This Home Occupation was previously approved on 2/26/91 subject to conditions as
specified in Section 18.142 of the Community Development Code (Home Occupations).
Although the application satisfied the Home Occupation approval requirements of
the code, it has been shown that this Home Occupation, if approved, would violate
a known deed restriction attached to or imposed upon the subject property.
The application form requests certification that the Home Occupation request does
not violate any deed restrictions that may be attached to or imposed upon the
subject property. Additionally, the application form requests acknowledgement
that all of the written statements and statements in the plot plan, attachments,

It has been demonstrated that Section 4.1.4 of the Colony Creek Estates Codes,
Covenants and Restrictions document applicable to the subject property states

kind shall be conducted on any lot, nor shall any goods, equipment, vehicles,
materials or supplies used in connection with any trade, service or business be
kept or stored on any lot.
Therefore, the City of Tigard amends the earlier decision and hereby denies Home

To the City of Tigard:
Whereas the residents of Fanno Creek Court have been informed
that Toan Ngoc Nguyen, a resident of Colony Creek Estates, has
applied to the City Planning Officer for permission to conduct a
janitorial business from his home, 14220 Fanno Creek Court, and
Whereas this application HOP 91 -0005 (HOP 91 -05 ?) has been
approved by the City Planning Officer, and
Whereas all homeowners in the Colony Creek Estates, including Mr.
Toan Ngoc Nguyen, were asked, at the time of purchasing such
home, to agree to observe and sign a Declaration of Protective
Covenants, and
Whereas this formed part of the sales agreement between the
builder, Titan Corporation, and the buyer, and
Whereas Section 4.1.4 of this agreement states:
"No trade, craft, business, profession,
commercial or similar activity of any kind shall be
conducted on any lot, nor shall any goods, equipment,
vehicles, materials or supplies used in connection
with any trade, service or business be kept or stored
on any lot," and
Whereas Section 9.3 of this agreement states:
"The provisions of these Covenants ...shall be
deemed to be for the benefit of the City of Tigard as
well as the Declarant and the owners of lots within
Colony Creek Estates (and) The City of Tigard may
enforce such provision by appropriate proceedings at
law or in equity," and
Whereas the undersigned other residents of Fanno Creek Court are
of the opinion that the activity proposed at 14220 Fanno Creek
Court by Mr. Toan Ngoc Nguyen is contrary to the Declaration of
Protective Covenants, and will constitute a nuisance entirely
contrary to their wishes,
Now, Therefore, the undersigned residents do petition the City of
Tigard to deny this application and to inform Mr. Toan Ngoc
Nguyen that he must abide by this denial in a manner of proper
compliance, without any threats or demonstrations of any kind
toward his neighbors.
In testament of which the following residents do hereby subscribe
their names, their addresses, and their lawful signatures.
