The findings and conclusions on which the decision is based are noted in Sections II and III. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. Background The subject property was annexed into the City of Tigard on March 30, 1981 (BC 1667). This site was recently approved for site improvements (SDR 92 -0006) to enable this location to be used as a motorcycle and lawn equipment sales and service business. This property was previously occupied by Power Rents. Another site development review (SDR 92 -0013) was approved for this site in 1992 to allow addition of a warehouse space. No other land use applications for this site have been reviewed by the City. 2. Vicinity Information The subject site is generally triangular in shape and abuts the State of Oregon Highway 217 right -of -way on its east side. The western portion of the site abuts SW Cascade Boulevard which functions as a frontage road to Highway 217. The south side abuts the site of Designer's Choice Furniture and the Office Club. The site is surrounded on all sides by property which is zoned I -P. 3. Site Information and Proposal Description The subject parcel is approximately 2.19 acres in size and is developed with a 20,931 square foot building. The front entrance to both the building and the parking area are oriented to SW Cascade Boulevard. The parking lot provides a total of 35 vehicle parking spaces (with one of those spaces being designated as a disabled person parking space). Access to the property is provided by two driveways, one 40 foot wide and one 30 foot wide, both accessing onto SW Cascade Boulevard. The two driveways are separated by approximately 200 feet of street frontage. The applicant requests Site Development Review approval for a Major Modification to an existing 20,931 square foot building. The proposed modification is for an approximately 12,000 square foot showroom and warehouse space addition to the south side of the existing building. 4. Other Staff Comments: The City of Tigard Public Works Department has reviewed this proposal and has offered the following comments: NOTICE OF DECISION - SDR 94 -0005 - LANPHERE /BEAVERTON HONDA PAGE 2 • • Landscape plan looks good. Good choice of materials for screening inside perimeter. Area along highway 217 could be sensitive to that environment, but okay with irrigation. The City of Tigard's Building Division and Tigard Police Department and the have reviewed this application and have offered no comments or objections. 5. Agency Comments: The Tualatin Valley Water District has reviewed this proposal and has offered the following comments: The existing irrigation system will be water efficient. Although drip irrigation will be best suited for the landscaping. The Tualatin Fire & Rescue District #1, General Telephone and Electronics, Portland General Electric, Northwest Natural Gas and Metro Area Communication have reviewed this application and have offered no comments or objections. SECTION III. ANALYSIS AND CONCLUSION Section 18.120.070 lists the criteria for a major modification to an approved site development plan. This application is classified as a major modification because: 1) the change requires additional on -site parking in accordance with Chapter 18.106 (Parking Standards); and 2) an increase in the floor area for non- residential use is proposed which is more than 10% of the existing floor area and is also over 5,000 square feet. Section 18.68.050(M(4) (Dimensional Requirements) of the Code allows a maximum building height of 45 feet in the I -P zone. The proposed structure is less than 45 feet in height and its height will not be increased by the internal modifications. Therefore, this code section is satisfied. The front yard setback shall be a minimum of 35 feet. There are no other setbacks which are applicable to this site. The proposed building is more than 35 feet from the front property line of this site. Therefore, this site plan complies with all applicable setback requirements. NOTICE OF DECISION - SDR 94 -0005 • LANPHERE /BEAVERTON HONDA PAGE 3 The applicant has indicated that the building will be used as additional covered showroom and warehouse space for the already approved motorcycle and power equipment use. This use is permitted in the I -P zoning district and will be used as additional space for the primary use on the site. Section 18.106.030(C)(7)(g) requires that uses classified as Automotive and Equipment Sales /Rental - Light Equipment need to provide a minimum of 1 parking space for every 1,000 square feet of gross floor area; but not less than four spaces for each establishment. The existing building is 20,931 square feet and the requested addition is approximately 12,000 square feet in size. Therefore, this total square footage (32,931 square feet) requires the provision of a minimum of 33 vehicular parking spaces on this site. The approved site plan (SDR 92 -0006 and SDR 92- 0013), and the proposed site plan shows that there will be 35 parking spaces provided. A total of 33 parking spaces is required for this site. Therefore, this requirement has been satisfied. The Americans with Disabilities Act (ADA), which became effective January 26, 1992, requires one disabled person parking spaces if 25 or fewer parking spaces are provided, and two such spaces if 26 to 50 parking spaces are provided. A total of two disabled person parking space is required foot this site. The proposed site plan show provision of one (1) disabled person parking space. Therefore, a revised site plan shall be submitted that show provision of two (2) disabled person parking spaces. Code Section 18.106.020(P) requires one bicycle parking space for each 15 vehicular parking spaces in any development. This plan will need to provide a minimum of two bicycle parking rack spaces on -site as required in the approval SDR 92 -0006. The proposed site plan only show provision for one (1) bicycle parking rack space. Therefore, a revised site plan shall be requested for to show provision of the additional bicycle rack space. The site meets the minimum access standards through the provision of one 30 foot wide driveway and one 40 foot wide driveway; both of which provide access to the site from SW Cascade Boulevard. Code Section 18.108!080(A) requires that commercial use parking areas with less than 100 parking spaces be provided with one access drive with a minimum access width of 30 feet. The accessway must be paved to a minimum width of 24 feet. These provisions have been satisfied through SDR 92 -0006, therefore, this code section has been satisfied. Code Section 18.100.110 (Screening: Special Provisions) and Section 18.100.035 (Location of Street Trees) have been addressed through the previous approval SDR 92 -0006. All applicable requirements have either been satisfied or have been sufficiently conditioned. NOTICE OF DECISION - SDR 94 -0005 - LANPHERE /BEAVERTON HONDA PAGE 4 • • Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporate functional and adequate space for on -site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick -up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign -off. The applicant will need to submit evidence or a plan which indicates compliance with this section. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The site is located on SW Cascade Boulevard which is shown as a Major Collector street on the City Comprehensive Plan. The existing right -of -way is 30 feet from centerline and the street improvements have been constructed to the collector street standards. No additional improvements are required. 2. SANITARY SEWER: The site is served by the existing 12" sanitary sewer in SW Cascade Boulevard, which has sufficient capacity for the proposed addition. 3. STORM SEWER: The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. However,the building addition is located within an area that is presently paved and no additional facilities or fees are applicable. The existing parking lot currently drains to an underground system in SW Cascade Boulevard which has sufficient capacity for the new construction. The outline description, as we have discussed, is a two story structure with an all glass front. Both floors are exposed concrete slab, with structural steel columns and beams. All areas are open to the public, requiring an elevator. The entire area is sprinklered, heated and air conditioned. Lighting will be two tube fluorescent hung from the structure. We feel that everything for construction is estimated, and done so with a conservative slant to it. We won't have a hard bid number until the drawings are complete. We have also included all the costs for civil, structural, mechanical, electrical and architectural design and engineering. I suggest you budget $4,000 for permits and $18,550 for traffic impact fees after our discussion with the City of Tigard today. (I think the TIP charge can be reduced substantially by doing a traffic study.)
