. i CITY OF TIGARD NOTICE OF DECISION HOP 87 -13 JOHN HIBBARD — MODERN LAYOUT APPLICATION: Request by John Hibbard for approval of a Home Occupation Permit to allow a distribution business for computer layout packages (d.b.a. Modern Layout) to be conducted from his residence on property that is zoned R -25 (CBD) (Multi— Family Residential, 25 units per acre, Central Business District). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director's designee based his decision are as noted below. A. FINDING OF FACT 1. Background The Viking Apartments are a 17 unit multiple family development built in 1972. Since construction, no applications have been reviewed by the Planning Director for this property. 2. Vicinity Information The subject property is surrounded by the following zoning districts: R -4.5 (Single Family Residential, 4.5 units per acre) to the west, R -12 (Multiple Family Residential, 12 units per acre) to the north and CBD (Central Business District) on the east and south sides. Development in the vicinity is mixed with both single family and multiple family residential units on the north side of SW Commercial and predominately light industrial /manufacturing south of SW Commercial and across the railroad tracks. 3. Site Information and Proposal Description The applicant is a resident in the Viking Apartment complex. He is proposing to conduct a distribution business for computer layout packages from this residence. He is also considering a mail order distribution enterprise for weight lifting equipment to begin at a later date. 4. Agency and NPO Comments NPO #2 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The proposed home occupation satisfies the provisions set forth in Chapter 18.142 of the Tigard Community Code. Under these provisions no more than 95 square feet of the residence can be used as part of the home occupation. As indicated by the applicant, the amount of floor area to be utilized for his business will be under the maximum allowed. NOTICE OF DECISION — HOP 87 -13 — PAGE 1 • • Besides the distribution of computer layout packages, the applicant is considering a mail order business for weight lifting equipment. This home occupation permit is intended to include such a business as long as the provisions and criteria for home occupation are not violated (see conditions). Applicant has been advised of such conditions should he go ahead with a second business venture. C. DECISION HOP 87 -13 is approved subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be no signs or advertising visible from the exterior of the premises. 3. There shall be NO customers or clients coming to the residence in conjunction with the business. 4. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
