department, they thought a title or deed was not
necessary to attach to the application.
With regards to Tigard City Code 18.360.050 (B):
1. There will be no increase in dwelling unit density

The area proposed for' the structure is currently a gravel drive. It was originally
installed when the 2004 additions were made to Tigard High School. Subsequently it
was used for Balloon festival access until the eastern portion of the driveway was
restored to athletic fields. Currently the drive way ends just beyond the proposed
structure in a temporary gate. This gate is scheduled to be removed this summer and
permanent fencing installed.
The structure will have a ten foot (10') set back from the property to the east. This
property is currently a light industrial park.
The height of the structure will not exceed 15' which will make it considerably
shorter than the two portable buildings to the south and west.
Rainwater drainage will be addressed in the building plans and conform to applicable
codes; including the city and/or Clean Water Services.
There will be no clear vision issues, no trees need to be cut down and there will be no
signage needed.
This structure will occupy a space that is rarely used except for an occasional car for
parking purposes.
If there is additional information needed, I would be more than happy to supply it.
