Project: Proposed Entry Monument at Walnut St. and Barrows Rd. As requested, I have reviewed this work for the need of a permit to work within a right of way. As to right of ways, Chapter 15.16 only applies to "unimproved public right of way ". This term is ambiguous, but this ambiguity need not be resolved here since this chapter also states that where the adjacent right of way is fully improved, an encroachment may be permitted between the property line and one foot from the back of the sidewalk (15.16.050 1. f.). However, it appears that this Chapter is not intended to apply to City work. For instance, 15.16.060 requires that the permit be recorded against the benefitting property. Encroachments must also comply with Chapter 15.04 (15.16.010 1. a.). Permits are not issued to the City under this Chapter. Since the proposed work is by the City, it appears that neither chapter requires a permit. However, since the proposed work is in a fully improved portion of Walnut St., there should be compliance with the requirement for one foot of clearance from the back of the sidewalk. The submitted drawings shows that the footing of the monument is three feet below ground. This is sufficiently deep to conflict with utilities which are likely to be in the area.
