APPLICATION: Request by Kent Blankenbaker for approval of a Home Occupation
Permit to allow a book authoring and mail order business (dba. Marco Thinc) to
be conducted from a residence on property on property zoned R -4.5 (Low Density
Residential, 4.5 units per acre). Location: 15615 SW 88th Avenue (WCTM
2S1 /11DD Tax Lot 3800).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subject to certain
conditions. The findings and conclusions on which the Director's designee
based his decision are as noted below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning Division
for this property.
2. Vicinity Information
The subject property is surrounded on all sides by R -4.5 zoning except
to the west which is zoned R -7 (Single Family Residential, 7 units per
acre). The entire area is currently built with single family
residential development on the west, south and east sides. To the
north, the land is cleared but undeveloped and is used for a pasture.
3. Site Information and Proposal Description
The applicant is the owner and resident of a 1350 square foot single
family residence. The proposed home occupation will involve a
customized computer programming service including the writing of
computer manuals and a mail order business to distribute them. The
business will be conducted from one room of the house which is
converted into an office and totals 132 square feet.
4. Agency and NPO Comments
NPO #6 will be notified of the Director's decision and will be given
the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposal meets the provisions set forth in chapter 18.142 of the City
of Tigard's Community Development Code (CDC). This allows for up to 25%
of the residence to be used for a home occupation providing the approval
criteria of Section 18.142.50 are met. In this case, the 132 square feet
indicated by the applicant to be utilized for his business falls well
below the 25% allotment.

C. DECISION

Home Occupation Permit HOP 87 -07 is approved subject to the following conditions:
1. There shall be NO paid employees working in the home in conjunction with the
business who are not residents of the home.
2. There shall be no signs or advertising visible from the exterior of the
premises.
3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually.
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the business
which is audible to abutting residences.
7. There shall be no outdoor storage of materials, vehicles, or products on the
premises. Indoor storage of materials or products shall not exceed the
limitations imposed by the provisions of the Building, Fire, Health, and
Housing Codes.
8. This approval is valid if exercised within one year of the final decision
date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City Hall and
mailed to:

2. Final Decision: THE DECISION SHALL BE FINAL ON MARCH 23, 1987 UNLESS AN
APPEAL IS FILED.
3. Appeal: Any party to the decision may appeal this decision in accordance
with Section 18.32.290(A) and Section 18.32.370 of the Community Development
Code which provides that a written appeal must be filed with the CITY
RECORDER within 10 days after notice is given and sent.
The deadline for filing of an appeal is 3:30 P.M. MARCH 23,1987 .

BETWEEN: Dirt. E. Barram and Nancy L. Barram, as
joint tenants with right of survivorship
SELLER
AND
Kent Vernon Blankenbaker and Linda Sue
Blankenbaker, as joint tenants with right
of survivorship
PURCHASER
Seller owns the real and personal property and fixtures located in
Washington County, Oregon, and described on attached Exhibit A (the •
Property).
Seller agrees to sell the Property to Purchaser and Purchaser
agrees to buy the Property from Seller for the price and on the terms
and conditions set forth below:
SECTION 1. PURCHASE PRICE; PAYMENT
1.1 Total Purchase Price. Purchaser promises to pay Seller as
the total purchase price for the Property the sum of $67,000.00 Dollars.
1.2 Payment of Total Purchase Price. The total purchase price
shall be paid as follows:
1.2.1 Purchaser shall pay on the Closing Date, as defined
in Section. 3.1, the sum of $10,000.00 Dollars as down payment on the
purchase price.
1.2.2 Purchaser shall assume all obligations and
liabilities, including payment of the existing mortgage on the real
property.
1.2.3 Interest on the remaining balance of $12,873.50
Dollars (representing the balance of $12,300.00 decreased by November
interest of $390.00 paid by Purchaser, and increased by $127.50 credit
to Seller for insurance paid through August 15, 1985 and $836.00 credit
to Seller for 1484 -85 proated taxes) shall accrue at the rate of 11
percent per annum from the Closing Date. The unpaid balance of the
purchase price shall be paid in a lump sum balloon on the earlier of
November 30, 1987 or within Thirty (30) days of distribution of proceeds
to purchaser from sale of that residence at 395 Woodley Road,
Montceieto, California (Santa Barbara County).
