This Home Occupation is subject to the following conditions:
1) Home occupations may be undertaken only by the principal occupant (s) of
a residential property;
2) There shall be no more than three deliveries per week to the residence by
suppliers;
3) There shall be no offensive noise, vibration, smoke, dust, odors, heat or
glare noticeable at or beyond the property line resulting from the
operation. Home occupations shall observe the provisions of TDC Chapter
18.090 (Environmental Performance Standards);
4) The home occupation shall be operated entirely within the dwelling unit
and a conforming accessory structure. The total area which may be used in
the accessory building for either material product storage and /or the
business activity shall not exceed 528 square feet. Otherwise, the home
occupation and associated storage of materials and products shall not
occupy more than 25 percent of the combined residence and accessory
structure gross floor area. The indoor storage of materials or products
shall not exceed the limitations imposed by the provisions of the
building,fire,health and housing codes;
5) A home occupation shall not make necessary a change in the Uniform
Building Code use classification of a dwelling units. Any accessory
building that is used must meet Uniform Building Code requirements and be
in conformance with TDC Chapter 18.144 of this title;
6) More than one business activity constituting two or more home occupations
shall be allowed on one property only if the combined floor space of the
business activities does not exceed 25 percent of the combined gross floor
area of the residence and accessory structure. Each home occupation shall
apply for a separate home occupation permit, if required per this chapter,
and each shall also have separate Business Tax Certificates;

7) There shall be no storage and /or distribution of toxic or flammable
materials, and spray painting or spray finishing operations that involve
toxic or flammable material which in the judgement of the Fire Marshall
pose a dangerous risk to the residence, its occupants, and /or surrounding
properties. Those individuals which are engaged in home occupations shall
make available to the fire marshall for review the Material Safety Data
Sheets which pertain to all potentially toxic and /or flammable materials
associated with the use;
8) No home occupation shall require any on or off - street parking other than
that normally required for a residence;
9) The following uses are not allowed as home occupations:
a) Auto -body repair and painting
b) Ongoing mechanical repair conducted outside of an entirely
enclosed building
c) Junk and salvage operations
d) Storage and /or sale of fireworks
10) There shall be no exterior storage of vehicles of any kind used for the
business except that one commercially licensed vehicle of not more that
three- quarters ton GVW may be parked outside of a structure or screened
area.
Type II home occupations allow the following according to TDC Chapter 18.142.050:
a) One non - illuminated sign, not exceeding 1.5 square feet, which shall
be attached to theresidence or accessory structure or placed in a
window;
b) No more than one outside volunteer or employee who is not a
principal resident of the premises;
c) No more than six daily customers or clients. Customers and clients
may not visit the business between the hours of 10:00 p.m. and 8:00
a.m. and shall not generate excessive traffic or monoploize on-
street parking;
d) Storage of materials, goods, and equipment which is screened
entirely from view by a solid fence. Storage shall not exceed five
percent of the total lot area and shall not occur within the front
yard or the required side yard setback;
If any of the preceding conditions are not met, this Home Occupation Permit will
be immediately invalidated.

It has come to the City's attention that your Type 1 - Home
Occupation (HOP 92 -0084) is operating in violation of the permit
regulations. Although you have Type 2 Home Occupation Permit (HOP
92- 0090), this permit is now in an appeal period which expires on
May 26, 1992. As I had explained to Mrs. Marsh in our telephone
conversation on May 6, 1992, the Type 2 permit approval is not
final until the end of this appeal period. It was also explained
that Cascade Electric & Maintenance, Inc. may only operate as a
Type 1 Home Occupation until the appeal period has passed.
By signing the Type 1 application form, you agreed to the following
statement:
I hereby certify that I have read and understand the above
conditions and standards as they apply to home occupations.
I acknowledge that this home occupation may be revoked if the
above conditions have not or are not -being complied with and
the home occupation is otherwise being conducted in a manner
contrary to the home occupation chapter of the Tigard
Development Code Chapter 18.142. A home occupation revoked
due to violation of the home occupation requirement cannot be
renewed for a minimum period of one year (18.142.090).
By signing the Type 2 application form, you agreed to the following
statement:
All of the above statements and the statements in the plot
plan, attachments, and exhibits transmitted herewith, are true
and the applicants so acknowledge that any permit issued,
based on this application, maybe revoked if it is found that
any such statements are false.
Therefore, your Type 1 permit (HOP 92 -0084) is hereby revoked for
the following reason:
Code Section 18.142.050(A)(1) states:
A Type 1 home occupation shall not permit:
a) Outside volunteers or employees to be engaged in the
business activity other than the persons principally
residing on the premises.

The City of Tigard Code Enforcement Officer, Mr. Ken Schreindl,
visited the site of Cascade Electric & Maintenance, Inc. (11769 SW
129th Place) the morning of May 15, 1992 between approximately 6:45
a.m. and 7:15 a.m. in response to numerous citizen complaints
concerning the operation of your business. Mr. Schreindl reported
witnessing three employees on your property at one time actively
engaged in business activity. This included unlocking and opening
the doors of the business van and unloading materials from the top
of the van.
The March 6, 1992 decision to approve your Type 2 permit (HOP 92-
0090) is hereby ammended to revoke the Type 2 permit application
for the following reason:
Code Section 18.142.050(A)(2) states:
Property on which a Type 2 home occupation is located may show
evidence that a business is being conducted from the premises.
Therefore the following is allowed for Type 2 home
occupations:
b) No more than one (emphasis added) outside volunteer or
employee who is not a principal resident of the premises
[per day].
The code violation which has caused the City to revoke your
approved Type 1 home occupation permit has also resulted in the
denial of your pending Type 2 permit. _
Additionally, the supplementary $40.00 check which you paid to the
City of Tigard on May 5, 1992 towards the Type 2 Home Occupation
Permit has been returned due to insufficient funds. I have been
informed that this check (receipt #92- 226849) has been resent and
cannot be resent again. Therefore, the permit fee for the Type 2
permit was effectually never paid.
Therefore, I must now state that with the revocation of the Type 1
permit (HOP 92 -0084) and the denial of the Type 2 permit (HOP 92-
0090), the business operation of Cascade Electric & Maintenance,
Inc. must cease entirely from the property commonly referred to as
11769 SW 129th Place (WCTM 1S1 33DD, tax lot 1100). To continue a
business operation on this site after the receipt of this letter
will constitute a land use violation. Such violations may be
subject to citation into civil infractions court and a fine of up
to $250.00 per day for each infraction.

I spoke with the plaintiff, Steve Marsh, yesterday. Steve offered
to dismiss with prejudice his complaint against the City of Tigard
if we dismiss the citation that is pending in Municipal Court.
Steve's argument in favor of this offer is that he has moved out
of the residence so the home occupation violation is moot. On the
other hand, I think we would prevail in Circuit Court. I do not
think there is any doubt that this is a land use decision and that
he failed to exhaust his administrative remedies. However, will
have to spend two to three hours getting ready for and appearing
in court at the oral argument scheduled for November 9. Ken
Schreindel, the Code Enforcement Officer, informs me that the fine
would be worth about $250.
I told Mr. Marsh I would get back to him sometime next week.

9 1. INTRODUCTION
10 Defendant has moved the court for an order to dismiss the
11 complaint. Defendant's motion to dismiss is based on two points
12 of law. First, the Land Use Board of Appeals ( "LUBA ") has
13 exclusive jurisdiction in this matter because the decision is a
14 land use decision. In the alternative, the court does not have
15 jurisdiction because the Plaintiffs failed to exhaust the available
16 administrative remedy for local review.
17 2. ARGUMENT
18 A. Luba Has Exclusive Subject Matter Jurisdiction.
19 The defendant's decision is a land use decision within the
20 exclusive statutory jurisdiction of LUBA for the following reasons.
21 A "land use decision" as defined by ORS 197.015(10) (a) (A) (iii)
22 is a final decision of a local government that concerns the
23 application of a land use regulation. A "land use regulation"
24 includes "any local government zoning ordinance . . ." ORS
25 197.015(11). Defendant based the decision to revoke the
26 plaintiffs' home occupation permit upon an application of its

1 zoning ordinance. Tigard Community Development Code ( "TCDC "),
2 Sections 18.142.090. (See Exhibit A.)
3 LUBA has exclusive jurisdiction over appeals of "land use
4 decisions ". ORS 197.825(1) Therefore, LUBA has exclusive
5 jurisdiction over the subject matter of this complaint, which is
6 defendant's decision to revoke Plaintiffs' home occupation permit.
7 The Court of Appeals has ruled on a similar question involving
8 LUBA's jurisdiction vis -a -vis the circuit courts:
9 "If the opposed action takes the form of or is permitted by
a land use decision, the exclusive avenue of review is to LUBA
10 and then to this court, in accordance with ORS 197.805 to ORS
197.855." Oregon City v. Mill -Maple Properties, Inc., 98 Or
11 App 238, 242, 779 P2d 172 (1989).
12 The defendant's decision involved application of its zoning
13 ordinance in determining that the Plaintiffs were in violation of
14 the home occupation permit. Therefore, LUBA is the proper forum
15 for defendant's complaint.'
16 B. Plaintiff Failed To Exhaust Administrative Remedies.
17 Even if the court did have subject matter jurisdiction, the
18 plaintiff failed to exhaust available administrative remedies and
19 cannot seek review in this court.
20 Oregon courts have long held to the common law doctrine of
21 exhaustion:
22 "'Ordinarily, those who seek judicial relief must show they
have exhausted their administrative remedies.' Oregon City
23 v. Hartke, 240 Or 35, 44, 400 P2d 255, 260 (1965)" cited in
Fifth Avenue Corp. v. Washington County, 282 Or 591, 581 P2d
24 50, 63 (1978).

failed to exhaust their administrative remedies by not utilizing
the Defendant's appeal process. ORS 197.825(2)(a).

The Plaintiffs failed to appeal the defendant's decision

within the period set forth in the development code and it became
3
final. TCDC § 18.32.310 (see Exhibit B). Plaintiffs admit as much
a_
in their complaint. See paragraphs 7 and 8. The local government
5
has the necessary expertise to review challenged decisions before
6
they are reviewed in the courts or LUBA. Plaintiffs' allegations
7
of excessive fees and bias are not valid excuses for their failure
8
to exhaust their available remedy of a local appeal. Having failed
9
to appeal the Defendant's decision below, Plaintiffs are now
10
precluded from seeking review in this court.

3. CONCLUSION

For the reasons stated above, the court should dismiss the
13
complaint for lack of subject matter jurisdiction.

discovered the punitive nature of the appeal process namely a non -
24 refundable fee of $230 which the Plaintiff alleges is unreasonable
based upon the fee for the original application and that little or

18.142.090 Revocation and Expiration of Home Occupation Permits
A. The Community Development Director may revoke a home
occupation approval if the conditions of approval have
not been or are not being complied with and the home
occupation is otherwise being conducted in a manner
contrary to this chapter. The process for revocation
shall be as provided for in Section 18.142.120.
3. When a hone occupation permit has been revoked due to
violation of these standards, a minimum period of one
year shall elapse before another application for a home
occupation on the subject parcel will be considered.
C. A home occupation permit shall become invalid if the
applicant moves his or her residence. (Ord. 91 -31.)

18.32.300 Computation of Appeal Period and Effective Date of the
Decision
A. All appeals of decisions or interpretations made by the
Director may be appealed to the Planning Commission or
Hearings Officer pursuant to Subsection 18.32.090,
except:
1. The Council may, on its own motion, seek to hear the
matter by voice vote prior to the effective date of
the notice of the decision.
B. Any decision made by any other approval authority under
Subsections 18.32.090.B or C may be reviewed by the
Council by:
1. The filing of a notice of review as provided by
Section 18.32.340 by any party to the decision by
3:30 p.m. on the effective date of the notice of
decision;
2. The Council or Commission, on its own motion,
seeking review by voice vote prior to the effective
date of the notice of decision; or
3. Referral of a matter under Subsection 18.32.090.D
by the initial hearings body to the Council, upon
closure of the hearing, when the case presents a
policy issue which requires Council deliberation and
determination, in which case the Council shall
decide the application.
C. Failure to file an appeal or petition for review shall
be deemed a failure to exhaust administrative remedies.
It is the purpose of this section to provide the parties
every remedy possible. The filing of an appeal or
petition for review is a condition precedent to

Dear Hr. and Mrs. Marsh;
It has come to the City's attention that your Type 1 - Home
Occupation (HOP 92 -0084) is operating in violation of the permit
regulations. Although you have Type 2 Home Occupation Permit (HOP
92- 0090), this permit is now in an appeal period which expires on
Nay 26, 1992. As I had explained to Mrs. Marsh in our telephone
conversation on May 6, 1992, the Type 2 permit approval is not
final until the end of this appeal period. It was also explained
that Cascade Electric & Maintenance, Inc. may only operate as a
Type 1 Home Occupation until the appeal period has passed.
By signing the Type 1 application form, you agreed to the following
statement: -
I hereby certify that I have . read and understand the above
conditions and standards as they apply to home occupations.
I acknowledge that this home occupation may be revoked if the
above conditions have not or are not being complied with and
the home occupation is otherwise being conducted in a manner
contrary to the home occupation chapter of the Tigard
Development Code Chapter 18.142. A home occupation revoked
due to violation of the home occupation requirement cannot be
renewed for a minimum period of one year (18.142.090).
By signing the Type 2 application form, you agreed to the following
statement:
All of the above statements and the statements in the plot
plan, attachments, and exhibits transmitted herewith, are true
and the applicants so acknowledge that any permit issued,
based on this application, may be revoked if it is found that
any such statements are false.
Therefore, your Type 1 permit (HOP 92 -0084) is hereby revoked for
the following reason:
Code Section 18.142.050(A)(1) states:
A Type 1 home occupation shall not permit:
a) Outside volunteers or employees to be engaged in the
business activity other than the persons principally
residing on the premises.

The City of Tigard Code Enforcement Officer, Mr. Ren Schreindl,
visited the site of Cascade Electric & Maintenance, Inc. (11769 SW
129th Place) the morning of May 15, 1992 between approximately 6:45
a.m. and 7:15 a.m. in response to numerous citizen complaints
concerning the operation of your business. Mr. Schreindl reported
witnessing three employees on your property at one time actively
engaged in business activity. This included unlocking and opening
the doors of the business van and unloading materials from the top
of the van.
The March 6, 1992 decision to approve your Type 2 permit (HOP 92-
0090) is hereby ammended to revoke the Type 2 permit application
for the following reason:
Code Section 18.142.050(A)(2) states:
Property on which a Type 2 home occupation is located may show
evidence that a business is being conducted from the premises.
Therefore the following is allowed for Type 2 home
occupations:
b) No more than one (emphasis added) outside volunteer or
employee who is not a principal resident of the premises
[per day].
The code violation which has caused the City to revoke your
approved Type 1 home occupation permit has also resulted in the
denial of your pending Type 2_pernit.
Additionally, the supplementary $40.00 check which you paid to the
City of Tigard on May 5, 1992 towards the Type 2 Home Occupation
Permit has been returned due to insufficient funds. I have been
informed that this check (receipt #92- 226849) has been resent and
cannot be resent again. Therefore, the permit fee for the Type 2
permit was effectually never paid.
Therefore, I must now state that with the revocation of the Type 1
permit (HOP 92 -0084) and the denial of the Type 2 permit (HOP 92-
0090), the business operation of Cascade Electric & Maintenance,
Inc. must cease entirely from the property commonly referred to as
11769 SW 129th Place (WCTM 151 33DD, tax lot 1100). To continue a
business operation on this site after the receipt of this letter
will constitute a land use violation. Such violations may be
subject to citation into civil infractions court and a fine of up
to $250.00 per day for each infraction.

3 application effectively revoking plaintiffs' permit claiming that
4 an alleged violation of the terms had occurred and that
5 plaintiffs would be forced to use the Defendant's appeal process

8 Plaintiff met with Defendant's representatives claiming that

10 that the alleged violation was not what in fact what had
11 occurred. Defendant's representatives conceded that the
12 information could have been misleading and that it was possible
13 that the violation may not have occurred and that they were in a
14 position to rescind the amended application but refused to due so
15 and plaintiff would have to utilize Defendant's appeal process.

17 Upon researching Defendant's appeal process, Plaintiffs
18 discovered the punitive nature of the appeal process namely a non
19 refundable fee of $230 which the plaintiff alleges is
20 unreasonable based upon the fee for the original application and
21 that little or no evidence is required for the Defendant to
22 require such an appeal.

24 Plaintiffs further allege that since the appeal process is
25 controlled by the defendant, the impartiality of the process must
26 be questioned.

On June 5, 1992 between the hours of 6:05 am and 7:05 am, a brown
GMC pick -up, a red Toyota pick -up, a blue Toyota pick -8 with
canopy, a red Corvair vehicle, and a motorcycle arrived.
Three individuals entered the Marsh residence and removed materials
from either the Marsh's Plymouth van or from their garage. (Not
able to determine which location that the material was stored).
At about 7:15 am, the GMC pick -up and red Toyota pick -up (Oregon
License C SMILE) left the Marsh residence after loading material.
At 7:30 the blue Toyota pick -up with the canopy left, and also the
white Ford van which appeared to have 3 individuals in it. The red
Chevrolet Corvair remained parked in front of the same location, as
well as the motorcycle.

regarding Home Occupations by June 26, 1992. This signed
agreement needs to be returned to City of Tigard no later
than June 23, 1992.
I acknowledge that a Home Occupation Permit for
electrical contracting was revoked on May 15, 1992. The
reason the Home Occupation Permit was revoked was due to
my continuing to violate the Type I Home Occupation
Permit within the time period for the appeal process.
Also, the check I issued to the City of Tigard for the
permit fee was never processed due to insufficient funds
in my account.
A home occupation can not be operated at the above property, and
can not be reapplied for in less than a period of one year
according to Section 18.142.090.b from this date, and I choose not
to utilize the appeal process.
I understand the City will withhold action until the new date of
compliance indicated above. Upon compliance with all conditions,
this case will be closed. I further understand that if these
conditions are not complied with fully, I may be cited with an
additional Class I infraction of "Failure to Comply" with this
signed agreement, (and in addition a Failure to Comply and a Class

environmental impacts such as noise, vibration, air pollution,
glare, odor, and dust;
3. Requiring additional building setbacks, and increased lot area,
depth or width;
4. Further limiting the building area and outdoor storage used by the
home occupation and restricting the location of the use on the site
in relationship to adjoining uses;
5. Designating the size, number, location, and design of vehicle access
points;
6. Requiring street right -of -way to be free at all times of vehicles
associated with the home occupation;
7. Requiring landscaping, buffering and /or screening, of the home
occupation from adjoining uses and establishing standards for the
continued maintenance of these improvements;
8. Requiring storm drainage improvements, and surfacing of parking and
loading areas;
9. Limiting the extent and type of interior or exterior building
remodeling necessary to accommodate the home occupation;
• 10. Limiting or setting standards for the location and intensity of
outdoor lighting;
11. Requiring and designating the size, height, location, of fences and
materials used for their construction;
12. Requiring the protection and preservation of existing trees, and
other vegetation, watercourses, slopes, wildlife habitat areas, and
drainage areas;
13. Limiting the type and number of vehicles or equipment to be parked
or stored on the site; and
14. Any other limitations which the Director considers to be necessary
or desirable to make the use comply with the purposes stated in
Sections 18.142.040 and 18.142.050. (Ord. 91 -32; Ord. 89 -06; Ord.
87 -20)
18.142.090 Revocation and Expiration of Home Occupation Permits
A. The Community Development Director may revoke a home occupation approval
if the conditions of approval have not been or are not being complied
with and the home occupation is otherwise being conducted in a manner
contrary to this chapter. The process for revocation shall be as
provided for in Section 18.142.120.
B. When a home occupation permit has been revoked due to violation of these
standards, a minimum period of one year shall elapse before another
application for a home occupation on the subject parcel will be
considered.
C. A home occupation permit shall become invalid if the applicant moves his
or her residence. (Ord. 91 -32)

It has come to the City's attention your Type 1 - Home
Occupation (HOP 92 -0084) is operating in violation of the permit
regulations. Although you have Type 2 Home Occupation Permit (HOP
92- 0090), this permit is now in an appeal period which expires on
May 26, 1992. As I had explained to Mrs. Marsh in our telephone
conversation on May 6, 1992, the Type 2 permit approval is not
final until the end of this appeal period. It was also explained
that Cascade Electric & Maintenance, Inc. may only operate as a
Type 1 Home Occupation until the appeal period has passed.
By signing the Type 1 application form, you agreed to the following
statement:
I hereby certify that I have read and understand the above
conditions and standards as they apply to home occupations.

above conditions have not or are not -being complied with and
the home occupation is otherwise being conducted in a manner

The City of Tigard Code Enforcement Officer, Mr. Ken Schreindl,
visited the site of Cascade Electric & Maintenance, Inc. (11769 SW
129th Place) the morning of May 15, 1992 between approximately 6:45
a.m. and 7:15 a.m. in response to numerous citizen complaints
concerning the operation of your business. Mr. Schreindl reported
witnessing three employees on your property at one time actively
engaged in business activity. This included unlocking and opening
the doors of the business van and unloading materials from the top
of the van.
- The March 6, 1992 decision to approve your Type 2 permit (HOP 92-
0090) is hereby ammended to revoke the Type 2 permit application
for the following reason:
Code Section 18.142.050(A)(2) states:
Property on which a Type 2 home occupation is located may show
evidence that a business is being conducted from the premises.
Therefore the following is allowed for Type 2 home
occupations:
b) No more than one (emphasis added) outside volunteer or
employee who is not a principal resident of the premises
[per day].
The code violation which has caused the City to revoke your
approved Type 1 home occupation permit has also resulted in the
denial of your pending Type 2 permit. _
Additionally, the supplementary $40.00 check which you paid to the
City of Tigard on May 5, 1992 towards the Type 2 Home Occupation
Permit has been returned due to insufficient funds. I have been
informed that this check (receipt #92 has been resent and
cannot be resent again. Therefore, the permit fee for the Type 2
permit was effectually never paid.
Therefore, I must now state that with the revocation of the Type 1
permit (HOP 92 -0084) and the denial of the Type 2 permit (HOP 92-
0090), the business operation of Cascade Electric & Maintenance,
Inc. must cease entirely from the property commonly referred to as

I have reviewed the Voluntary Compliance Agreement and have the
following comments:
1. Amend the second paragraph (wherein Marsh acknowledges that
his home occupation permit was revoked) by adding some
reference to the home occupation permit that he applied for
but was never processed because of a check returned for
insufficient funds.
2. Reference the TDC section that prohibits Marsh from applying
for a home occupation permit for another year and give the
date on which he may reapply.
3. Change the last paragraph by deleting the period in the last
sentence and adding "and class I infractions for violation of
TDC Chapter 18.142."

appeal of this decision in accordance with the Community Development Code.

My appeal is based on the fact that the conditions of the permit have not been met and will
continue to be ignored.
8) No Home occupation shall require any on or off - street parking other than that
normally required for a residence;
This business which has been operating for at least the past three months without a permit
has two commercial vehicles that are used daily and at least one of them is parked in front
of my house every night. Five full time employees park their vehicles daily on the street and
in front of my house. , The mailbox for the cul -de -sac is located in front of my residence, the
Post Office will not deliver mail when this is blocked. Several times we have not received
mail because of this business's employees parking in front of the mailbox. The mail carrier
blames us thinking it is our vehicle, since it is in front of our house.
10) There shall be no exterior storage of vehicles of any kind used for the business
except that one commercially licensed vehicle of not more than three - quarters ton
GVW may be parked outside of a structure or screened area.
As I stated there are two vehicles associated with this business. one van with the company
name on it and one pickup with canopy also loaded with tools and supplies used everyday
for the business. The employees also park their vehicles all day and sometimes double park
them in the street.

10b) No more than one outside volunteer or employee who is not a principal resident of

As I stated there are at least five full time employees that drive to this location everyday
and park their vehicles. These employees gather at 7:00 each morning and throughout the
day discussing business in the driveway. This sometimes extends past normal working hours.
10c) No more than six daily customers or clients. Customers and clients may not visit the
business between the hours of 10:00 pm and 8:00 am and shall not generate excessive
traffic or monopolize on- street parking;
People arrive at this location as early as 7:00 and do not park in front of residence of this
business, even though there is room, but in front of everybody else's residence. The vehicles
going to and from this business do not observe the speed limit and are not cautious of the
many small children in this neighborhood.
I purchased this property in good faith that the City of Tigard would continue to enforce the
residential nature of this area. I specifically moved to this area because there were no
commercial properties except in major areas. The allowance of this activity would reduce
the value of surrounding property thus causing all affected properties to appeal their
assessment to a lower level do to the changing nature of this once residential area. I am
very concerned about my children as well as the other small children in this area since they
will have to play next to a street with increased and speeding traffic.
This business has been operating this way for several months and it seems that they are
applying for a permit only because someone has complained. If you approve a permit for
this business, even if they assured you that they would abide by the conditions, it would
continue to cause the problems that are now disturbing our neighborhood. Based on the
fact that they did not apply for this permit prior to operation would suggest that they will
also not conform to the conditions of the permit.
