Mr. Boros,
The City of Tigard Building Division has not yet received application for permits for the fire repair
at the above referenced site. We are concerned that the structure, as it now exists, is in a
condition that is unsafe and may be a hazard to the other occupants of the building. Section
14.16.380 C. 1. of the Tigard Municipal Code states, "Whenever any portion of a structure has
been damaged by fire, earthquake, wind, flood, or by any other cause, to such an extent that the
structural strength or stability is materially less than it was before such catastrophe and is Tess
than the minimum requirements of Chapter 14.04 for new buildings of similar structure, purpose,
or location," it shall be deemed a "Dangerous Structure." It also may be deemed a public
nuisance as defined in Section 14.16.380, L. The fire that damaged this structure occurred on
December 17, 2000. The City of Tigard has given you ample time to obtain the necessary
permits to perform repairs to this structure. We have not seen any progress on your part to bring
this issue to a close and make the necessary repairs.
Plans and structural calculations will be required to be submitted for review or the City will have
no alternative but to act on this issue. Please contact us no later then seven (7) days of receipt
of this letter and obtain permits and commence work within thirty (30) days of receipt of this

Failure to respond can and will result in class I civil infractions of $250.00 per day per infraction.

Mr. Boros,
Pursuant to our phone conversation on the afternoon of June 25, 2001, I am sending you this
letter of understanding of. your commitment to the City of Tigard. You indicated you were still
negotiating with your insurance company regarding your claim and should have some monetary
settlement within thirty (30) days. We also discussed the timelines you were going to submit
plans for the repair to the Building Division. You said you had a contractor in mind that could
provide us with plans that we could review. Based on this conversation, and your statement that
you could provide plans within two (2) weeks, we would expect a submittal for permits no later
than the third week of July 2001. We feel this is not an unreasonable timeframe based on the
amount of time that has passed since the fire. We could review the plans and provide you with
comments during the time you are negotiating with your insurance company.

Unless there is some immediate resolution to this matter, the City is seriously considering legal
• action, up to and including, declaring it a dangerous structure and requiring the hazard to be
