APPLICATION: Request by William A. Monahan, Esq. for a Home Occupation Permit
for a legal practice (dba "William A. Monahan, Attorney at Law ") on property
zoned R -4.5 (PD) (Single Family Residential, 4.5 units per acre maximum,
Planned Development) and located at 10045 S.W. Serena Way (WCTM 2S1 14BB
Lot 400).
DECISION: Notice is hereby given that the Planning Director's designee for
the City of Tigard has APPROVED the above application subject to certain
conditions. The findings and conclusions on which the designee based her
decision are as noted below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning
Division with respect to the subject property.
2. Vicinity Information
Properties to the east, south and west are all zoned and developed
R -4.5 (PD) (Single Family Residential, 4.5 units per acre maximum,
Planned Development). Properties to the northwest are zoned
R -7 (PD) (Medium —High Density Residential, 7 units per acre
maximum, Planned Development). To the north properties are zoned
and developed R -4.5 (Single Family Residential, 4.5 units per acre
maximum).
3. Site Information and Proposal Description
There is a 1610 square foot home on the property. The applicant
proposes to use 224 square feet for the business. The applicant
will occupy the remainder of the home. The business as proposed
will not occupy more than 25% of the home. The applicant intends
to meet clients at their homes or away from the applicant's
property.
4. Agency and NPO Comments
NPO #6 will be notified of the Director's decision and will be
given the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposal meets the provisions set forth in Chapter 18.142 of the
Tigard Municipal Code. In order to discourage pedestrian and vehicular
traffic to the residence, newspaper, radio and TV advertising in which
the residential address is given should be prohibited. Use of the
residential address on other business — related printed materials should
also be prohibited.

C. DECISION • •
Home Occupation Permit HOP 26 -86 is approved subject to the following
conditions:
1. There shall be NO paid employees working in the home in
conjunction with the business.
2. There shall be no newspaper, radio or TV or other printed
advertising (other than business cards) in which the applicant's
residential address is given.
3. There shall be no signs or advertising visible from the exterior
of the premises.
4. There shall be NO customers or clients coming to the residence in
conjunction with the business.
5. The Home Occupation Permit shall be renewed annually.
6. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.
7. There shall be no outdoor storage or display of materials,
vehicles or products on the premises. Indoor storage of material
or products shall not exceed the limitations imposed by the
provision of the Building, Fire, Health and Housing Codes.
8. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City
Hall and mailed to:

THE DECISION SHALL BE FINAL ON September 26, 1986 UNLESS AN APPEAL

with Section 18.32.290(A) and Section 18.32.370 of the Community
Development Code which provides that a written appeal must be
filed with the CITY RECORDER within 10 days after notice is given
and sent.
The deadline for filing of an appeal is 3:30 P.M. 9/26/86
