SDR1994-00020 CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 94 -0020 SABRE / CIRCLE AW APPLICATION: The applicant requests Site Development Review approval to allow an approximately 30,120 square foot expansion to an existing building to be used for manufacturing and a new 3,770 square foot office building. Zone: I -H (Heavy Industrial). Location: 13885 and 13905 SW 72nd Avenue (WCTM 2S1 01DC, tax lots 1000 and 1100). Southwest corner of SW 72nd Avenue and SW Tech Center Drive. SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MICHAEL ANDERSON OF THE ENGINEERING DEPARTMENT. 1. The applicant shall submit a revised final site, drainage, and grading plan for the review and approval of the Engineering Department. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. The applicant shall construct a 6 foot wide sidewalk along the SW 72nd Avenue frontage with a minimum 2 foot wide bench adjacent to the property line, and obtain a street opening permit for the construction. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right -of -way. The applicant shall include a detail of the sewer connection as a part of the development plan that shall be submitted for approval by both the Engineering and Maintenance Services Departments. Washington County has established and the City has agreed to collect Traffic Impact Fees in accordance with Resolution No. 94 -18. The applicant shall pay the fee established for the proposed use. 7. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: Will D'Andrea. The revised plans shall include the following: a. 5 disabled parking spaces. b. 8 bicycle parking spaces c. Access drive with 40 feet of pavement width. 8. A tree removal permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCE PERMITS: 9. All site improvements shall be installed as per the approved revised site plans. 10. No parking signs shall be installed along the access roadway leading from SW Tech Center Drive to the north side of the existing building. Signs shall be placed at the ends of parking stall grids, located in the large parking lot, and elsewhere, as determined by field inspector or deputy fire marshal at the end of the project. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Backround: The site has received a Site Development Review (SDR 20 -73) approval in 1973 and a Lot Line Adjustment (M 16 -85) in 1985. No other land use applications have been filed with the City of Tigard. 2. Vicinity Information: The site is located west of SW 72nd Avenue on the south side of SW Tech Center Drive. The property is zoned I -H (Heavy Industrial). Properties to the north are zoned I -P (Industrial Park). Adjacent properties to the east, west, and south are zoned I -H. The adjacent property to the east contains a single family residence. The surrounding properties are developed with industrial, commercial and residential buildings. 3. Site Information and Proposal Description: The site has frontage on SW Tech Center Drive. The site is developed with a 76,000 square foot manufacturing building, accessory building and parking lot. The applicant requests approval to allow a 30,120 square foot expansion to the existing industrial building and construct a new 3,770 square foot office building. The applicant proposes to use the existing access drive onto SW Tech Center Drive. 4. Other Staff Comments: The City of Tigard Engineering Department's findings are addressed in Section III (B). The City of Tigard Maintenance Services Division has reviewed this proposal and has offered the following comments: All storm lines should be privately maintained. The City of Tigard Water Department has reviewed this proposal and has offered the following comments: A new double check valve (backflow preventer) assembly is required on the fire sprinkler line. This upgrade is to include a new vault with Bilco doors, and new sump pump or NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 3 daylight drain. Also a double check valve assembly will need to be installed behind (customer side) of domestic water meter. All improvements are the responsibility of owner and will need to be completed in order to receive water service after construction is complete. 5. Agency Comments: The Tualatin Valley Fire District has reviewed this proposal and has offered the following comments: 1) The district would ask that the new small office building be addressed off SW Tech Center Drive as access to that building is from SW Tech Center and not SW 72nd; 2) Existing manufacturing plant to be added onto will exceed allowable fire flow. If not already provided with automatic sprinkler protection will be required throughout the structure, including new additions to meet fire flow requirements; 3) No parking signs shall be installed along the access roadway leading from SW Tech Center Drive to the north side of the existing building. Signs shall be placed at the ends of parking stall grids, located in the large parking lot, and elsewhere, as determined by field inspector or deputy fire marshal at the end of the project. General Telephone and Electronics has reviewed this proposal and has offered the following comments: The applicant to place conduit for telephone service to GTE's specifications. The City of Tigard Building Division, Portland General Electric, has reviewed this application and have offered no comments or objections. No other comments have been recieved. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing an expansion for manufacturing space. Manufacturing use is classified in Code Section 18.42 (Use Classifications) as Manufacturing of Products. Code Section 18.72.030(A)(3) (A) allows Manufacturing of Products as a permitted use in the I -H zoning district. Minimum Lot Area: Section 18.72.050 states that there is no minimum lot area for parcels in the I -H zoning district. The site has an average lot width of approximately 580 feet, NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 4 • • thereby exceeding the required 50 foot average minimum lot width. Developments within the I -H zone are required to provide a minimum of 15% landscaping. The applicant is providing approximately 56,733 square feet or 25% of the site for landscaping. Setbacks: Section 18.72.050 states that the front yard setback is 30 feet. There are no side or rear yard setbacks except where the I -H zone abuts a residential district. This site does not abut a residential zone, therefore there are no side or rear yard setback requirements. As indicated on the site plan, the front yard setback is satisfied. The maximum building height is 45 feet. The applicant is proposing both buildings under 28 feet, well under the maximum allowed. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The site plan indicates the provision of 7 red maple trees spaced approximately 25 feet apart, thereby satisfying this criteria. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The site plan provides for trees in a manner which provides the required canopy effect and screening of the parking lot from the adjoining property, thereby satisfying this requirement. Buffer Matrix: Section 18.100.130 contains the buffer matrix to be used in calculating widths of buffering and screening NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 5 . . to be installed between proposed uses. The Matrix indicates that where an industrial development abuts a residential use the required buffer and screening width shall be 30 feet. Section 18.100.070(C) states that a detailed buffer area landscaping and screening plan may be substituted for the Director's approval as an alternative to the buffer area landscaping and screening standards, provided it affords the same degree of buffering and screening as required by this code. The applicant is proposing a 23 foot buffer along the east property line. The minimum improvement within a buffer area would provide for a row of large trees to be spaced no greater than 30 feet apart, to be planted with an initial height of 5 feet. The proposed plan provides a mix of pines, firs, and other evergreens, planted on the average of 15 - 25 feet apart. The proposed alternative landscape plan would provide screening in accordance with the intent of this chapter. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right -of -way and the driveway and then connecting these two 30 foot distance points with a straight line. The site plan shows landscaping within the vision clearance area. The applicant shall maintain a vision clearance between 3' and 8' in height within this area. Minimum Off Street Parking: Section 18.106.030(D) (1) requires a minimum of one parking space per employee of the largest shift for manufacturing. The office requires one space per 350 square feet of gross floor area. The applicant states that the number of employees of the largest shift shall be 100, requiring 100 parking spaces. The office requires an additional 10 spaces. The total required parking shall be 110 spaces. The site plan shows the provision of 122 parking spaces, thereby satisfying this requirement. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 5 disabled parking spaces if 101 to 150 parking spaces are provided. This NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 6 . . proposed site plan shows the provision of 2 disabled person parking spaces. A revised site plan shall be submitted which provides for 5 disabled parking spaces in accordance with ADA standards. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Eight bicycle parking spaces will be required for this development. A revised site plan shall be submitted which shows the provision of 8 bicycle parking spaces. Access: Section 18.108.080 requires that commercial and industrial uses which requires more than 100 parking spaces provide one access with a minimum width of 50 feet and a minimum pavement width of 40 feet or two access with a minimum pavement width of 24 feet. The preliminary site plan shows the provision of one access onto SW Tech Center Drive, with a minimum pavement width that varies between 37 and 40 feet. A revised site plan shall be submitted which provides for 40 feet of pavement for the access drive. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. The site plan shows the provision of a sidewalk connection to SW Tech Center Drive, thereby satisfying this criteria. Tree Removal: Section 18.150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The proposed development will take access from SW Tech Center Drive at the existing driveway on the southerly side of the street. The site is contiguous to SW 72nd Avenue which is classified as a Major Collector on the .Comprehensive Plan. SW Tech Center Drive is classified as a Minor Collector. NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 7 • SW Tech Center Drive is constructed to local commercial standards with a pavement width of 34 feet on a right -of -way of 50 feet. SW 72nd Avenue is constructed to collector standards with a pavement width of 40 feet on a variable right -of -way, with a minimum of 60 feet. The sidewalk has not been constructed on SW 72nd Avenue and the applicant should be required to construct sidewalk along this frontage. The final grading plan should be submitted to the Engineering Department for approval. The grading plan should be modified to provide a two foot bench from the back of the sidewalk to provide a margin of safety for pedestrians. In addition, there are no overhead facilities adjacent to the site and the street lighting has been installed. 2. SANITARY SEWER: The site is served by the existing 8" public sanitary sewer line in SW Tech Center Drive. The preliminary utility plan shows a private pressure sewer from the new building area on the westerly side of the existing building connecting to a new service line that joins the main at the existing manhole. The final plans should detail the change from the pressurized system to the gravity system and a cleanout should be provided at a location that is a minimum of 5 feet onto the private property. The existing sewer main line has sufficient capacity for this development. 3. STORM SEWER: The site slopes in a southwesterly direction into an existing private underground system that drains off -site along a private storm drain easement to an existing ditch parallel to the railroad, approximately 400 feet westerly of the site. The preliminary utility plan shows the construction of a new private underground system that parallels the existing that will provide additional capacity due to the increase of impervious area. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10 of the R & 0 No. 91 -47 permits the acceptance of a fee in -lieu of improvements if "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the NOTICE OF DECISION SDR 94 - 0020 SABRE /CIRCLE AW PAGE 8 effective development ". The location of the existing building at the low point of the site does not allow for an efficient design of a water quality facility, and the additional impervious area is small in comparison to the existing improvements. Therefore, an on -site facility does not appear to be feasible and the applicant should be permitted to pay a fee in -lieu of construction a water quality facility. The final drainage plan shall be submitted to the Engineering Department. The applicant shall provide copies of the off -site drainage easement for the record file. The outlet of the new pipe shall be designed to prevent downstream erosion by the addition of an outlet structure and /or rip -rap energy dissapator. SECTION V. PROCEDURE 1. Public suppo • MEMORANDUM CITY OF TIGARD, OREGON TO: Will D'Andrea August 24, 1994 FROM: Michael Anderson, Development Review Engineer RE: SDR 94 -0020 SABRE /CIRCLE AW Description: The applicant requests Site Development Review and approval to construct two additions to the existing industrial buildings on a 5.28 acre site located at the southwest intersection of SW 72nd Avenue and SW Tech Center Drive. Findings: 1. STREETS: The proposed development will take access from SW Tech Center Drive at the existing driveway on the southerly side of the street. The site is contiguous to SW 72nd Avenue which is classified as a Major Collector on the Comprehensive Plan. SW Tech Center Drive is classified as a Minor Collector. SW Tech Center Drive is constructed to local commercial standards with a pavement width of 34 feet on a right -of -way of 50 feet. SW 72nd Avenue is constructed to collector standards with a pavement width of 40 feet on a variable right -of -way, with a minimum of 60 feet. The sidewalk has not been constructed on SW 72nd Avenue and the applicant should be required to construct sidewalk along this frontage. The final grading plan should be submitted to the Engineering Department for approval. The grading plan should be modified to provide a two foot bench from the back of the sidewalk to provide a margin of safety for pedestrians. In addition, there are no overhead facilities adjacent to the site and the street lighting has been installed. 2. SANITARY SEWER: The site is served by the existing 8" public sanitary sewer line in SW Tech Center Drive. The preliminary utility plan shows a private pressure sewer from the new building area on the westerly side of the existing building connecting to a new service line that joins the main at the existing manhole. The final plans should detail the change from the pressurized system to the gravity system and a cleanout should be provided at a location that is a minimum of 5 feet onto the private property. The existing sewer main line has sufficient capacity for this development. ENGINEERING COMMENTS SDR 94 -0020 SABRE /CIRCLE AW PAGE 1 3. STORM SEWER: The site slopes in a southwesterly direction into an existing private underground system that drains off -site along a private storm drain easement to an existing ditch parallel to the railroad, approximately 400 feet westerly of the site. The preliminary utility plan shows the construction of a new private underground system that parallels the existing that will provide additional capacity due to the increase of impervious area. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10 of the R & 0 No. 91 -47 permits the acceptance of a fee in -lieu of improvements if "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development ". The location of the existing building at the low point of the site does not allow for an efficient design of a water quality facility, and the additional impervious area is small in comparison to the existing improvements. Therefore, an on- site facility does not appear to be feasible and the applicant should be permitted to pay a fee in -lieu of construction a water quality facility. The final drainage plan shall be submitted to the Engineering Department. The applicant shall provide copies of the off -site drainage easement for the record file. The outlet of the new pipe shall be designed to prevent downstream erosion by the addition of an outlet structure and /or rip -rap energy dissapator. Recommendations: PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1. The applicant shall submit a revised final site, drainage, and grading plan for the review and approval of the Engineering Department. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. The applicant shall construct a 6 foot wide sidewalk along the SW 72nd Avenue frontage with a minimum 2 foot wide bench adjacent to the property line, and obtain a street opening permit for the construction. STAFF CONTACT: John Hagman, Engineering Department (639 -4171) 4. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right -of -way.
