The property was already developed with a 108 unit apartment complex. 3. Vicinity Information The subject property is surrounded by single family residences to the east and north, grazing land to the northwest, and Highway 217 to the southwest. Access to the subject property is through an approximately 70 foot wide accessway from SW Hall Boulevard. SW Hall Boulevard is an Oregon state highway, is functionally designated as an arterial by the City's Transportation Plan Nap, and is currently developed with a two FINAL ORDER NO. 89 -30 PC - SCE 89 -15/V 89 -32 ST. JAMES - PAGE 1 lane roadway without curbs or a sidewalk. 4. Site Information and Proposal Descrintioq The subject property is developed with the 109 unit St. James Apartments complex. The apartments are provided with access from Ball Boulevard through an approximately 70 foot wide by 265 foot long acceesway. The accessway includes a paved driveway bounded by hedges and various trees. Two older freestanding signs located on either side of the driveway along Ball Boulevard were recently replaced by two new, larger (18 square feet) freestanding signs. The previous signs had been in existence prior to annexation of the property. In late October, 1989, the City of Tigard notified the managers of the apartments that the newly erected signs violate a Community Development Code requirement that allows only one freestanding sign per multi - family residential parcel (Code Section 18.114.130 (B)(b)) as well as the requirement to obtain a City of Tigard sign permit prior to erecting a sign. Each of the newly erected signs is approximately 18 square feet in sire. The Code allows the one freestanding sign that is permitted to be up to 32 square feet in sire per sign face. The applicants request a Sign Code Bxception/Variance to allow retention of the two signs. The applicants' November 15, 1989 letter to Keith Liden notes their proposed justification for the requested variance. 5. Jlaencv and APO Comments NPO #8 reviewed the proposed sign variance and commented that although the new signs are an improvement over the previous signs at this location, the NPO would like to see the signage comply with the Code requirements. The Engineering Division, Building Division, and the Oregon State Highway Division have reviewed the proposal and have noted no objections to the proposed variance. No other comments have been received. B. FINDINGS AND CONCLUSIONS Code Section 18.114.130(8) allows one permanent freestanding sign at each entry point to a multi - family housing development with sign size not to exceed 32 square feet per sign face. The applicants request a Variance to permit a second freestanding sign. The subject apartment complex has had two freestanding signs at its one entry point for some time. The following criteria in Section 18.134.050 apply to the applicants' request: (1) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and FINAL ORDER NO. 89 -30 PC - SCE 89 -15/V 89 -32 ST. JANES - PAGE 2 to other properties in the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and (3) (5) The hardship is not self- imposed and the variancj requested is the minimum variance which would alleviate the hardship. The general purpose of the limit on the number of allowed signs for a housing complex is to reduce visual clutter through minimising the number of signs along roadways while at the same time providing for adequate identification of housing developments that may be known more by their name than by an address. The proposal to allow retention of two signs does not conflict with these purposes because the signs back up against vegetation and thus do not present a cluttered appearance to motorists or pedestrians on Hall Boulevard. In addition, the signs' opposing angles help to funnel visitors into the correct driveway. The St. James Apartments are not readily visible from Hall Boulevard and have only a small amount of frontage; therefore the improved driveway identification provided by this funneling effect aids motorists in finding the complex and its only entrance point. The requested variance would not allow a use that is prohibited by the Code nor would it allow greater sign area than is permitted by Code provisions for multi - family housing developments. The proposed signs' areas total 36 square feet. A double faced sign is allowed 32 square feet per face or a total of 64 square feet by Code standards. No effects upon natural or physical systems, such as traffic, resulting from the requested variance aro foreseeable if the two signs are allowed to continue. In fact, the present location of the signs against the vegetation and located back from the driveway is a good location with regard to clear vision for traffic as compared to the likely alternative location of a double -faced sign if the variance is not approved. Because the applicant requests only one additional sign and the sign area requested is limited to less than would be allowed for a double -faced sign in this location, the variance requested is minimal. The variance criteria are therefore satisfied for the request to allow two single faced signs for the St. James apartments when the Code normally would allow one sign. C.
