APPLICATION: Request by Lynn Eckersley for approval of a Home Occupation Permit to allow a children's day care referral service (d.b.a. WEE -CARE Referral Services, Inc.) to be conducted from her residence on property that is zoned R -12 (Multi - Family Residential, 12 units per acre). Location: 11040 SW Greenburg Road (WCTM: 1S1 35CA lot 2800). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director's designee based his decision are as noted below. A. FINDING OF FACT 1. Background The Ash Creek Park Apartments were built when this property was under the jurisdiction of unincorporated Washington County. The property was part of a City of Tigard annexation in 1980. Since being annexed to Tigard no applications have been reviewed by the Planning Director for this property. 2. Vicinity Information The subject property is surrounded on all sides by R -12 zoning except across SW Greenburg directly west. On the west side of SW Greenburg property is zoned I -P (Industrial Park). Development in the vicinity is mixed with single and multi - family residences on the east side of SW Greenburg and commercial and light industrial uses on the west side of SW Greenburg. 3. Site Information and Proposal Description The applicant is a resident of. the Ash Creek Park Apartments. She is proposing to conduct a telephone referral service for parents needing day care for their children. All referrals will be conducted via telephone contacts and will not involve any on- premises, direct child care. 4. Agency and NPO Comments NPO #2 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The proposed home occupation satisfies the provisions set forth in Chapter 18.142 of the Tigard Municipal Code. Under these provisions no more than 225 square feet of the approximately 900 square feet of the residence may be used as part of the home occupation. The amount of floor area to be utilized for the applicant's referral business will be under the maximum allowed. NOTICE OF DECISION - HOP 87 -10 - PAGE 1 . • C. DECISION HOP 87 -10 is approved subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be no signs or advertising visible from the exterior of the premises. 3. There shall be NO customers or clients coming to the residence in conjunction with the business. 4. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
