APPLICATION: Request by Jake F. Gieszler for a Home Occupation Permit for an
electrical contracting business (d.b.a. "Alpha Electric ") on property zoned
C —P (Commercial — Professional). Location: 7075 SW Gonzaga (WCTM 2S1 1AC Tax
Lot 300).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain condition. The
findings and conclusions on which the Director based his decision are as noted
below.
A. FINDINGS OF FACT
1. Background
No previous applications have been reviewed by the Planning
Division for the subject property.
2. Vicinity Information
Properties in all directions are zoned C —P
(Commercial— Professional).
3. Site Information and Proposal Description
There is a 2352 square foot home on the property. The applicant
proposes to use 480 square feet for the business. The applicant
will occupy the remainder of the home. The business as proposed
will not occupy more than 25% of the home.
4. Agency and NPO Comments
NPO #5 will be notified of the Director's decision and will be
given the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposal meets the provisions set forth in Chapter 18.142 of the
Tigard Municipal Code.
C. DECISION
Home Occupation Permit HOP 17 -86 is approved subject to the following
conditions:
1. There shall be NO paid employees working in the home in
conjunction with the business.

2. There shall le no signs or advertising visit) e from the exterior
of the premises.
3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually.
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.
7. There shall be no outdoor storage of materials, vehicles or
products on the premises. Indoor storage of material or products
shall not exceed the limitations imposed by the provisions of the
Building, Fire, Health and Housing Codes.
8. This approval is valid if exercised within one year of the final
decision date noted below.

with Section 18.32.290(A) and Section 18.32.370 of the Community
Development Code which provides that a written appeal must be
filed with the CITY RECORDER within 10 days after notice is given
and sent.
The deadline for filing of an appeal is 3:30 P.M. August 28, 1986.

Dear Mr. Gieszler:
The City has received two written complaints regarding the operation of your
home occupation, d.b.a. "Alpha Electric" (HOP 17 -86). Upon receipt of
complaints the City is obligated to investigate such complaints and determine
their validity. The complaints alleged that 1) employees were coming to your
residence, and 2) that you are storing vehicles and materials or products
outdoors on the premises. Finally, it is alleged that more than one vehicle
is being used in conjunction with the business.
The City Code Enforcement Officer inspected your property recently and
determined that all of these allegations are in fact true. These actions are
in violation of Tigard Community Development Code, Chapter 18.142. The Code
Sections are as follows: 18.142.050 (6) and (10). Because the two vehicles do
not require parking in excess of what is normally required for a single family
residence, the third allegation has been dismissed.
Because the City Council has in the past expressed their intent that the home
occupation ordinance be strictly interpreted and enforced, as designee for the
Director, I will approve your home occupation permit for a limited time only
subject to your strict adherence to the following and your acknowledgment of
this by your signature below:
1. There shall be no paid employees on the premises other than those who are
permanent residents of the dwelling.
2. There shall be no outdoor storage or display of materials, vehicles, or
products on the premises.
3. The renewal permit will be valid until February 28, 1989.
