• • gYA, CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 94 -0027 KOLBERG - OWNER / APPLICANT APPLICATION: The applicant requests for Site Development Review approval to allow the construction of a 10,000 square foot commercial office building. Zoning: C -P (Professional Commercial). Location: 12775 SW 69th Avenue (WCTM 2S1 lAD, tax lot 3000) . SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 1. Standard half - street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, streetlights, and underground utilities shall be installed along the SW 69th Avenue frontage. Improvements shall be designed and constructed to local street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. The applicant shall connect to the underground storm drain system in SW 70th Avenue in an alignment approved by the Engineering Department. STAFF CONTACT: Michael Anderson, Engineering Department (639 -4171) 4. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. STAFF CONTACT: Greg Berry, Engineering Department (639- 4171) . 5. Washington County has established and the City has agreed to collect Traffic Impact Fees in accordance with Resolution No. 94 -18. The applicant shall pay the fee established for the proposed use. 6. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right -of -way. The second part is paid at Building Permit issuance which is for each individual lot. 7. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 70th Avenue. STAFF CONTACT: Diane Jelderks, Engineering Department (639 -4171) 8. The applicant shall place the overhead facilities along SW Hampton Street underground or pay the fee in -lieu of undergrounding. STAFF CONTACT: Michael Anderson, Engineering Department (639 -4171) 9. A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. STAFF CONTACT: Diane Jelderks, Engineering Department (639- 4171). 10. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: Will D'Andrea. The revised plans shall include the following: a. landscaping / impervious surface calculations which provide for a minimum 15% landscaping. b. screening of the trash enclosure. c. compliance with vision clearance at the SW Hampton and SW 70th intersection. d. two bicycle parking spaces. e. 15 foot one -way drive widths within the parking lot. f. A plan which shows compliance with Community Development Code Chapter 18.116, Mixed Solid Waste and Recyclable Storage. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan or Franchised Hauler Review and Sign -off. Regardless of which method NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 2 chosen, the applicant shall submit a letter from the franchise disposal company related to facility design and • compatibility. g. relocation of the midblock ADA ramp with one additional ramp on each corner. 5E-E- XE�ze 3/A0/96 h. In the event that the northern property owner does not intend to utilize this preliminary site plan and provide a joint access agreement, the applicant shall revise the preliminary plans so as to not encumber the property to the north and shall comply with the buffer requirements. 11. The applicant shall obtain a demolition permit from the Building Department for the removal of the existing residential buildings. 12. An exterior lighting plan shall be submitted to the Police Department for review and approval. Staff Contact: Kelly Jennings, Police Department (639- 4171). 13. The applicant shall submit drawings of the bus stop and ramp changes to Tri -Met for review and approval. Staff Contact: Kim Knox (239-6716). � tel",E2 3 /it0\ THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 14. All site improvements shall be installed as approved per the revised site plan. IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE LIST. 1. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS A. 18.164.180 Notice to City Required Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Backround: The subject site is presently developed with a single family residence. No other land use or development applications have been reviewed by the City of Tigard. 2. Vicinity Information: NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 3 ' 410 • The subject site is located east of SW 70th Avenue, west of SW 69th Avenue, and on the north side of SW Hampton Street. The • surrounding properties are zoned C -P (Professional Commercial) and are generally developed with commercial uses. The adjacent property to the north is developed with a single family residence and accessory structure. 3. Site Information and Proposal Description: The subject site is approximately 22,000 square feet in size. The site contains a single family residence with access onto SW 69th Avenue. The applicant is proposing to demolish the residence and construct a 10,000 square foot office building with access onto SW 69th Avenue. The applicant is proposing a joint access drive with the property to the north. 4. Other Staff Comments: The City of Tigard Building Division has reviewed this proposal and has offered the following comments: The applicant shall obtain a demolition permit for the two residential structures; cap -off all utilities to the demolished buildings per City standards; and provide erosion control per requirements of USA. 5. Agency Comments: Tri -Met has reviewed this proposal and has offered the following comments: The following comments respond to the requirements from the Transportation Planning Rule that new developments must orient to existing transit stops and that they provide safe and convenient pedestrian linkages to nearby destinations. Tri -Met recommends the following changes to the plan to strengthen the pedestrian linkages: 1) The plans should include frontage improvements to accommodate pedestrians including a new sidewalk along SW 70th Avenue and a landscaping buffer between the sidewalk and the street; 2) Relocate the ramp from the midblock location to the corners; 3) It does not appear that the existing ramp and bus stop meet ADA standards, therefore the applicant shall submit more detailed drawings showing the existing bus stop and shelter along with any proposed changes. The Unified Sewerage Agency has reviewed this proposal and has offered the following comments: A water quality facility will be necessary and an erosion control / prevention permit is required. General Telephone and Electronics has reviewed this proposal and has offered the following comments: NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 4 . • Developer to place conduit for telephone service to GTE specifications. The City of Tigard Maintenance Services Department, City of Tigard Police Department, Tigard Water Department, Tualatin Valley Fire District, Portland General Electric, has reviewed this application and have offered no comments or objections. No other comments have been recieved. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing an office building. Offices are classified in Code Section 18.42 (Use Classifications) as Professional and Administrative Services. Code Section 18.64.030 allows Professional and Administrative Services as a permitted use in the C -P zoning district. Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C -P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. The subject site contains approximately 22,000 square feet and indicates a width of approximately 100 feet, thereby satisfying the minimum dimensional requirements. Developments within the C -P zone are required to provide a minimum of 15% landscaping. The applicant has not indicated the square footage to be devoted for landscaping. Therefore, calculations for landscaped area shall be submitted for review for compliance with this section. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100. 130 (Buffer Matrix) , there is no front yard setback and no side or rear yard setback except 20 feet shall shall be required where the C -P zone abuts a residential zone. The maximum building height is 45 feet. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone. The building elevation drawings show a height of 25 feet, well under the maximum allowed. Section 18.120.180(A)(1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are chapters 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under section 18.120.180.A.1. These Chapters are therefore found to be inapplicable as approval standards. Code section 18.120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 5 • • • provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Oudoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), 18.120.180.9 (Demarcation of Spaces), and are therefore found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site is currently developed and does not contain natural drainage or existing trees in need of preservation. Buffering, Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This criteria shall be satisfied as addressed in the Buffer Matrix (18.100.130) section below. Section 18.120.108.4(B) states that on -site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. Given the temporary nature of the necessity of buffering between different uses, the plans provide adequate temporary screening of parking and service areas. The buffer requirements are discussed in section 18.100.130 (Buffer Matrix) . Privacy and Noise: Section 18.102.108.5 requires that on -site uses which create noise, lights, or glare shall be buffered from adjoining residential uses. The proposed plan indicates that the adjoining property is intended to be redeveloped, as shown by the joint access drive. Until the property to the north is redeveloped, screening of the adjoining residential use has been provided by a 6 foot fence and a lighting plan which will not create off -site impacts. Crime Prevention and Safety: Section 18.102.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. An exterior lighting plan shall be submitted for review and approval. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 6 • • • feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of Chinese maple and Golden Desert Ash trees to be spaced approximately 25 feet apart, satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision of parking lot trees and screening of the parking lot in accordance with this section. Screening of Refuse Containers and Service Facilities : Section 18.100.110(B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. A revised plan shall be sumbitted which indicates how the trash enclosure will be screened in accordance with this criteria. Buffer Matrix: Section 18.100.130 contains the buffer matrix to be used in calculating widths of buffering and screening to be installed between proposed uses. The Matrix indicates that where a commercial development abuts an adjoining residential structure the required buffer and screening width shall be 20 feet. The site abuts a residential home on the north property line. A 20 foot buffer and screening area shall therefore be required along this property line. The applicant is proposing a 10 foot buffer on the north property line along the length of the building, and a 3 foot buffer along the parking area. This proposed reduction is addressed below. Section 18.100.080.B states that no building, accessway or parking area shall be allowed in a buffer area except where an accessway has been approved by the City. The site plan shows the provision of a joint access driveway with the property to the north. This plan indicates that the property to the north is intended to be redeveloped and will share access with the subject property. While the buffer matrix requires a buffer between an office building and an adjoining single family residence, it appears that these properties are in transition and the existing single family residence to the north is of a temporary nature. Strict compliance with the buffer matrix would create an inefficient use of land as it would require a 20 foot buffer where one will not be required when the future use of the north property will be commercial. Approval of the proposed access NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 7 • • within the buffer is a reasonable decision because of the future plans for development. In the interim, in an effort to provide screening for the single family residence the applicant is providing a temporary 6 foot cedar fence adjacent to the parking area. The plan also shows a 10 foot setback and landscaping for the proposed building. Section 18.100.070(C) states that a detailed buffer area landscaping and screening plan may be substituted for the Director's approval as an alternative to the buffer area landscaping and screening standards, provided it affords the same degree of buffering and screening as required by this code. Given the temporary nature of the need for buffering, the 10 foot setback, proposed landscaping, and temporary fencing would provide an adequate buffer and screen between the adjoining uses. The proposed site plan, as well as the justification of the reduction in buffer standards, relies upon the cooperation and intended development of the property to the north. At this time, the City does not have information or evidence that the property owner to the north is in agreement with the proposed plan and does intend to utilize the proposed shared access. Therefore, the applicant shall submit written approval from the property owner to the north that the proposed driveway location and joint access is acceptable. A joint use and maintenance agreement shall be provided for the proposed driveway. In the event that the northern property owner does not intend to utilize this proposed site plan, the applicant shall revise the preliminary plans so as to not encumber the property to the north and shall comply with the buffer requirements. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right -of -way and then connecting these two 30 foot distance points with a straight line. The proposed plan does not comply with this requirement as the building is with the clearance area at the SW Hampton Street and SW 70th Avenue intersection. A revised site plan shall be submitted which indicates compliance with this section. Minimum Off - Street Parking: Section 18.106.030(C)(1) requires a minimum of one parking space for every 350 square feet of gross floor area. The total number of required parking spaces for a 10,000 square foot office is 28 spaces. The applicant is proposing to provide 30 parking spaces, thereby satisfying this requirement. NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 8 • • The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 2 disabled parking spaces if 26 to 50 parking spaces are provided. The proposed site plan shows the provision of 2 disabled person parking spaces, thereby satisfying this requirement. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The site plan does not indicate the location of bicycle racks. A revised site plan shall be submitted which provides for 2 bicycle spaces. Access: Section 18.108.080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet. Curbs are required as well. The plan shows the provision of one access drive with a width of 30 feet, including curbs. The proposed plan indicates that a shared driveway will be provided with the property to the north. The applicant shall be required to obtain an access easement from the adjoining property to the north. The preliminary plan shows that the circulation of the parking area provides for a one -way drive width of 14' 2 ", whereas the Code requires a width of 15 feet. A revised plan shall be submitted which provides for a 15 foot one -way drive width. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs and obtructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. This criteria is satisfied as a walkway has been provided from the entrance to SW Hampton Street and has been extended to the north property line to connect with future development. Transportation Planning Rule. OAR 660- 12- 045(4)(b). This section states that new retail, office and institutional buildings at or near existing or planned transit stops to provide preferential access to transit. The intent of this requirement is to provide preferential access to transit by locating building entrances at a direct, safe, and convenient distance from the transit street and by removing other barriers to pedestrian access. The proposed site plan shows the provision of a direct walkway connection from the building entrance to the bus stop located on SW Hampton Street. This connection would place the entrance of the building approximately 50 feet from the bus stop. In addition, the site plan provides for a walkway connection to the property to the north which would allow the provision of a direct NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 9 • • connection from the bus stop to future development on that parcel. Signs: Section 18.114.130 (D) lists the type of allowable signs and sign area permitted in the C -P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on -site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick- up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign -off. The applicant shall submit evidence or a plan which indicates compliance with this section. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The site plan proposes a joint use driveway onto SW 69th Avenue that would serve this property and the property contiguous to the north. SW 69th Avenue is a local street which was previously improved on the easterly side of the street. The applicant should be required to construct the remaining one -half street to City standards. SW Hampton Street is a Major Collector as shown on the City Comprehensive Plan and SW 70th Avenue is an unimproved local street. The existing improvements along SW Hampton Street have been constructed to City standards and conform to the requirements for Major Collector streets. No additional street construction along SW Hampton Street will be necessary with the exception that the overhead utilities should be placed underground. With respect to SW 70th Avenue, the applicant does not propose access to this existing street and no improvements are proposed. This site is located within the Tigard Triangle area which is under current planning review by the City Council. The status of SW 70th Avenue has yet to be determined. Under Section 18.164.030(A)1 -c.vi, the Director may accept a "future guarantee in lieu of street improvements" based on the criteria that "additional planning work is required to define the appropriate design standards" for the street. The applicant should be required to sign an agreement of non - remonstrance to NOTICE OF DECISION SDR 94 - 0027 KOLBERG PAGE 10 III . the formation of a future Local Improvement District for the development of the street improvements for SW 70th Avenue. 2. SANITARY SEWER: The site currently has 8 inch public sanitary sewer lines located in the SW 69th Avenue. The main line has sufficient capacity for this development and no additional public sewer improvements are required. 3. STORM SEWER: The site currently drains toward SW 70th Avenue. An underground storm drain system has been constructed to the intersection of SW 70th Avenue in SW Hampton Street. The site drainage should be designed to connect to this system and may require an extension of the system in SW 70th Avenue. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in -lieu be required. SECTION V. PROCEDURE 1. The site is adjacent to north side of SW Hampton Street, between SW 70th Avenue and SW 69th Avenue. Findings: 1. STREETS: The site plan proposes a joint use driveway onto SW 69th Avenue that would serve this property and the property contiguous to the north. SW 69th Avenue is a local street which was previously improved on the easterly side of the street. The applicant should be required to construct the remaining one -half street to City standards. SW Hampton Street is a Major Collector as shown on the City Comprehensive Plan and SW 70th Avenue is an unimproved local street. The existing improvements along SW Hampton Street have been constructed to City standards and conform to the requirements for Major Collector streets. No additional street construction along SW Hampton Street will be necessary with the exception that the overhead utilities should be placed underground. With respect to SW 70th Avenue, the applicant does not propose access to this existing street and no improvements are proposed. This site is located within the Tigard Triangle area which is under current planning review by the City Council. The status of SW 70th Avenue has yet to be determined. Under Section 18.164.030(A)1 -c.vi, the Director may accept a "future guarantee in lieu of street improvements" based on the criteria that "additional planning work is required to define the appropriate design standards" for the street. The applicant should be required to sign an agreement of non - remonstrance to the formation of a future Local Improvement District for the development of the street improvements for SW 70th Avenue. 2. SANITARY SEWER: The site currently has 8 inch public sanitary sewer lines located in the SW 69th Avenue. The main line has sufficient capacity for this development and no additional public sewer improvements are required. ENGINEERING COMMENTS SDR 94 -27 KOLBERG PAGE 1 . 411 3. STORM SEWER: The site currently drains toward SW 70th Avenue. An underground storm drain system has been constructed to the intersection of SW 70th Avenue in SW Hampton Street. The site drainage should be designed to connect to this system and may require an extension of the system in SW 70th Avenue. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 - 47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. Recommendations: THE FOLLOWING CONDITION(S) SHOULD BE REOUIRED PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: 1. Standard half - street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, streetlights, and underground utilities shall be installed along the SW 69th Avenue frontage. Improvements shall be designed and constructed to local street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. The applicant shall connect to the underground storm drain system in SW 70th Avenue in an alignment approved by the Engineering Department. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right -of -way. The second part is paid at Building Permit issuance which is for each individual lot. 7. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 70th Avenue. The site is served by transit along Hampton Street with 15- minute and better transit frequency throughout the day, and half-hourly evening service. Because of the proximity of the proposed office building to transit, shopping and homes, it is critical that the building respond to existing and future pedestrian activity in the vicinity. The following comments respond to the requirements from the Transportation Planning Rule that new developments must orient to existing transit stops and that they provide safe and convenient pedestrian linkages to nearby destinations such as shopping centers and residential areas. We recommend the following changes to the plan to strengthen the pedestrian linkages: 1) The plans should include frontage improvements to accommodate pedestrians including a new sidewalk along 70th Avenue and a landscaping buffer between the sidewalk and the street as illustrated on the attached plan. 2) Relocate the ramp from the midblock location to the corners as shown on the attached plan. 3) It does not appear that the existing ramp and bus stop meet ADA standards.
