Notice is hereby given that the Planning Director's Designee for the City of Tigard has
APPROVED this Home Occupation. No business activity shall begin until after the appeal
period has expired.
This Home Occupation is subject to the following special condition:
1.) Customers shall visit the residence on an appointment -only basis, as the
applicant has indicated.
2.) Evidence of more than six daily customers or clients will cause immediate
revocation of this Home Occupation Permit.
This Home Occupation is also subject to the following conditions:
1.) Home occupations may be undertaken only by the principal occupant(s) of a
residential property;
2.) There shall be no more than three deliveries per week to the residence by suppliers;
3.) There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare
noticeable at or beyond the property line resulting from the operation. Home
occupations shall observe the provisions of TDC Chapter 18.090 (Environmental
Performance Standards);

4.) The home occupation shall be operated entirely within the dwelling unit and a
conforming accessory structure. The total area which may be used in the accessory
building for either material product storage and/or the business activity shall not
exceed 528 square feet. Otherwise, the home occupation and associated storage of
materials and products shall not occupy more than 25 percent of the combined
residence and accessory structure gross floor area. The indoor storage of materials
or products shall not exceed the limitations imposed by the provisions of the building,
fire, health and housing codes;
5.) A home occupation shall not make necessary a change in the Uniform Building Code
use classification of a dwelling unit. Any accessory building that is used must meet
Uniform Building Code requirements and be in conformance with TDC Chapter
18.144 of this title;
6.) More than one business activity constituting two or more home occupations shall be
allowed on one property only if the combined floor space of the business activities
does not exceed 25 percent of the combined gross floor area of the residence and
accessory structure. Each home occupation shall apply for a separate home
occupation permit;
7.) There shall be no storage and/or distribution of toxic or flammable materials, and
spray painting or spray finishing operations that involve toxic or flammable material
which in the judgement of the Fire Marshall pose a dangerous risk to the residence,
its occupants, and/or surrounding properties. Those individuals which are engaged
in home occupations shall make available to the Fire Marshal, for review, the
Material Safety Data Sheets which pertain to all potentially toxic and/or flammable
materials associated with the use;
8.) No home occupation shall require any on or off - street parking other than that
normally required for a residence.
9.) The following uses are not allowed as home occupations:
(a) Auto -body repair and painting.
(b) Ongoing mechanical repair conducted outside of an entirely
enclosed building.
(c) Junk and salvage operations.
(d) Storage and/or sale of fireworks.
10.) There shall be no exterior storage of vehicles of any kind used for the business except
one commercially licensed vehicle of not more than three - quarters ton GVW which
may be parked outside of a structure or screened area.

(c) No more thawkdaily customers or clients. Custorakand clients may not visit the
business beta the hours of 10:00 p.m. and 8: .m. and shall not generate
excessive traffic or monopolize on- street parking;
(d) Storage of materials, goods, and equipment which is screened entirely from view by
a solid fence. Storage shall not exceed five percent of the total lot area and shall not
occur within the front yard or the required side yard setback.
If any of the preceding conditions are not met, this Home Occupation Permit will be immediately
invalidated.

I SPOKE WITH MS KAYTON AT APPROX 11AM THIS MORNING IN REGARD TO THE LETTER
MAILED TO YOU FROM SALLY PAULY AT FROCKS 'N BRITCHES.
ALTHOUGH MS KAYTON FEELS THIS COMPLAINT IS A PERSONAL ATTACK BY MS PAULY
SHE DID ADMIT TO SOME VIOLATIONS OF HER H.O.P. APPARENTLY MS PAULY IS NOT A
NEIGHBOR OF MS KAYTON AND IS IN NO WAY AFFECTED BY THE HOME BUSINESS EXCEPT
THAT SHE NOW HAS SOME STRONG COMPETITION AS THEY ARE BOTH INVOLVED IN RESALE
OF CHILDRENS CLOTHING AND ACCESSORIES.
COMPLAINT 1: EXCEEDING 6 CUSTOMERS PER DAY.
MS KAYTON STATES THAT SHE HAS RECEIVED NO COMPLAINTS FROM
HER NEIGHBORS (NEITHER HAVE I) REGARDING THE AMOUNT OF
CUSTOMERS FREQUENTING HER BUSINESS DAILY AND THAT USUALLY
THE AMOUNT IS UNDER 6. ON THE COUPLE OCCASIONS THAT THE
LIMIT HAS BEEN EXCEEDED, MS KAYTON SAID SHE CALLED CITY
HALL AND WAS TOLD NOT TO WORRY ABOUT IT UNLESS IT CAUSES A
PROBLEM FOR THE NEIGHBORS. SHE STATES THAT SHE RARELY GOES
OVER THE LIMIT AND IS VERY CONSIDERATE OF HOW THE BUSINESS
AFFECTS HER NEIGHBORHOOD. I'VE RECEIVED NO INFO OF
SURROUNDING NEIGHBORS HAVING A PROBLEM WITH HER BUSINESS
REGARDING TIMES OF OPERATION OR NUMBER OF CLIENTS. SHE HAS
BEEN ADVISED TO INFORM PLANNING OR CODE ENF WHEN SHE BELIEVES
SHE MAY EXCEED THE LIMIT AND TO GET THE NAME OF WHO SHE
SPEAKS WITH. SHE SAID THAT SHE WOULD DO SO AND THAT IT
SHOULD HAPPEN ONLY RARELY ON SPECIAL OCCASIONS. SHE DOES
KNOW THAT THAT THE ISSUE WILL BE RE- ADDRESSED IF IT BECOMES
AN ONGOING PROBLEM.
COMPLAINT 2: SIGNAGE.
MS KAYTON ADVISED THAT SHE HAS AN A -FRAME SIGN AT
GAARDE /114TH AND HAS POSTED A COUPLE TELEPHONE POLE SIGNS.
SHE WAS REMINDED THAT HER H.O.P. AGREEMENT ALLOWED FOR ONLY
ONE 1.5 CUBIC FT SIGN ON HER PROPERTY AND THE OTHERS WOULD
HAVE TO BE REMOVED. SHE HAS BEEN GIVEN 10 DAYS TO COMPLETE
THIS, I WILL FOLLOW UP ON 4/14.
COMPLAINT 3: TRAFFIC.
THE TRAFFIC PROBLEMS IN THIS AREA WERE EXISTENT BEFORE THE
OPERATION OF MS KAYTON'S BUSINESS AND HER BUSINESS DOES
NOT CONTRIBUTE TO THE PROBLEM ANY MORE THAN GARAGE SALES
WOULD ON WEEKENDS. ALTHOUGH THE AREA CAN BE SOMEWHAT
HAZARDOUS, IT IS PRIMARILY DUE TO VEHICLES SPEEDING DOWN
GAARDE TOWARD 99W WHICH IS A PD TRAFFIC DIV ISSUE THAT THEY
CONTINUE TO MONITOR AS THEY DO OTHER HIGH SPEED PROBLEM
AREAS. I DON'T BELIEVE MS KAYTON'S BUSINESS IS HAVING A
NOTICEABLE IMPACT ON TRAFFIC BUT WILL MONITOR SITUATION AS
TIME ALLOWS.
MS PAULY DID NOT LEAVE A PHONE NUMBER FOR A RETURN CALL BUT ONE WOULD NOT BE
DIFFICULT TO LOCATE. PLEASE ADVISE IF YOU WOULD LIKE ME TO RESPOND DIRECTLY
TO HER LETTER OR IF YOU WOULD PREFER TO INFORM HER OF MY FINDINGS AND
RECOMMENDATIONS.

Dear Mr. Bewersdorff:
I am lodging a complaint regarding the home
business, Kids Choice Re -Sale, that was approved on
114 St. off Gaarde St./
First complaint: I understant that this business'
is only allowed up to 6 customers per day. With open hours
of M -S 10 -5, and Sun 11 -3, there is no guarantee of a cap
of only 6 customers. As the owner of a similar business,
I know that the amount of traffic is unpredictable, but
most surely exceeds the six customers limit per day. I
can verify the first week it was open, this limit was
violated twice.
Second complaint: Numerous signs on telephone poles
(which is illegal) from Scholls Ferry Rd. to McDonald St.,/
devalues surrounding businesses and residential neighbor-
hoods. An unregistered A -board is clearly visible at the
entrance to the street of this business.
Third complaint: The traffic. 114 St. that intersects
Gaarde, is closely adjacent to Gaarde Christian School, and
has been the sight of numerous accidents. Additional
business and consignment deliveries will contribute to the
problem and is an area of great concern.
