APPLICATION: Request by Henry and Donna Pearson for a Home Occupation Permit
for Pearson Construction Co. on property zoned R -3.5 (Single Family Residential,
3.5 units per acre). Location: 7525 S.W. Varns Street (WCTM 2S1 1DB Lot 601).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain conditions. The
findings and conclusions on which the Director based his decision are as noted
below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning Department
for this property.
2. Vicinity Information
Properties in all directions are zoned R -3.5 (Single Family Residential,
3.5 units per acre).
3. Site Information and Proposal Description
There is a 1538 square foot home on the property. The applicant proposes
to use 99 square feet of the home for a business office. The applicant
and family use the remainder of the home as a residence. The use as
proposed will not occupy more than 25 percent of the gross floor area
of the home.
4. Agency and NPO Comments
NPO #5 will be notified of the Director's Decision and given the right to appeal.
B. ANALYSIS AND CONCLUSION
The proposal meets the provisions set forth in_Chapter 18.142 of the Tigard
Municipal Code.
C. DECISION
Home Occupation Permit HOP 8 =86 is approved subject to the following
conditions:
1. There shall be no outside storage of materials, vehicles or products
on the premises. Indoor storage of material or products shall not
exceed the limitations imposed by the provisions of the Building, Fire,
Health and Housing Codes.

2. There shall be no paid employee working in the home in conjuction with
the business who are not residents of the home. _
3.. There shall be no signs or advertising visible from the exterior of
the premises.
4. There shall be NO customers or clients coming to the residence in
conjunction with the business.
5. The Home Occupation Permit shall be renewed annually. •
6. A Business Tax shall be paid annually for the business.
7. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.
This approval is valid if exercised within one year of the final decision
date noted below.

RE: Violation Of Home Occupation Permit �-�DP x' 10-61
Dear Mr. & Mrs Pearson:
The above violation is in existence at your home. The problem involves the
heavy equipment stored on the rear and side of the property. The dump trucks
and backhoe violate the following section of Tigard Municipal Code #18.142
HOME OCCUPATION:
"18.142.050 Approval Criteria: (e) There shall be no outdoor storage of
materials, vehicles or products; (j) The use shall not require any
additional parking other than that which is required for the residence."
The requirements are not being met. The Planning Division has contacted me to
inform you of the requirements needed to correct the problem(s).
The vehicle(s) and equipment must be removed within ten days from the above
date. If the ten days is not enough time, you may contact me and agree to sign
a Voluntary Compliance Agreement, which gives an extension if we can agree
