Beardsley for approval of a home occupation permit to allow operation or an office for a residential landscaping business (d.b.a. "Nature's Way Landscaping ") on property zoned R -7 (PD) (Single Family Residential, 7 units /acre, Planned Development). Location: 8375 SW Colony Creek Court (WCTM 291 120113 Lot 1000). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the application subject to certain conditions. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1. Background No previous applications have been reviewed by the Planning Division staff with respect to the subject property. 2. Vicinity Information Properties to the east and west are also zoned and developed R -7 (PD)(single family residential, 7 units /acre, planned development). Properties to the north and south are zoned R -7 (single family residential, 7 units /acre). 3. Site Information and Proposal Description There is presently a 1,277 square foot residence on the property. The applicant proposes to use 94.5 square feet as an office. The remainder of the home will be used as a residence. 4. Agency and NPO Comments NPO #5 will be notified of the Director's decision and will be given the opportunity to appeal. B. ANALYSIS AND CONCLUSION The use as proposed meets all requirements of Chapter 18.142 of the Community Development Code which discusses home occupations. C. DECISION Home Occupation Permit HOP 87 -28 is approved subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. NOTICE OF DECISION — HOP 87 -28 — PAGE 1 2. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
