. . ��� �� � � CITY OF TIGARD NOTICE OF DECISION HOP 88-18 V 88-13 NEIL S. ARNEY APPLICATION: A request by Neil S. Arney for a home occupation permit to allow operation of a machine and welding shop on property zoned CBD (Central Business District). Also, a variance request to allow an 18.60 square foot freestanding sign where 8 square feet is allowed for a home occupation in commercial zones. Location: 8750 SW Scoffins Street (WCTM 2S1 2AA, lot 2000) DECISION: Notice is hereby given that the Planning Director's Designee for the City of Tigard has APPROVED the above application subject to certain conditions. The findings and conclusions on which the Designee based his decision are as noted below. A. FINDING OF FACT 1. Background No previous applications have been reviewed by staff for the subject property. 2. Vicinity Information Surrounding properties in all directions are also zoned CBD (Central Business District). A single family residence lies immediately to the south, an office building lies to the north, and the Payless Shopping Center is directly across the street. 3. Site Information and Proposal Description The site is occupied by an approximately 1,500 square foot home and a 375 square foot detached accessory building or shop. The residential use of the property is nonconforming with the Community Development Code and the uses allowed outright in the CBD. The applicant proposes to conduct the business entirely within the shop. No customers or clients will come to the residence according to the applicant. No non-resident paid employees will come to the house either. The applicant has applied separately for a freestanding sign permit. 4. Agency and NPO Comments NPO #1 will be notified of the Director's decision and will be given the opportunity to appeal. NOTICE OF DECISION - HOP 88-18, V 88-13 - NEIL S. ARNEY - PAGE 1 B. ANALYSIS AND CON(SION • The proposal meets the provisions of Chapter 18.142 of the Tigard Community Development Code which regulates home occupations. The single — family residential use on the property is considered a . nonconforming use as stipulated in Chapter 18.132 of the Code. The welding business, by itself, would not be permitted in the Central Business District as this zone does not allow light industrial -type uses. A nonconforming use may be continued so long as it is not expanded and the nonconforming use is in continuous operation. This home occupation is consistent with a nonconforming residential use so long as all of the conditions given below are met. Should the applicant desire to expand the business at some time in the future, he may need to consider relocating his residence and business to another location. The applicant also wishes to erect a 6 foot high, 18.66 square foot sign (9.33 sq. ft. per face) in conjunction with his home occupation. No wall signage is proposed. Section 18.142.035(e) allows one freestanding sign for a home occupation in a commercial zoning district no larger than 8 square feet in area (4 sq. ft. per face) and 6 feet in height. Wall signage cannot exceed 4 square feet. The applicant by necessity must have approval of variance prior to erection of this sign. He has already submitted the necessary documents for a City sign permit. Section 18.134.050 of the Code contains the approval criteria whereby the Director can approve, approve with conditions, or deny a variance request. They are: 1. The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity. 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and 5. The hardship is not self -- imposed and the variance requested is the minimum variance which would alleviate the hardship. NOTICE OF DECISION — HOP 88 -18, V 88 -13 — NEIL S. ARNEY — PAGE 2 ` ���N Section 18.114.1 contains the standards for��wuootanding signs in the CBD zone for uses that are permitted outright. One freestanding sign with a maximum sign height of 20 feet (22 feet if set back 20 feet from the property line) and a maximum sign area of 70 square feet (90 square feet if set back 20 feet from the property lined) is allowed. The applicant's proposed freestanding sign is 10.66 square feet (5.38 sq. ft. per side) larger than the Code would allow for a home occupation in the COD zone (8 sq. ft freestanding sign, 4 sq. ft wall sign). Although the freestanding sign will exceed Code standards, no wall signage is proposed. The proposed variance appears to be appropriate because of the commercial character of the northern section of Scoffins Street and the small scale of the sign. Commercial uses in this zone are entitled to a freestanding sign with a total area of 140 square feet. The purpose of the sign area limitation for home occupations is to prevent the erection of commercial type signage within residential neighborhoods. This variance should not adversely affect any residences in the vicinity and obviously, no impact will be felt by adjoining businesses. C. DECISION The Planning staff approves HOP 88-18 and V 88-13 subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be NO customers or clients coming to the residence in conjunction with the business. 3. The Home Occupation Permit shall be renewed annually. 4. A Business Tax shall be paid annually for the business. 5. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 6. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 7. Wall signage shall not be permitted at this location so long as the subject freestanding sign remains erected. 8. The freestanding sign shall not exceed a total of 19 square feet in size and 6 feet in height. 9. This approval is valid if exercised within one year of the final decision date noted below.
