Enclosed with this letter you will find a calculation sheet showing the
computation that has been performed to determine the amount of the
Traffic Impact Fee (TIF) to be paid for the project noted above. The amount
of the TIF is $10,652.00.
You have three payment options available to you. The first is to pay the TIF
at the time you are issued a building permit. The second is to arrange for
payment over time by signing a promissory note (if you wish to exercise
this second option please contact me for additional details). The third
option is to defer payment until occupancy. Traffic impact fees are subject
to an annual increase of up to 6% if not paid or financed prior to July 1st
of each year.
Please note that you may appeal the discretionary decisions made in
determining the appropriate category and the amount of the fee based on
that category. A notice of appeal must be received by the City Recorder no
later than 5:00 p.m. on December 26, 1995 and must be accompanied by
the $625.00 appeal fee required by Washington County. Although filed
with the City Recorder, an appeal would be heard by the Washington
County Hearings Officer.

from a second floor. Section 3303(a) is specific as to the

occupant load on the second floor is 10 or more. Provide two
exits from the second floor of Office #2. Office #1 will be
restricted to an occupant load of less than 10 for future use.

clarify the specific type of business activities that the tenant will be conducting on site.
Northwest Auction Galleries employs about 7 people who provide support to the
business. The business provides estate planning, appraisals, storage and a private
auction. The majority of the business is performing appraisals. Approximately 70% -
75% of the business is directed toward this aspect of the business. The majority of the
appraisals are performed off site for northwest financial institutions, estate sales, etc.
Artwork appraisals and the proof of authenticity is also an aspect of the appraisal process.
Northwest Auction Galleries will catalog the items being appraised and prepare, in the •
office, an itemized list establishing the quality, cost and quantity of the items in the
estate. Some items are brought to the office and are stored in either the office,
warehouse, staging or auction areas while the appraisals are being performed.

Estate planning consulting is another aspect of the business. Representatives of
Northwest Auction Galleries review the contents of the estate and establish a value of the
estate and a strategy on how to dispose of the -items in the estate.
During the estate appraisal and consulting process of the business, there are certain times
when the estate is required to place the items of the estate in storage. Storage can be long
term and the clients are charged a monthly fee. Another option is that items can be
stored while waiting for appraisals. Items in storage are located throughout the facility,
depending on the amount or size of the items. Financial institutions or probate officers
will pay to have items stored at Northwest Auction Galleries facility due to the security
provided by them. Overseas shipments are also stored on site until they are itemized
and/or shipped to other auction houses or dealers.
As an outcome of the appraisal process, some items are designated to be disposed of via
the auctioning process. This aspect of the business comprises approximately 20% - 30%
of the business. The auctions are held once a month and performed in two sessions (two
consecutive evenings.) Guest are allowed to preview the auction items only during the
two days prior to the auction at established times. Attendance is by invitation only and
primarily (90 %) of the people attending are wholesale buyers. Some clients are from out
of state and a catalog is sent to them so they may bid on items by either fax or telephone.
Due to the amount of expensive items stored or auctioned on site all persons attending
the auction must be pre- approved in order to attend or purchase any items. Other than
preview and auction dates the facilities is not open to the public. That is, the auction
aspect of the business occurs only four days per month. The only exception to this is, for
private appraisals which are scheduled by appointment only.
Besides the business aspects of the company Northwest Auction Galleries organizes
seminars for local wholesale clients. The seminars are provided as a courtesy to their
clients and are given by selected experts in the specific fields.

Hopefully this outline has provided you with adequate information to explain and
determine the type of use being proposed for the Duncan building. It is clear that this is
not a retail establishment and if one must categorize the auction function as a retail
activity, that the remaining portions of the building are not specific to the auction
activity. If you must categorize the auction as a retail activity, the auction area comprises
of less than 20% of the building and this is allowed to occur within the zone designation.

stored while waiting for appraisals. Items in storage are located throughout the facility,
depending on the amount or size of the items. Financial institutions or probate officers
will pay to have items stored at Northwest Auction Galleries facility due to the security
provided by them. Overseas shipments are also stored on site until they are itemized
and/or shipped to other auction houses or dealers.
As an outcome of the appraisal process, some items are designated to be disposed of via
the auctioning process. This aspect of the business comprises approximately 20% - 30%
of the business. The auctions are held once a month and performed in two sessions (two

preview and auction dates the facilities is not open to the public. That is, the auction
aspect of the business occurs only four days per month. The only exception to this is, for
private appraisals which are scheduled by appointment only.
Besides the business aspects of the company Northwest Auction Galleries organizes
seminars for local wholesale clients. The seminars are provided as a courtesy to their
clients and are given by selected experts in the specific fields.

Hopefully this outline has provided you with adequate information to explain and
determine the type of use being proposed for the Duncan building. It is clear that this is
not a retail establishment and if one must categorize the auction function as a retail
activity, that the remaining portions of the building are not specific to the auction

I have completed an audit of the above project, including the cases referenced
above, which is routine when projects near completion. The purpose of this audit
is to insure that all planning, engineering and building requirements have been
met before I authorize a Certificate of Occupancy.
I have discovered that the while the original land use conditions have been met,
there was a minor modification to the original land use approval that included
parking requirements and landscaping on the building southside that have yet to
be completed. The planner assigned to this case, Mark Roberts, is out of the
office until 5/4/98, however, his immediate supervisor, Dick Bewersdorff,
Planning Department Manager, is familiar with the case and can be reached at
639 -4171, extension #316 if you have questions regarding this issue.
Additionally, the Traffic Impact Fee (TIF) for the shell building at 14,267 square
feet, originally calculated at the time the above building permit was submitted,
was not paid for at the time of building permit issuance, which is your choice
under the ordinance. If TIF payment is not made at the time the building permit
is issued, your options are either to pay or finance the TIF at occupancy.
Enclosed is the new calculation based on 7/1/98 rates. Please see the
"Additional Note" section at the bottom of the calculation form which indicates the
square footage differential of 5,485 square feet due to the payment of the NW
Auction.Gallery TIF assessment for the tenant improvement for BUP97 -0067 on
2/25/97. This TIF balance is due upon receipt of this letter. Make your check

This letter is to recap our previous conversation. To date the Traffic Impact Fee charges
have not been paid for your original building permit (BUP95 -0597) at 15955 SW 74`
Avenue. During the construction of this project, a portion of this building was re-
assessed for TIF to reflect a change of use for 5,485 square feet that is used as auction
space and the remainder of the building's use as warehouse. The tenant improvement
building permit (BUP97 -0067) for the auction space was assessed TIF at $2,058.00 and
paid in full on February 25, 1997. The enclosed attachment reflects the remaining square
footage used to calculate the TIF for the rest of the building that is for warehouse use.
When I receive your payment, I will make sure that everything is signed off regarding the
payment of TIF to help facilitate the issuance of a Certificate of Occupancy. Please keep
in mind that there may be other issues with the building department that require sign off
for the Certificate of Occupancy. Jeanne Temple is the contact person for the Building
Department.

Dear Jim:
This letter is in follow up to your letters concerning the proposed NW Auction use. The
Director has determined that a portion of this use is considered a Retail Sales Use but
that the majority of the proposed tenant improvements are permitted outright within the
I -P Zoning District. Specifically, the Director has interpreted that the warehouse and
office square lease areas are not counted against the 20% limitation that applies to the
General Retail Sales tenant improvements.
The recent Site Development Review plan stated that the existing Jadco Building was a
total of 8,000 square feet of which 7,000 had been developed as warehouse and 1,000
square feet as office space. The new building of 14,774 square feet was proposed to
be developed for 5,622 square feet of office, and 9,152 square feet of warehouse. NW
Auctions proposes to occupy 9,848 square feet of the new building for use as an
auction house. The tenant improvement plans provided 2,335 square feet of office,
1,850 square feet of warehouse, and 3,150 square feet for auction staging. An
additional 2,513 square feet has been designated for the actual auction. The Director
has determined this portion of the proposed tenant improvements to be a General
Retail Sales use.
The Planned Industrial Zoning District permits up to 20% of a "Development Complex"
to be developed as a General Retail Sales use. This means that 20% of the building
square footage on the site can be used for retail sales. Based on the recent Site
Development Review, the site is developed with a total of 22,774 square feet. The total
square footage for the retail portion of the auction use and any other retail uses cannot
exceed 4,558 square feet.
