APPLICATION SUMMARY FILE NAME: STARBUCKS CASE NO.: Minor Modification (MMD) MMD2010 -00022 PROPOSAL: The applicant is requesting approval for minor site /facade modifications including installation of an awning, planter areas on the patio, new screening on the northeast side of the building, and removal of arches from the building design. The C -G zoning district is designed to accommodate a full range of retail, office and civic uses with a City -wide and even regional trade area. Except where non - conforming, residential uses are limited to single- family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini- warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390 and 18.520. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2010 -00022 Starbucks - Tigard Marketplace Page 1 of 4 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECT D ATE O THI DE SECTION III. PROPOSAL INFORMATION This request is for a Minor Modification (MMD2010- 00022) approval to complete minor changes to the site and building exterior. These changes include removal of all arch design incorporated into the building including an arch over the drive- through area on the northeast side of the building. In addition, an awning is proposed to cover the drive - through window, a trash screen is proposed at the rear entry door to the building, the drive- through menu board sign is being relocated within an existing landscape island, and planting areas are being cut into the existing concrete patio. The proposed plans show new signage to be installed. This review does not include the proposed signage. All signs require a Sign Permit and therefore, go through a separate review process. These sign permits have been submitted and are currently under review. The site has been developed with different businesses over the years. A search of City records shows land use cases dating back to 1976 for a Skate Palace (SDR44 -76). Several other cases were found including a Comprehensive Plan Amendment, a Minor Modification, multiple Site Development Reviews, and a couple of Minor Land Partitions. The most recent Site Development Reviews (SDR2000 -00005 & SDR2004- 00008) was for expansion of the existing grocery store within the shopping plaza, Tigard Marketplace and construction of a separate retail building, respectively. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states: "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on -site parking in accordance with Chapter 18.765. No additional on -site parking is required. Parking requirements are based on the proposed square footage and use. The applicant is not proposing an increase in building square footage or a change in the approved use (eating and drinking establishment). This standard is satisfied. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to building heights. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off -site traffic would be affected. The proposal does not include any revisions to the existing accessways or parking areas. This criterion is satisfied. MMD2010 -00022 Starbucks - Tigard Marketplace Page 2 of 4 7. An increase in ve. .ular traffic to and from the site and _ _c increase can be expected to exceed 100 vehicles per day. The minor site and building exterior modifications will have no effect on vehicular traffic to and from the site. This criterion is met. 8. An increase in the floor areas proposed for a non - residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal does not include any increase in floor area. Therefore, this standard is satisfied. 9. A reduction in the area reserved for common open space and /or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. No common open spaces were previously required. This criterion is not applicable. 10. A reduction of project amenities (recreational facilities, screening; and /or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The applicant states that no project amenities will be affected by the proposed changes. However, the menu board is being relocated into an existing landscape area. Based on a site visit and aerial photography from the City's GIS system, the island is smaller than indicated on the plans. The square footage of the area is approximately 45 square feet. If the total site landscaping (78,695 sq. ft. based on previous approvals) were reduced by 45 square feet, the minim of 15% would still be satisfied, and the reduction is less than 10 %. This standard is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. This proposal does not modify or adversely affect any of the conditions from the previous approvals. This standard is met. CONCLUSION: This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental or injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. SECTION V.
