APPLICATION: Request by Melvin G. Waymire, Jr. for approval of a home occupation
permit to allow operation of an office for a residential home construction business
(d.b.a. "Mel Waymire, Builder ") on property zoned R -2 (Single Family Residential,
2 units /acre). Location: 10845 SW Dover Court (WCTM 2S1 15AD lot 4100).
DECISION: Notice is hereby given that the Planning Director's Designee for the
City of Tigard has APPROVED the application subject to certain conditions. The
findings and conclusions on which the Director's designee based his decision are as
noted below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning Division staff
with respect to the subject property. The applicant has been operating
this same business at 9725 SW Murdock Street since 1985 (HOP 20 -85). No
complaints were received by staff. Because the applicant has moved, a new
home occupation application is required. The approval criteria by which
home occupation permits are reviewed and granted depend on the location of
the residence and how the business will be conducted.
2. Vicinity Information
Properties to the east, south and west are also zoned R -2. Properties to
the north are located in Washington County.
3. Site Information and Proposal Description
There is presently a 1896 square foot residence on the property. The
applicant proposes to use 147 square feet as an office. The remainder of
the home will be used as a residence.
4. Agency and NPO Comments
NPO #6 will be notified of the Director's decision and will be given the
opportunity to appeal.
B. ANALYSIS AND CONCLUSION
The use as proposed meets all requirements of Chapter 18.142 of the Community
Development Code which discusses home occupations.
C. DECISION
Home Occupation Permit HOP 87 -22 is approved subject to the following
conditions:
1. There shall be NO paid employees working in the home in conjunction with
the business who are not residents of the home.

2. There shall • no.signs or advertising visit from the exterior of the
premises.
3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually.
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the business
which is audible to abutting residences.
7. There shall be no outdoor storage of materials, vehicles, or products on
the premises. Indoor storage of materials or products shall not exceed
the limitations imposed by the provisions of the Building, Fire, Health,
and Housing Codes.
8. This approval is valid if exercised within one year of the final decision
date noted below.
