APPLICATION: Request by Stan Benkey and Kathy Steiner for approval of a Home
Occupation Permit to allow a computer software mail order and consulting
business (dba Northwest Automation Services) to be conducted from their home
on property that is zoned R -2 (Single Family Residential, 2 units per acre).
Location: 14570 SW McFarland Boulevard. (WCTM 2S1 10BA lot 2400).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subject to certain
conditions. The findings and conclusions on which the Director's designee
based his decision are as noted below.
A. FINDING OF FACT
1. Background
This lot was originally platted as part of the Shadow Hills
subdivision in 1978. No land use applications have been reviewed by
the Planning Division for the property.
2. Vicinity Information
The subject property is surrounded on all sides by R -2 zoning and
development in the vicinity is exclusively single family residential
on lots averaging about 19,000 square feet. An exception to this
development pattern is the Diocese of Oregon property located directly
east of the applicant's property.
3. Site Information and Proposal Description
The applicants are the owners and residents of a single family
residence in Shadow Hills subdivision. They are proposing to operate
a mail order computer software business out of their home and will be
conducting the business under the name Northwest Automation Services.
The applicants have stated that the house has 2,100 square feet of
floor area and the business will involve the use of a 10 foot by
12 foot room as an office.
4. Agency and NPO Comments
NPO #3 will be notified of the Director's decision and will be given
the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposed home occupation satisfies the provisions set forth in
Chapter 18.142 of the Tigard Municipal Code. Under these provisions no
more than 525 square feet of the residence may be used as part of the home
occupation. The amount of floor area to be utilized for the applicants'
business will be under the maximum allowed.

C. DECISION
Home Occupation Permit HOP 87 -09 is approved subject to the following
conditions:
1. There shall be NO paid employees working in the home in conjunction with
the business who are not residents of the home.
2. There shall be no signs or advertising visible from the exterior of the
premises.
3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually.
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.

7. There shall be no outdoor storage of materials, vehicles, or products on
the premises. Indoor storage of materials or products shall not exceed
the limitations imposed by the provisions of the Building, Fire, Health,
and Housing Codes.
8. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City Hall and
mailed to:

2. Final Decision: THE DECISION SHALL BE FINAL ON April 10, 1987
UNLESS AN APPEAL IS FILED.
3. Appeal: Any party to the decision may appeal this decision in
accordance with Section 18.32.290(A) and Section 18.32.370 of the
Community Development Code which provides that a written appeal must be
filed with the CITY RECORDER within 10 days after notice is given and
sent. The deadline for filing of an appeal is 3:30 P.M. April 10, 1987.

It is time _ to renew your Home Occupation Permit, I an enclosing a - renewal
application for your convenience. Please complete the form and submit it along
with your $20.00 renewal fee. If you are no longer in business, please note
this on the application and complete only the first page. Return the
application form to the City of Tigard, Planning Division, Attention: Vi
Goodwin.
For your convenience, we are initiating a calendar year expiration date for all
Home Occupation Permits so they will correspond with the Business Tax
expiration date. This means you will be billed only once a year and both the
Home Occupation Permit and Business Tax will expire annually on December 31st.
To make this transition to the calendar year expiration date, we have adjusted
the expiration date of your Home Occupation Permit. You will not be billed
again until December 31, 1990 for the home Occupation Permit renewal. You
will, however, be billed for the Business Tax at the end of this year, December
31, 1989. Thereafter, the annual Home Occupation Permit and Business Tax fees
will be due in full on January 1st of each year.

"PURCHASER"
Seller agrees to sell to Purchaser and Purchaser agrees
to purchase from Seller for the price and on the terms and
conditions set forth below that certain real property, together
with all improvements thereon, situated in the County of Washington,
State of Oregon, described as follows:
Lot 40, SHADOW HILLS, Washington County, Oregon.
Said property is referred to herein as "the Property ".
1. PURCHASE PRICE AND PAYMENT. Purchaser promises
to pay as the total purchase price for the Property the sum •
of ($129,000.00) One Hundred Twenty -Nine Thousand and no /100
DOLLARS. Such amount shall be paid as follows:
1.1 The downpayment shall be $5,000.00, receipt of
which is hereby acknowledged.
1.2 The balance of $124,000.00 shall be due in eighteen
(18) months. While the balance is• outstanding, purchaser shall
pay interest thereon at the rate of (10.00 %) ten percent per
annum, in equal monthly installments of $1,033.34. Any or all
of the balance may be prepaid at any time without penalty, provided
that no payment less than the full contract balance shall excuse

18. USES OF PROPERTY. THIS INSTRUMENT DOES NOT GUARANTEE
THAT ANY PARTICULAR USE MAY BE MADE OF THE PROPERTY,DESCRIBED
IN THIS INSTRUMENT. A BUYER SHOULD CHECK WITH THE APPROPRIATE
CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY APPROVED USES.
19. DOCUMENT PREPARATION. This instrument was prepared
by Buccino & Uffelman,, P.C., attorneys for the Seller. The
Purchaser has been ' to obtain independent legal counsel
prior to executing this agreement.
