HAROLD JONES
APPLICATION: A request by Harold Jones to operate an acetylene gas tank
repair business (dba "Oxygen Equipment Repair Service ") on property zoned
R -4.5 (PD) (Single Family Residential, 4.5 units /acre, Planned Development).
Location: 15220 SW 79th (WCTM 2S1 12CA lot 3200).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain conditions. The
findings and conclusions on which the Director's designee based his decision
are as noted below.
A. FINDING OF FACT
1. Background
Mr. Jones first applied to the City for a business license and a home
occupation permit in April, 1986. Shortly thereafter staff realized
the applicant was using a detached shop for his business which was
prohibited by the home occupation ordinance in effect at the time.
The applicant withdrew his application but signed a Voluntary
Compliance Agreement indicating his agreement to a future home
occupation application if a revised ordinance was passed allowing his
porposed use.
Ordinance 87 -20 was signed by the Mayor of Tigard on May 4, 1987 and
will be in effect on June 5, 1987. It contains new regulations
pertaining to accessory structures and is further discussed in the
Analysis section below.
2. Vicinity Information
Properties to the south and northwest are all zoned R -4.5
(Residential, 4.5 units /acre). Properties immediately to the north
and east are zoned R -4.5 (PD) (Residential, 4.5 units /acre, Planned
Development). Properties to the west are zoned R -7 (Residential,
7 units /acre).
3. Site Information and Proposal Description
There is a 2870 square foot residence and a 576 square foot detached
shop on the property. The applicant proposes to use 576 square feet
of the shop for the business. No portion of the residence will be
used for the business. The business as proposed will not occupy more
than 25% of the combined floor area of both the home and shop. The
business began in 1971.
The business involves the repair of hoses, gauges and fittings for
oxygen and acetylene equipment. This is not of a hazardous nature.

, 4. Agency and NPO Comments
NPO #5 will be notified of the Director's designee's decision and will
be given the right to appeal. _
The Building Inspection Division has reviewed the proposal and has the
following comments:
Mr. Jones should provide his business with a minimum of one
2A -10BC fire extinguisher. At least one door should be provided
from the shop directly to the outside (not through the garage)
with locking devices that can be opened from inside without the
use of keys.
B. ANALYSIS AND CONCLUSION
Section 18.142.050 of the Community Development Code contains specific
approval criteria for home occupations. Subsection (b)(1) states that
"the total area used in the accessory building shall not exceed 500 square
feet. Any accessory building that is used must meet Uniform Building Code
requirements and be in conformance with Chapter 18.144 of the Code
[Accessory Structures]."
The applicant proposes to use 76 square feet more than what the ordinance
allows. However, it is also possible for the City to approve a variance
request based on the fact that the shop is pre— existing and has been in
use since 1971. It would no doubt be impractical for the owner to reduce
his shop area in use by 76 square feet. However, it appears that the shop
meets all provisions of Chapter 18.144. If denied, the applicant could
apply for nonconforming status since he has been in operation since 1971.
The City has received no complaints regarding this business.
C. DECISION
Home Occupation Permit HOP 7 -86 and Variance 87-08 is approved subject to
the following conditions:
1. There shall be NO paid employees working in the .home in conjunction
with the business who are not residents of the home.
2. There shall be no signs or advertising visible from the exterior of
the premises.
3. There shall be NO customers or clients coming to the residence in
conjunction with the business.
4. The Home Occupation Permit shall be renewed annually. .
5. A Business Tax shall be paid annually for the business.
6. There shall be no noise emitted from the home connected with the
business which is audible to abutting residences.

7. There shall be n • tdoor storage of materials, vehicles, or products
on the premises. Indoor storage of materials or products shall not
exceed the limitations imposed by the provisions of the Building,
Fire, Health, and Housing Codes.
8. The applicant shall ensure that a door is constructed in the shop to
provice direct egress from the shop to the outside. The door shall be
equipped with locks which can be opened from the inside without keys.
The applicant shall consult with the Building Inspector on these or
any other building uses..
9. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City Hall
and mailed to:

2. Final Decision: THE DECISION SHALL BE FINAL ON June 15, 1987
UNLESS AN APPEAL IS FILED.
3. Appeal: Any party to the decision may appeal this decision in
accordance with 'Section 18.32.290(A) and Section 18.32.370 of the
Community Development Code which provides that a written appeal must
be filed with the CITY RECORDER within 10 days after notice is given
and sent.
The deadline for filing of an appeal is 3:30 P.M. June 15,1987 .

The mortgagor covenants that he owns the premises in fee simple, has good right to mortgage same, that the premises are free •
from encumbrance, that he will warrant and defend same forever against the claims and demands of all persons whomsoever, and this
covenant shall not be extinguished by foreclosure, but shall run with the land.
MORTGAGOR FURTHER COVENANTS AND AGREES:
1. To pay all debts and moneys secured hereby;

2. Not to permit the buildings to become vacant or unoccupied; not to permit the removal or demolishment of any buildings or im-
provements now or hereafter. existing to keep same in good repair; to complete all construction within a reasonable time in
accordance with any agreement made between the parties hereto;
3. Not to permit the cutting or removal of any timber except for his own domestic use; not to commit or suffer any waste;
4. Not to permit the use of the premises for any objectionable, or unlawful purpose;
5. Not to permit any tax, assessment, lien, or encumbrance to exist at any time;
6. Mortgagee Is authorized to pay all real property taxes assessed against the premises and add same to the principal, each of the
advances to bear interest as provided in the note;
7. To keep all buildings unceasingly insured during the term of the mortgage, against loss by fire and such other hazards in such
company or companies and in such an amount as shall be satisfactory to the mortgagee; to deposit with the mortgagee all such

8. Mortgagee shall be entitled to all compensation and damages received under right of eminent domain, or for any security volun-
tarily released, same to be applied upon the indebtedness;
9. Not to lease or rent the premises, or any part of same, without written consent of the mortgagee;
10. To promptly notify mortgagee in writing of a transfer of ownership of the premises or any part or interest in same, and to
furnish a copy of the instrument of transfer to the mortgagee; any purchaser shall assume the indebtedness. and purchasers
not entitled to a loan or 4% interest rate under ORS 407.010 to 407.210 shall pay interest as prescribed by ORS 407.070 on all pay-
ments due from the date of transfer; in all other respects this mortgage shall remain in full force and effect; no instrument of
transfer shall be valid unless same contains a covenant of the grantee whereby the grantee assumes the covenants of this mort-
gage and agrees to pay the indebtedness secured by same.
The mortgagee may, at his option, in case of default of the mortgagor, perform same in whole or in part and all expenditures made
in so doing including the employment of an attorney to secure compliance with the terms of the mortgage or the note shall draw
interest at the rate provided in the note and all such expenditures shall be immediately repayable by the mortgagor without demand
and shall be secured by this mortgage.
Default in any of the covenants or agreements herein contained or the expenditure. of any portion of the loan for purposes
other than those specified in the application, except by written permission of the mortgagee given before the expenditure is made,
shall cause the entire indebtedness at the option of the mortgagee to become immediately due and payable without notice and this
mortgage subject to foreclosure.
The failure of the mortgagee to exercise any options herein set forth Will not constitute a waiver of any right arising from a
breach of the covenants.
In case foreclosure is commenced, the mortgagor shall be liable for the cost of a title search, attorney fees, and all other costs
incurred in connection with such foreclosure.
Upon the breach of any covenant of the mortgage, the mortgagee shall have the right to enter the premises, take possession,
collect the rents, issues and profits and apply same, less reasonable costs of collection, upon the indebtedness and the mortgagee shall
have the right to the appointment of a receiver to collect same.
The covenants and agreements herein shall extend to and be binding upon the heirs, executors, administrators, successors and
assigns of the respective parties hereto. • -- • — -
It is distinctly understood and agreed that this mortgage is subject• to the provisions of Article XI -A of the Oregon Constitution,
ORS 407.010 to 407.210 and any subsequent amendments thereto and to all rules and regulations which have been issued or may here-
after be issued by the Director of Veterans' Affairs pursuant to the provisions of ORS 407.020.
