designed to accommodate existing housing of all types and new attached single -

wide range of civic and institutional uses are permitted conditionally.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject parcel is located at 11321 SW Naeve Street and consists of the Tigard Covenant Church, its
associated playground, landscaping and parking lot. The site borders Pacific Highway on the west and
fronts Naeve Street at the intersection of Naeve Street and Royalty Parkway. The site is an approved
conditional use as a place of religious worship.
Proposal Description:
The Tigard Covenant Church proposes to add day care /pre - school as an accessory use to a previously
approved conditional use for religious worship. The program is in conformance with Director's
Interpretation dated January 28, 2010, which established the criteria for approval of a pre - school /day
care at a church. There will be no interior or exterior changes to the site.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
MINOR MODIFICATION TO CONDITIONAL USE: Section 18.330.20.B contains the
following criteria for approval of a request for Minor Modification of a Conditional Use:
Section 18.020.B.2 states that the Director shall determine that a major modification has
resulted if one or more of the changes listed below have been proposed:
a. A change in land use;
The subject property has a conditional use classification of Religious Worship. A church
sponsored day care /pre- school is an approved accessory use per Director's Interpretation
January 28, 2010.
b. A ten % increase in dwelling unit density;
The proposal does not affect dwelling unit density.
C. A change in the type and /or location of access ways and parking areas where off -site
traffic would be affected;
The proposal does not affect access ways or parking areas.
d. An increase in the floor area proposed for non - residential use by more than 10 %where
previously specified;
There is no proposal for increase of non - residential floor area.
e. A reduction of more than 10 % of the area reserved for common open space and /or
usable open space;
The proposal does not include any exterior changes.
f. A reduction of specified setback requirements by more than 20 %;
There is no reduction of setback requirements.

g. An elimination of project amenities by more than 10 % where previously specified,
such as:
1. Recreational facilities;
No recreational facilities will be affected.
2. Screening;
No screening will be affected.
3. Landscaping provisions;
Landscaping will not be affected.
h. A 10 % increase in the approved density;
There is no approved density associated with the conditional use of Religious Worship.
FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a
conditional use have been met.

Final Decision
A Minor Modification is a Type I procedure. As such, the Director's decision is final on the date it is

AND BECOMES EFFECTIVE ON JULY 20, 2010.

Tigard Covenant Church seeks a Minor Modification in order to operate a PiesNMk,'P ENGINEEPIING
Child Care Center on the premises, in the existing building. Tigard Covenant Church's
Church Council is fully supportive of gaining the modifred permit and operating the pre-
school childcare as soon as possible.
Please know that:
1. The child care program is subordinate to the principal use of the church.
2. The child care is located in the existing church facility.
3. The child care center is subordinate in area to the to the principal building and
use of the church.
4. The Church developed the child care program which is funded by the Church
S. The Council has created a program and curriculum that supports the Church's
mission and Christian values.
