HOP1988-00001 • 411 CITY OF TIGARD NOTICE OF DECISION HOME OCCUPATION PERMIT HOP 88 -1 Leslie & Joyce Peters (Southwest Sharpening Center) APPLICATION: Request by Leslie and Joyce Peters for Home Occupation Permit approval to allow continued operation of a sharpening business from their residence in an area zoned R -12 (Residential, 12 units /acre). This parcel and adjacent properties were annexed to the City of Tigard in July 1987. The Peters have had a Washington County Home Occupation Permit for the business since 1985. Location 10860 SW 95th Avenue (WCTM 1S1 35AC, lot 2600). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1. Background -) The parcel and surrounding parcels were annexed into the City of Tigard in July 1987. The original Washington County permit for the applicant's home occupation was approved on January 18, 1985 (File 84- 626 —SU) and renewed annually since that time. The Tigard City Council amended Community Development Code Chapter 18.142.032 on May 4, 1987 to state: "Certain types of uses may be granted nonconforming status by the City: 1. Home occupations under County authority prior to annexation to the City which have been in continuous operation, and a. which have been; or b. would have been found to meet the County's requirements." The home occupation presently applied for falls under this provision since the business has been approved by Washington County as meeting the County's requirements for a Home Occupation Permit and has been in operation continuously prior to annexation. Because the business qualifies for nonconforming status, it is necessary only for the business to demonstrate continued compliance with the County's requirements to obtain permit renewal. 2. Vicinity Information Properties surrounding and including the subject parcel are zoned R -12 (Residential, 12 units /acre) and are developed with single family residences. Site Information and Proposal Description There is an approximately 1,150 square foot house on the property and a 300 square foot attached garage. An approximately 500 square foot carport and shop area is located southeast of the house and across a cement patio. The carport is used for the sharpening business. A 280 square foot shop is located behind the carport. A number of mature trees exist on the site. A grove of tall fir trees and a group of shrubs separate the house and sharpening shop from the house to the south. A small sign advertising the business is located along the street. The applicants request renewal of their Home Occupation Permit previously issued by Washington County. The applicants sharpen saws, knives, lawnmowers, garden tools and "most anything that can be sharpened." The sharpening occurs in the carport. The applicants pick up and deliver items to be sharpened but also do have some customers coming to the residence. 4. Agency and NPO Comments NPO #2 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The sharpening business meets the Home Occupation Approval criteria of Chapter 18.142 of the Community Development Code with the exception of requirements that there be no customer traffic to the residence, no noise to be produced by the business, and no exterior business signs in a residential zoning district. Because the home occupation was established in Washington County and previously approved for a Home Occupation Permit by the County, the business is granted nonconforming status according to the provisions of Chapter 18.142.032 of the Code and, therefore, need not comply with City standards that differ from those standards applied by Washington County at the time of the original application for the Home Occupation Permit. However, the business is prohibited from expanding the degree of nonconformity through increasing the amount of signage, increasing the scope of business in ways that might produce additional noise, or encouraging additional customer traffic to the home. C. DECISION The Planning Director APPROVES HOP 88 -01 subject to the following conditions: 1. There shall be no paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be no additional signs or advertising visible from the exterior of the premises. The existing sign shall not be increased in size. 3. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no increase in the noise emitted from the home connected with the business. 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. The home occupation shall continue to comply with all original conditions of approval of Washington County Home Occupation Permit 84- 626 - -SU . D. PROCEDURE 1. The Framework Plan does require, though, that development applications be in compliance with the Community Development Code and the applicable Community Plan which, in this instance, is the Metzger /Progress Community Plan. This requirement is listed in the Preface of the Comprehensive Framework Plan. By demonstrating in this report that the request complies to the standards of the Code and Metzger /Progress Community Plan, this requirement will be satisfied. C. 1983 Metzger /Progress Community Plan: STAFF: There are no policies in this Plan which affect the site. D. 1985 Washington County Community Development Code: 1. Article II, Procedures: Section 202 -2 Type II §202-2.1 Type II land use actions are presumed to be appropriate in the district. They generally involve uses or development for which review criteria are reasonably objective, requiring only limited.discretion. Impacts on nearby properties may be associated with these uses which may necessitate imposition of specific conditions of approval to minimize those impacts or ensure compliance with this Code. STAFF: One letter from the City of Tigard, written in opposition to the request, was received during the fourteen day comment period. The letter outlined the City's standards for approval of a home occupation permit. It also stated that "the use may not be approvable if it were in the City. For instance, the business uses an off - premise sign which is prohibited." It shall be noted that the use of an off - premise sign is not allowed in the Washington County Community Development code. Therefore the sign, at the northeast corner of SW Greenburg Road and SW Shady Lane, is an illegal sign and shall be removed immediately. 86 -47 -H • • Page 4 The Department of Land Use and Transportation has not received any complaints since the approval date of this home occupation permit, January 18, 1985. Staff finds the use to be compatible with surrounding properties in the area, except for the off -site sign which will have to be removed. Section 207 -6 Conditions of Approval: §207 -6.1 The Review Authority may impose conditions on any Type II or III development approval. Such conditions shall be designed to protect the public from potential adverse impacts of the proposed use or development or to fulfill an identified need for public services within the impact areaoof the proposed development. Conditions shall not restrict densities to less than that authorized by the development standards of this Code. STAFF: The home occupation has not changed since its original approval in 1985. However, the permit is not in compliance with the conditions of approval, specifically condition #2 regarding the location of the sign. See the above finding. 2. III, Land Use District: Section 304 R -9 District STAFF: The applicant's home occupation is permitted in this District as a Type II application. B. Article IV, Development Standards: Section 430 -63.2 Home Occupations (Type II) A Type II Home Occupation shall: A. Require the applicant to obtain a permit which shall be renewed annually; STAFF: This application is for the renewal of the home occupation permit. B. Remaining Home Occupation Standards, • 430 -53.2 B through K. STAFF: The applicant's business.meets all of these remaining standards except Standard E. . • 0 4 1 1 6_47 -H • • 'Page 5 E. Limit any external evidence of an occupation to one (1) identification sign not to exceed two (2) square feet in area. { STAFF: The applicant has placed an A -fram off - premise sign at the northeast corner of SW Greenburg Road and SW Shady Lane. The Code allows only one sign in the residential districtsich can be placed anywhere on the premises, except in a required side yard or within ten feet of a street right -of -way (Section 414 -1.3). Therefore, the sign at the intersection is illegal and shall be removed immediately. There also is an existing sign at the premises. This sign shall be limited to two square feet in area. III. CONCLUSION: The applicant's request to renew her home occupation permit meets the applicable approval standards as demonstrated in Section II of this report. IV. RECOMMENDATION: Based upon the findings and conclusion of this report, the renewal of this home occupation is approved subject to the following conditions: A. 1985 Community Development Code Regulations: 1. The applicant shall submit an application to renew this home occupation permit within on year from the date of this approval. 2. There shall be continued compliance to the standards of Section 430 -63.2 - Type II Home Occupation standards. B. Conditions: 1. The applicant shall remove the illegal sign at the northeast corner of SW Greenburg Road and SW Shady Lane within thirty (30) days from the date of this approval. 2. The applicant shall he a resident of the house. The business shall be immediately discontinued if the applicant moves. C. Additional Information: 1.
