APPLICATION SUMMARY FILE NAME: BOURKE REAR YARD SETBACK ADJUSTMENT CASE NO.: Development Adjustment (VAR) VAR2010 -00016 PROPOSAL: The applicant requests approval for an adjustment to reduce the rear yard setback requirement by 20% to accommodate a covered deck. Currently, the roofed structure encroaches into the setback and the applicant requests the variance to avoid a total rebuild of the structure. APPLICANT: Erin M. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section W. VAR2010 -00016 Bourke Rear Yard Adjustment Decision 122210 Page 1 CONDITIONS OF APPROVAL PRIOR TO FINAL BUILDING INSPECTION THE FOLLOWING CONDITIONS SHALL BE MET. Staff contact: Hap Watkins, Assistant Planner, 503 - 718 -2440. 1.) Prior to final building inspection and closure of the code enforcement case, the applicant shall call for inspection by the Planning Division to verify property lines and setbacks. 2.) The northeast and northwest property corner survey pins shall be located and exposed to accurately show the north property line. The southeast corner pin shall also be located and exposed to show the east property line. 3.) No structure shall be constructed to encroach into the sanitary sewer easement. 4.) No structure shall be constructed to encroach into the easement provided for Fire Department vehicles (the hammerhead turnaround). THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Site Information: The property is one of two homes built on two lots of a minor land partition. There is a 20 ft. private drive with hammerhead turn around easement for emergency vehicles. Partition plan 2002- 084 shows 5.6 feet of easement on the property for sanitary sewer along the north property line. The end of the hammerhead is 34.99 feet from the east property line. Site History: The property was approved as Parcel 1 of the 2002 Stark minor land partition, D1LP2002- 00002. Proposal Description: The applicant requests an adjustment to reduce the rear yard setback requirement by 20% to accommodate a covered deck beyond the 15 ft. setback. SECTION IV. Section 18.370.020.B.2, Approval Criteria, provides that a development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: a. A demonstration that the adjustment requested is the least required to achieve the desired effect; The applicant has requested a 20% reduction in the required rear yard setback of 15 feet. This would reduce the rear yard setback to 12 feet. All other setbacks will be adhered to. The adjustment is the least required to be able to re- construct the roofed deck in compliance with the Development Code. b. The Adjustment will result in the preservation of trees, if trees are present in the development area; No trees will be removed due to this construction and there are none that need protection. C. The Adjustment will not impede adequate emergency access to the site; The Adjustment will not impede emergency access as noted in condition #3 and #4. d. There is not a reasonable alternative to the Adjustment which achieves the desired effect. There is no reasonable alternative to the Adjustment that will allow the proposed project. FINDING: Based on the analysis above, the adjustment approval criteria have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and owners. Final Decision: The decision of the Director on Type I Procedure is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THE DECISION IS FINAL ON DECEMBER 22, 2010 AND BECOMES EFFECTIVE ON DECEMBER 23, 2010. The rear setback for this zone is 15' -0" with a possible variance allowance of 3' -0" bringing the rear setback allowance to 12' - 0 11 . The property owner had a structure built that encroached into the rear setback beyond that which was allowed and has now provided plans and specifications to the City of Tigard to remove a portion of said structure in order to meet the 12' -0" rear setback. If approved the resulting structure will be permitted and inspected and shall meet the variance allowed 12' -0" rear setback. The rear property line that was shown on the submitted Site Plan was verified by using the original site plan which was submitted and approved at the time the home was built.
