HOP1987-00021 • • CITY OF TIGARD NOTICE OF AN AMENDED DECISION HOP 87 -21 TRACY LIVINGSTON APPLICATION: A request by Tracy Livingston for approval of a Home Occupation Permit to allow operation of a mobile music entertainment service on property zoned R -4.5 (Single Family Residential, 4.5 units /acre). Location: 11100 SW 95th (WCTM 1S1 35DB lot 10400). DECISION: Notice is hereby given that the Planning Director's Designee for the City of Tigard has APPROVED AMENDED HOP 87 -21 subject to certain conditions. The findings and conclusions on which the Director's designee based his decision are as noted below. A. FINDING OF FACT 1. Background No previous applications have been reviewed by the Planning Division staff with respect to the subject property 2. Vicinity Information Properties to the immediate north, east and south of this subject property are also zoned R -4.5. Properties to the west are zoned R -12 (Medium Density Residential, 12 units /acre). 3. Site Information and Proposal Description An amended staff report and a new director's decision is hereby being issued because of a misunderstandng between staff and the applicant regarding his intentions for the site. This new decision will extend the appeal period. This .19 acre parcel presently contains a 700 square foot single family structure. The applicant intends to remodel the existing structure into a 2400 square foot residence with an attached garage. Until the applicant has been issued an occupancy permit by the Building Division, he will not be permitted to operate the business from this .location. The applicant intends to store sound equipment which would then be hauled to locations for dances. No on —site customer contact is planned; customers will be contacted by mail or by phone. Some speaker construction will occur in the garage and music recording will occur in the living quarters of the home. The applicant proposes to use 160 square feet for the business which is less than the 25% maximum floor area allowed. The remainder of the home will be used as a residence. 4. Agency and NPO Comments NPO #2 will be notified of the Director's decision and will be given the opportunity to appeal. B. ANALYSIS AND CONCLUSION The proposal as submitted meets the conditions for approval set for the in Community Development Code Chapter 18.142. Unless otherwise noted, operation of this business at this location shall not be permitted until issuance of occupancy permit. 2. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 3. There shall be no signs or advertising visible from the exterior of the premises. 4. There shall be NO customers or clients coming to the residence in conjunction with the business. 5. The Home Occupation Permit shall be renewed annually. 6. A Business Tax shall be paid annually for the business. 7. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 8. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 9. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
