Dear Staff:
The intent of this letter is to address city condition #25 which requires compliance with the CWS service
letter conditions. The service provides letter for this project is CWS file #4264 and a copy of it is
attached for reference. In this letter we have addressed each condition to the best of our knowledge based
on a site visit performed on August 2, 2006. We have also attached site photographs from our
investigation at the end of this document.
Conditions 1 - No structures, development, etc.... shall be permitted within the sensitive area or the
vegetated corridor which may negatively impact water quality, except those allowed by Section 3.02.3 -
These conditions were met. The only evident work performed in the sensitive area or vegetated
corridor was the permitted construction of the stonn outfall and the work necessary for the
enhancement / restoration of the vegetated corridor associated with planting and removing invasive
species.
Condition 3: Prior to any site Bearing, grading or construction the vegetated corridor and water quality
sensitive areas shall be surveyed, staked and temporarily fenced per approved plan. During construction
the vegetated corridor shall remain fenced and undisturbed except as allowed by Section 3.02.5 and per
approved plans.
The sensitive area was staked out and a sediment fence constructed along the perimeter for erosion
control.. • It was uncertain if the perimeter of the vegetated corridor was staked and fenced prior to
work, although as indicated above, there was no evidence of impacts in the vegetated corridor except
for permitted activities.
Q.1211;10_4: Prior to any activity within the sensitive area, the applicant shall gain authorization for the
project from the ODSL and USACOE. The applicant shall provide the District with copies of all ODSL and
USACOE project authorization permits.
Not applicable. The project involved no impacts within sensitive areas and therefore ODSI., and
USACOE permits were not required.
Condition 5: An approved Oregon Department of Forestry Notification is required for one or more trees
harvested for sale, trade, or barter on any non-federal lands "within the State of Oregon.
Not applicable. No trees were harvested for sale, trade or barter.
Condition 6: Appropriate BMP's for Erosion Control, in accordance with the CWS Erosion Control
Technical Guidance Manual shall be used prior to, during, and following earth.disturbing activities.

Condition 7: Prior to construction, a . Stormwater Connection Permit from the District or its designee is
required pursuant to Ordinance 27, Section 413.
I contacted the project manager. from Studio 3 Architecture and he indicated that to his knowledge the
City of Tigard required that all the necessary permits be obtained prior to construction.
Condition 8: The District or City/County may require an easement over the vegetated corridor conveying
storm, surface water management, and/or sanitary sewer rights to the District or City that would prevent
the owner of the vegetated corridor from activities and uses inconsistent with the purpose of the corridor
and any easements therein.
Because the project involved no partition of separate lots, a separate tract with the vegetated corridor
and sensitive area was not created. An easement was not required by the local jurisdiction to cover
the entire vegetated corridor. Pre-existing narrow utility easements interior to the vegetated corridor
were retained.
Condition 9: Activities located within the 100 -year floodplain shall comply with Section 3.13 of R&O 04-9.
Not applicable. No site work was proposed within a 100 -year floodplain.
Condition 10: Removal of native, woody vegetation shall be limited to the greatest extent practical.
Tres within the vegetated corridor were preserved. It was not practical to preserve the limited
woody vegetation on the shrub stratum because of the dense Rubus discolor (Himalayan Blackberry)
that was required to be removed. ,
Condition 11: Removal of invasive non-native species by hand is required in all vegetated corridors rated
'good'. Replanting is required in any cleared areas larger than 25 square feet.
Not applicable. No portion of the vegetated corridor was rated "good ". As per the Natural Resources
Report prepared by our firm, the interior of the vegetated corridor was rated as "marginal" and the
outer portion of the corridor was rated `poor".
Condition 12: Should final development plans differ significantly from those submitted for review by the
District, the applicant shall provide updated drawings, and If necessary, obtain a revised Service Provider
Letter.
Not applicable. Final development plans did not differ significantly from the plans reviewed by
CWS.
Condition 13: The vegetated corridor width for sensitive areas within the projects site shall be a minimum
of 50 feet wide, as measured horizontally from the delineated boundary of the sensitive area.
The 50 -foot vegetated corridor was shown on the final plans, and our site visit revealed that the
project appeared to be built as per design.
Condition 14: For vegetated corridors that are 50 feet wide or Tess, the entire vegetated corridor shall be
equal to or better than a "good' corridor condition as defined in Section 3.02.7, Table 32.
Prograss Landscape Care & Design prepared a.landscape plan to enhance the vegetated corridor to a
"Good" condition. Clean Water Services planting specifications requires a density of 435 trees / acre
and 2178 shrubs / acre as per Appendix D of R&O 04-9. Planting at that density provides the basis
for the corridor to meet the definition of a "good" condition _ The landscape plan provided by
Prograss meets those standards. Our site inspection revealed that the trees and shrubs to be planted
per the landscape plan were installed as per plan. We did not do a stern count of individual plantings,
but the evident density was as per plan.
Condition 15: Clean Water Services shall be notified 72 hours prior to the start and completion of
enhancement/restoration activities. Enhancement/ restoration activities shall comply with the guidelines
provided in Landscape Requirements (R&O 04-9: Appendix D).

It is uncertain if this condition was addressed.
Condition 16: Prior to installation of plant materials, all invasive vegetation within the vegetated corridor
shall be removed. During removal of - invasive vegetation care shall be taken to minimize Impacts to
existing native trees and shrub species. •
The dense Rubus discolor (Hirnalayan Blackberry) was removed prior to the planting. A low growth
is returning to the area below ihetop of ravine, and we recommend doing a spot treatment using a
herbicide - approved for water-sensitive areas during the fall to ensure that the regrowth does not
redevelop dominant conditions.
Condition 17: Enhancement/restoration of the vegetated corridor shall be provided in accordance with
R&O 04-9, Appendbc D.
This condition was met. See response to condition 14 above.
Condition 18: Prior to any site clearing, grading, or construction, the applicant shall provide the District
with the required vegetated corridor enhancement/n3storafion plan in compliance with R&O 04-9.
Sheet L1.2 of the final construction plans, prepared by Prograss Landscape Care & Design, addressed
the enhancement / restoration criteria required by CWS. We assume the plan was reviewed and
approved by CWS.
Condition 19: Maintenance and monitoring requirements shall comply with Section 2.11.2 of R&O 04
If at any time during the warranty pelod the landscaping falls below the 80% level, the Owner shall
reinstall all deficient planting at the next appropriate planting opportunity and the two-year maintenance
period shall begin again from the date of replanting.
Maintenance and monitoring was addressed on Sheet L1.2. The permittee will comply with those
requirements. As evident during our inspection, it appeared that planting survival was well in excess
of 80%.
Condition 20: Performance assurances for the vegetated corridor shall comply with Section 2.08.2, Table
2-1 and Section 2.10, Table 2-2.
Success criteria for the planting were as addressed in the maintenance and monitoring requirements.
Condition 21: For any developments which create multiple parcels or lots intended for separate
ownership, the District shall require that the vegetated corridor and the sensitive area be contained in a
separate tract. The tract plat shall include language protecting the vegetated corridor and sensitive
areas.
Not applicable. Multiple parcels were not created.
Condition 22: Any water quality swale and detention pond shall be planted with District approved native
species, and designed to blend into the natural surroundings.
Not applicable. All storm facilities were in-ground stnictures (detention pipes, water quality
manholes, etc.)

size of plantings, existing plants and trees to be preserved, and installation methods for plant materials.
Plantings shall be tagged for dormant season identification. Tags to remain on plant material after
planting for monitoring purposes.
Final construction plans included sheet L1.2 prepared by Progress Landscape Care & Design that
address the required elements.
Condition 24: A maintenance plan shall be included on final plans induding methods, responsible party
contact information, and dates (minimum 2 times/year, by June 1 and September 30).

Condition 25: Final construction plans shall clearly deptict the location and dimensions of the sensitive
area and the vegetated corridor (indicating good, marginal, or degraded condition). Sensitive area
boundaries shall be marked in the field.
Final construction plans included sheet LI .2 prepared by Prograss Landscape Care & Design that
address the required elements. The sensitive area boundary was marked by the erosion control fence.
The vegetated corridor boundary is defined by the split -rail fence.
Condition 26: Protection of the vegetated corridors and associated sensitive areas shall be provided by
the installation of permanent fencing and signage between the development and the outer limits of the
vegetated corridors. Fencing details to be included on final construction plans.
A split rail fence was constructed as per plans.
