APPLICATION: Request by Peggy Lutz for a Home Occupation Permit to allow
operation of a catering business (dba "Peggy's Culinations ") on property zoned
R -12 (Multiple Family Residential, 12 units per acre). Location: 7645 SW
Bonita Road, #6. (WCTM 2S1 12BA Lot 300).
DECISION: Notice is hereby given that the Planning Director's designee for
the City of Tigard has APPROVED the above application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDINGS OF FACT
1. Background Information
No previous applications have been reviewed by the Planning
Division for the subject property.
2. Vicinity Information
Properties to the north, west and south are zoned R -12 (Multiple
Family Residential, 12 units per acre). Properties to the east
are zoned I —L (Light Industrial).
3. Site Information and Proposal Description
Marcienne Terrace Apartments are situated on the property. The
applicant's home is a 700 square foot apartment. The applicant
proposes to use 2.56 square feet for the business. The applicant
will occupy the remainder of the home. The business as proposed
will not occupy more than 25% of the home.
4. Agency and NPO Comments
NPO #5 will be notified of the Director's decision and will be
given the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposal meets the provisions set forth in Chapter 18.142 of the
Tigard Municipal Code.
C. DECISION
Home Occupation Permit HOP 33 -86 is approved subject to the following
conditions:
1. There shall be NO paid employees working in the home in
conjunction with the business who are not residents of the home.
2. There shall be no signs or advertising visible from the exterior
of the premises.

3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually.
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.
7. There shall be no outdoor storage of materials, vehicles, or
products on the premises. Indoor storage of materials or products
shall not exceed the limitations imposed by the provisions of the
Building, Fire, Health, and Housing Codes.
8. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City
Hall and mailed to:

2. Final Decision:
THE DECISION SHALL BE FINAL ON November 25, 1986 UNLESS AN APPEAL

Any party to the decision may appeal this decision in accordance
with Section 18.32.290(A) and Section 18.32.370 of the Community
Development Code which provides that a written appeal must be
filed with the CITY RECORDER within 10 days after notice is given
and sent.
The deadline for filing of an appeal is 4:30 P.M. 11/25/8

Dear Ms Lutz:
This is to respond to your request for a determination regarding the
application procedure and fee for reinstating your expired Home Occupation
Permit, Peggy's Culinations (HOP 33 -86). I have reviewed your case with Keith
Liden, head of the Planning Division. It is his decision that you would need
to complete a Home Occupation Application rather than a HOP Renewal
Application should you wish to resume the operation of your business. Due to
the extenuating circumstances relating to the discontinuence of your business,
the fee charged to process your application would be $20, the standard renewal
fee, rather than $80, the usual charge for processing a new application.
Additionally, the lower fee will be effective regardless of when you apply for
reinstatement, i.e. no deadline is set for the application of the standard
renewal fee.
A copy of this letter is being placed in your HOP file.

Dear Peggy:
Pursuant to our discussion on November 24, 1987, the Planning Division will
allow you until January 31, 1988 to renew your Home Occupation permit for
Peggy's Culinations (HOP 33 -86) due to the extenuating circumstances that have
caused you to suspend your business. Should you resume your business before
that time, it will be necessary for you to renew this permit and pay the
business tax immediately. In addition, as we discussed, if you do not renew
the permit by January 31, 1988, it will be necessary to process your
application as a new permit request at a fee greater than would be charged for
a renewal.

contact me.
