BACKGROUND INFORMATION Site Information: The subject parcel is located at 13939 SW Pacific Higghway, at the northwest intersection of Pacific Hwy. and Gaarde Road. The site contains an existing Walgreens Drug Store. Proposal Description: Installation of a Redbox DVD rental vending machine at an existing Walgreens store located at 13939 SW Pacific Hwy. The machine will be located on the outside of the building, under the southern arcade of the structure approximately 32 feet from the main entrance. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION TO A SITE DEVELOPMENT REVIEW: Section 18.360.060 contains the following criteria for approval of a request for Minor Modification of a Site Development Review: Section 18.360.060.0 states that the Director shall determine that the modification is not a major modification. A major modification will result if one or more of the following criteria are met: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on -site parking in accordance with Chapter 18.765. The proposal does not include a change of use or occupancy, or area increase. No additional on -site parking is required. Therefore, this criterion does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures. Therefore, this criterion does not apply. S. An increase in the height of the building(s) by more than 20 %; There is no proposed change in building height. Therefore, this criterion does not apply. 6. A change in the e and location of access ways and parking areas where off -site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off - site traffic would be affected. Therefore, this criterion does not apply. 7. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common space and /or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 %; The proposal would result in the loss of 13 square feet of existing outdoor arcade space to the proposed vending machine, which would not reduce existing outdoor common and /or usable space by more than 10 %. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Redbox kiosks can be found in over 12,000 locations nationwide, with around 5,000 placed on the exterior of Walgreens stores, in the same manner as what is proposed for the City of Tigard. In the years that Redbox has been in operation, we have never been notified of a situation in which the outdoor unit creates any kind of public nuisance or significant alteration in traffic patterns. Just as a soft drink machine, or ice machine does not draw patrons in large numbers, neither does the Redbox DVD rental unit. Typically, patrons of the Redbox are patrons of the Walgreens store who make use of the Redbox during their regular trips to the store. The placement of the unit is a convenience to patrons, potentially reducing trips to an alternate location for rental of films. The Redbox website allows patrons to pre - select and "hold" a film for their specific use, or to request a specific movie be sent to the unit for their pick up at a later date. The requesting patron is notified via e-mail when the film will be available specifically for their rental, similar to requesting a book at the public library. There is no required return date, and patrons are billed only upon return of the film to any Redbox unit with the original credit or debit card. The Redbox units are serviced one a week, with new releases or requested films added, and the unit is inspected for service to assure working order. The units operate on a credit or debit card basis, therefore no cash is kept in the machine. No X -rated or NC -17 films are installed in the unit. We are confident the City of Tigard will find that there are significant benefits to the Redbox unit that recommend it to the community. In addition to increasing tax revenue for the city, Redbox can potentially decrease traffic within the City by decreasing the number of trips citizens have to make for their errands. Most importantly, it provides an affordable and convenient entertainment option, something increasingly needed in these difficult economic times.
