HOP1987-00009 • • CITY OF TIGARD NOTICE OF DECISION HOP 87 -09 STAN BENKEY & KATHY STEINER — NORTHWEST AUTOMATION SERVICES APPLICATION: Request by Stan Benkey and Kathy Steiner for approval of a Home Occupation Permit to allow a computer software mail order and consulting business (dba Northwest Automation Services) to be conducted from their home on property that is zoned R -2 (Single Family Residential, 2 units per acre). Location: 14570 SW McFarland Boulevard. (WCTM 2S1 10BA lot 2400). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described applications subject to certain conditions. The findings and conclusions on which the Director's designee based his decision are as noted below. A. FINDING OF FACT 1. Background This lot was originally platted as part of the Shadow Hills subdivision in 1978. No land use applications have been reviewed by the Planning Division for the property. 2. Vicinity Information The subject property is surrounded on all sides by R -2 zoning and development in the vicinity is exclusively single family residential on lots averaging about 19,000 square feet. An exception to this development pattern is the Diocese of Oregon property located directly east of the applicant's property. 3. Site Information and Proposal Description The applicants are the owners and residents of a single family residence in Shadow Hills subdivision. They are proposing to operate a mail order computer software business out of their home and will be conducting the business under the name Northwest Automation Services. The applicants have stated that the house has 2,100 square feet of floor area and the business will involve the use of a 10 foot by 12 foot room as an office. 4. Agency and NPO Comments NPO #3 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The proposed home occupation satisfies the provisions set forth in Chapter 18.142 of the Tigard Municipal Code. Under these provisions no more than 525 square feet of the residence may be used as part of the home occupation. The amount of floor area to be utilized for the applicants' business will be under the maximum allowed. NOTICE OF DECISION — HOP 87 - 09 — PAGE 1 ' • • C. DECISION Home Occupation Permit HOP 87 -09 is approved subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be no signs or advertising visible from the exterior of the premises. 3. There shall be NO customers or clients coming to the residence in conjunction with the business. 4. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 0 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
