411 411 Y CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 94 -0010 LOUIE - OWNER / APPLICANT APPLICATION: The applicant requests for Site Development Review approval to allow the conversion of an existing single family residence to a commercial photographic portrait studio. Zoning: C -P (Professional Commercial). Location: 12395 SW 68th Avenue (WCTM 2S1 01AA, tax lot 4500). SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MICHAEL ANDERSON OF THE ENGINEERING DEPARTMENT. 1. Standard half - street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, and storm drainage shall be installed along the SW Franklin Street frontage. Improvements shall be designed and constructed to 2/3 street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. STAFF CONTACT: Michael Anderson, Engineering Department (639- 4171). 2. The applicant shall remove the existing driveway onto SW 68th Parkway, re- construct the curb and construct sidewalk along the frontage of SW 68th Parkway. 3. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the . • development which increases the impervious area within the public right -of -way. The second part is paid at Building Permit issuance which is for each individual lot. 5. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: Will D'Andrea. The revised plans shall include the following: a. Landscaping / impervious surface calculations. The minimum landscape requirement is 150. b. The number, location and type of landscape material and street trees. Landscape plan which provides screening of the parking lot. An additional street tree shall be planted along the SW Franklin Street frontage. c. An 8 foot access aisle width as part of the disabled parking space, in accordance with ADA requirements. d. Relocation of the bicycle parking space. e. A 24 foot driveway access width. f. Compliance with the vision clearance criteria. g. Tree removal permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE LIST 1. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS. Section 18.164.180 Notice to City Required Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THE FOLLOWING SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 6. All site improvements shall be installed as per the revised approved site plan. 7. Fire hydrant is required within 250 feet of all portions of the structure. Hydrants shall be shown on a site plan for review and approval. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Backround: The subject site is presently developed with a single family residence. No other land use or development applications have been reviewed by the City of Tigard. 2. Vicinity Information: The subject site is located east of SW 68th Avenue, west of SW 69th Avenue, south of SW Elmhurst Street and north of SW Franklin Street. The surrounding properties are zoned C -P (Professional Commercial) and are generally developed with commercial uses. The adjacent properties are vacant. 3. Site Information and Proposal Description: The subject site is approximately 7,500 square feet in size. The site contains a single family residence with access onto SW 68th Avenue. The applicant is proposing to convert the residence into a photographic portrait studio with related improvements. Access will be onto SW Franklin Street. 4. Other Staff Comments: The City of Tigard Building Division has reviewed this proposal and has offered the following comments: 1) Remove curb next to ADA parking space and provide an 8' wide access aisle; 2) North wall to be 1 -hour fire rated with a parapet per the building code, all openings to be protected by a 3/4 hour rated fire assembly; 3) Landings at ramp to be 60" X 60" minimum; 4)The second floor will require two exits minimum, the north exterior stairway is prohibited due to specific building code requirements; 5) Raindrains and impervious water to drain to an approved system. 5. Agency Comments: The Tualatin Valley Fire District has reviewed this proposal and has offered the following comments: 1) Fire fighting access is acceptable; 2) fire hydrant is required within 250 feet of all portions of the structure. Hydrants shall be shown on a site plan for review and approval. The Tualatin Valley Water Department has reviewed this proposal and has offered the following comments: Customer will need to provide district approved backflow protection. Contact: Floyd Hansley (642 - 1511). The City of Tigard Police Department, City of Tigard Maintenance Services Department, General Telephone and Electronics, Portland General Electric has reviewed this application and have offered no comments or objections. No other comments have been recieved. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing a conversion to a photography studio. Photography studios are classified in Code Section 18.42 (Use Classifications) as Personal Service Facilities. Code Section 18.64.030 allows Personal Service Facilities as a permitted use in the C -P zoning district. Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C -P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. The subject site contains approximately 7,500 square feet and indicates a width of approximately 75 feet, thereby satisfying the minimum dimensional requirements . Developments within the C -P zone are required to provide a minimum of 15% landscaping. The applicant has not indicated the square footage to be devoted for landscaping. Therefore', calculations for landscaped area shall be submitted for review for compliance with this section. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100.130, there is no front yard setback and no side or rear yard setbacks except 20 feet shall shall be required where the C -P zone abuts a residential zone. The maximum building height is 45 feet. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone. The 28 foot structure is well under the height requirement. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement will be satisfied as the applicant will be required to submit a plan indicating the number, type and location of trees and shrubs. NOTICE OF DECISION SDR 94 - 0010 Louie Photography PAGE 4 III • Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The applicant shall revise the landscape plan to indicate the type of street trees to be planted and to provide an additional tree along the SW Franklin Avenue frontage. Screening: Special Provisions: Section 18.100.110(A) (Screening of Parking and Loading Areas) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed'on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. As indicated on the site plan, trees are located adjacent to the parking area satisfying this criteria. A revised plan shall be submitted which indicates the type and form of landscaping which screens the parking lot. Minimum Off - Street Parking: Section 18.106.030(C) (24) requires a minimum of one parking space for every 500 square feet of personal service facility gross floor area. The 2,976 square foot studio requires 6 parking spaces. The applicant is proposing to provide 6 parking spaces, thereby satisfying this requirement. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 1 disabled parking space if 1 to 25 parking spaces are provided. The proposed site plan shows the provision of 1 disabled person parking space with a 9 foot width. The requirement states that this space be served by an access aisle 8 feet wide minimum and shall be designated "van accessible." A revised site plan shall be submitted which provides for an 8 foot wide access aisle. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for every 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. One bicycle parking space will be required for this development. The preliminary site plan shows the provision of a bicycle rack. However, the proposed location is in NOTICE OF DECISION SDR 94 - 0010 Louie Photography PAGE 5 + • • conflict with the required accessible parking requirements. A revised site plan shall be submitted which shows the relocation of the bicycle rack. Access: Section 18.108.080 requires that commercial uses which requires less than 100 parking spaces provide one access with a minimum width of 30 feet and a minimum pavement width of 24 feet. The site plan shows an access width of 18 feet. The applicant shall submit a revised site plan which provides for a 24 foot access width, in accordance with this section. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street. The preliminary site plan indicates a walkway connection to SW 68th Avenue, thereby satisfying this requirement. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right -of -way and the driveway and then connecting these two 30 foot distance points with a straight line. A revised site plan shall be submited which shows that this requirement will be satisfied. Tree Removal: Section 18.150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. Signs: Section 18.114.130 (D) lists the type of allowable signs and sign area permitted in the C -P zone. All signs shall be approved through the Sign Permit process as administered by the Planning Division. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030 (E) (1) (a) (Streets) , 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: NOTICE OF DECISION SDR 94 - 0010 Louie Photography PAGE 6 I • • 1. STREETS: The site presently fronts onto SW 68th Parkway which is classified as a Major Collector street on the Comprehensive Plan, and is located within the Tigard Triangle planning area. The existing right -of -way is 30 feet from center line and no further dedications are required. SW 68th Parkway has been improved with curbs and pavement. The applicant should be required to construct sidewalk along this frontage. The proposed site plan shows the construction of a new driveway on SW Franklin Street to provide access to the parking lot. SW Franklin Street is a local street with a right -of -way of 30 feet from center line. The street has been paved with gravel roadway of an un- determined thickness. The applicant shall be required to improve SW Franklin Street to City standards, with an additional twelve foot lane on the opposite side, to provide for a 2/3 street, suitable for fire access. In addition, the applicant should be required to remove the old driveway onto SW 68th Parkway and the curb restored to standard condition. Overhead utilities are existing on the southerly side of SW Franklin Street and the poles are being utilized for the street lighting system. No additional street lighting is required for SW Franklin Street. 2. SANITARY SEWER: The site is currently served by the 8 inch public sanitary sewer line that is located in SW 68th Parkway and no changes are proposed. The existing sewer has sufficient capacity for this project. 3. STORM SEWER: The site slopes in a southwesterly direction towards SW Franklin Street and drains to the existing roadway ditch. With the street construction, the existing culvert crossing SW 68th Parkway will be extended to the west and drain into the existing ditch in SW Franklin Street. The on -site drainage should connect to the new storm drain. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may NOTICE OF DECISION SDR 94 - 0010 Louie Photography PAGE 7 • • be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in -lieu be required. SECTION V. PROCEDURE 1. At the discretion of the City, the applicant may be offered an opportunity to pay a fee in lieu of the construction of such a facility. The resolution requires the construction of a water quality facility and /or the payment of a fee. Total Requirement n,n • 177914 - Publish June 9, 1994 - • • I MEMORANDUM CITY OF TIGARD, OREGON TO: Mark Roberts May 23, 1994 FROM: Michael Anderson, Development Review Engineer RE: SDR 94 -0010 LOUIE Description: The applicant requests Site Development Review approval to convert a single family residence for use as a commercial photographic portrait studio at a site located at the northwest corner of SW 68th Parkway and SW Franklin Street. Findings: 1. STREETS: The site presently fronts onto SW 68th Parkway which is classified as a Major Collector street on the Comprehensive Plan, and is located within the Tigard Triangle planning area. The existing right -of -way is 30 feet from center line and no further dedications are required. SW 68th Parkway has been improved with curbs and pavement. The applicant should be required to construct sidewalk along this frontage. The proposed site plan shows the construction of a new driveway on SW Franklin Street to provide access to the parking lot. SW Franklin Street is a local street with a right -of -way of 30 feet from center line. The street has been paved with gravel roadway of an un- determined thickness. The applicant shall be required to improve SW Franklin Street to City standards, with an additional twelve foot lane on the opposite side, to provide for a 2/3 street, suitable for fire access. In addition, the applicant should be required to remove the old driveway onto SW 68th Parkway and the curb restored to standard condition. Overhead utilities are existing on the southerly side of SW Franklin Street and the poles are being utilized for the street lighting system. No additional street lighting is required for SW Franklin Street. 2. SANITARY SEWER: The site is currently served by the 8 inch public sanitary sewer line that is located in SW 68th Parkway and no changes are proposed. The existing sewer has sufficient capacity for this project. ENGINEERING COMMENTS SDR 94 -10 LOUIE PAGE 1 4 • 3. STORM SEWER: The site slopes in a southwesterly direction towards SW Franklin Street and drains to the existing roadway ditch. With the street construction, the existing culvert crossing SW 68th Parkway will be extended to the west and drain into the existing ditch in SW Franklin Street. The on -site drainage should connect to the new storm drain. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. Recommendations: PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1. Standard half - street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, and storm drainage shall be installed along the SW Franklin Street frontage. Improvements shall be designed and constructed to 2/3 street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. The applicant shall remove the existing driveway onto SW 68th Parkway, re- construct the curb and construct sidewalk along the frontage of SW 68th Parkway. 3. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. NOTE: This is a two part fee which is paid at different times.
