Dear Mr. Skourtes,
This letter is a follow -up of our discussion on Friday, March 13,
1992, regarding the fill taking place at your above referenced
property.
Because a portion of the property is located in the 100 year flood
plain, there is a limit of how much can be filled. Based on the
information available, it has been determined that no fill may be
placed beyond a point 174 feet from the existing front property
line abutting SW 74th Ave. At this time fill has been placed beyond
this point, and it will be necessary to remove it. This is to mean
that the toe of the fill slope cannot extend beyond 174 feet from
the front property line. It was agreed that you would remove this
dirt within 60 days of our discussion, and that as a guarantee, you
will sign a "Voluntary Compliance Agreement" (a copy of which is
enclosed). No additional fill shall be placed beyond the 174 foot
point.
Additionally, the permit for the original fill is no longer valid,
for two reasons. A permit is only valid for 180 days from issuance
date, or date of last inspection. No inspections were ever
requested for this permit. There has been at least 1000 cubic yards
of fill material already deposited which was the limit of the
original permit. An additional permit will be required for the most
recent fill.
The signed voluntary compliance agreement must be returned, and the
required fill permit must be obtained within five days of receipt
of this letter.

I, John Skourtes, as responsible person for Tax Map 2S1 12AC, Tax
Lot 1600, and I agree to the following conditions:
To remove all fill material from area designated as the
100 year floodplain (No fill to extend beyond a point 174
feet from the front property line abutting SW 74th Ave).
as set forth in the notification letter dated March 17,
1992, by May 12, 1992.
I understand the City will withhold action until the new date of
compliance indicated above. Upon compliance with all above
conditions, this case will be closed. I further understand, if
these conditions are not complied with fully, I may be cited with
an additional Class 1 Infraction of "Failure To Comply" with this
signed agreement.
