And has the unrestricted right to grant the easement hereinafter described relative to the real estate; NOW, THEREFORE, in view of the premises the first party does hereby dedicate, donate, grant, assign and set over to the second party an easement to all portions of the real estate that fall within the existing 100 -year floodplain of Fanno Creek (ie., all portions of the real estate below elevation 150.0) (the "Drainage Area ", more particularly described in the attached Exhibit "A ") and all property 15 feet above (to the east of) the 150.0 foot floodplain boundary (the "Bike /Pedestrian Path Area ", more particularly described in the attached Exhibit "B ") (the Drainage Area and the Bike /Pedestrian Path Area shall be collectively referred to as the "Easement Area "). The easement shall allow the second party to undertake only the following uses in the Easement Area: Agreement For Easements between Dolan and Company, L.L.C. and City of Tigard After recording return to: City of Tigard, c/o City Mayor 13125 SW Hall Blvd. Tigard, OR 97223 AGREEMENT FOR EASEMENTS - 1 A. The easement will allow the second party access to the Drainage Area only for the purpose of conducting or constructing flood and drainage controls, repairs and improvements for the purposes of reducing or preventing flooding and erosion and for improving drainage within the City boundaries of the second party. The easement will not allow the general public to access the Drainage Area. B. The easement will allow the second party access to the Bike /Pedestrian Path Area for the purpose of constructing and maintaining a bicycle and pedestrian path and to use as necessary for activities allowed in the Drainage Area. The easement will allow the general public access to the Bike /Pedestrian Area only for the purpose of walking and using unmotorized forms of transportation such as bicycles. C. The first party may build a fence to exclude the general public from the Drainage Area and from access to the rear of the first party's building or buildings existing or proposed to the located upon the real estate. Except as to the rights herein granted, the first party shall have the full use and control of the above described real estate. The easement described above shall continue for a period of perpetuity and run with the land. This easement shall bind and inure to the benefit of, as the circumstances may require, not only the immediate parties hereto but also their respective heirs, executors, administrators and successors in interest. In construing this agreement, where the context so requires, the singular includes the plural and all grammatical changes shall be made so that this easement shall apply equally to individuals and corporations, or limited liability companies. Mathematical closure on Bike Path Easement The legal descriptions for the "Greenway" easement and the "Bike Path" easement were prepared prior to the survey of the boundary of the property. Since the surveyed boundary differs from the pre - surveyed boundary the easement descriptions become somewhat ambiguous. I used several different methods for locating the easement. In my professional opinion the following method is correct. The "locating" dimensions within the legal description are called as "more or less ", therefore making the location of both easements subject to some interpretation. The southwesterly line of the "Bike Path" easement is coincident with the northeasterly line of the " Greenway" easement. Therefore once the "Greenway" easement is located the "Bike Path" easement is immediately northeast therefrom. Within the body of the " Greenway" easement is the verbiage: "Thence along the southwesterly line of said Lot 1". The next two courses are therefore along the southwesterly property line. The legal then states: "To said 'southeasterly right of way line; thence along said right of way line North 57 °00'00 East, 15.,34 feet to the point of beginning." This leads me to locate the "point of beginning" of the "Greenway" easement at 15.34 feet from the intersection of the southwesx'4oundary of the property with the southeasterly right of way. Regarding dimensions along the southwest line, according to the plat of "Burnham Tract" they were 121.4 feet and 128.7 feet. Donald Holly used a dimension of 126.40 feet instead of 121.4 feet (see Exhibit Map) when he prepared the legal descriptions. The Vesting Deed stated 121.4 feet. Since I held a distance of 121.40 feet for the southerly portion of said line, the northerly portion of said southwesterly line shifted southwesterly due to the 5 foot shorter previous course. I calculated the "shift" as South 57 °04'28" West, 2.71 feet. I added the 2.71 feet to the 15.34 feet to determine the point of beginning of the "Greenway" easement. I then calculated the area within the "Greenway" easement (see page 4), said area is 4,582.55 square feet. The area of the "Greenway" easement according to the legal description is 4,583 square feet. The "Bike Path" easement was set adjacent to the northeast line of said "Greenway easement" and 15 feet wide, when measured at right angles. In my opinion this is the best resolution based on the existing legal descriptions. Sincerely, C. R.
