HOP1987-00033 CITY OF TIGARD NOTICE OF DECISION HOME OCCUPATION PERMIT HOP 87 -33 GENE CLAYTON APPLICATION: Request by Gene Clayton for a Home Occupation Permit to allow operation of an automobile restoration business from his residence in an area zoned R- 4.5(PD) (Residential 4.5 units /acre, Planned Development). Location: 15055 SW 88th Avenue (WCTM 2S1 11AD, Tax Lot 11200). DECISION: Notice is hereby given that the Planning Director's Designee for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director's designee based his decision are as noted below. A. FINDING OF FACT 1. Background No previous applications have been reviewed by the Planning Division with regard to the subject property. Scheckla Park Estates, which contains the property, was platted in 1978. 2. Vicinity Information Properties within 250 feet of the subject parcel are zoned R- 4.5(PD) and are mostly developed with single family residences. The parcel immediately north of the subject parcel is currently vacant. 3. Site Information and Proposal Description There is a 1400 square foot residence with a 440 square foot attached garage on the property. The applicant proposes to use the garage for restoring automobiles. The applicant will occupy the remainder of the home. The business as proposed will not occupy more than 25% of the home. The applicant has stated that no customers or delivery persons will visit the house in association with the business. In addition, the applicant has stated that there will be no outdoor storage of vehicles or materials associated with the business and that the business will not generate any noise able to be heard outside of the structure. 4. Agency and NPO Comments NPO #6 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The proposal as described above meets the Home Occupation approval criteria set forth in Chapter 18.142 of the Tigard Municipal Code. C. DECISION Home Occupation Permit HOP 87 -33 is approved subject to the following conditions: NOTICE OF DECISION - HOP 87 -33 — CLAYTON - PAGE 1 1. There shall be "fd0 paid employees working in home in conjunction with the business who are not residents of the home. 2. There shall be no signs or advertising visible from the exterior, of the premises. 3. There shall be NO customers or clients coming to the residence in conjunction with the business. 4. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
