Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the extension of the public sanitary sewer line and other related work in the public right -of -way. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. This permit shall be obtained by the applicant prior to approval of the final plat. 2. Any necessary off -site utility easements shall be the responsibility of the applicant to obtain and shall be submitted to, and accepted by, the City prior to issuance of a street opening permit. The specific easements needed for this project are: 1) private access easement over Tax Lot 4600 (NOTE: this easement must show that access rights also pertain to any newly created lot from the subject property), 2) public sanitary sewer and access easement from Tax Lot 4600, and 3) private storm drainage easement from Tax Lot 4600. 3. Prior to approval of the final plat, an agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 129th Avenue. 4. Final Plat Application Submission Requirements: A. Three mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. 5. In order for this property to have fire protection the existing barricade between SW 129th Avenue and the private street must either be removed or a new fire hydrant will need to be installed at the intersection of SW 129th Avenue and SW Walnut. EFFECTIVE; DATE;:OF:: THIS DECISION SECTION III: BACKGROUND INFORMATION Site History: The City has no record of other land use applications having been filed for this property. The site is presently undeveloped. Vicinity Information: The adjoining properties are subdivided and developed with detached single - family residences. • Site Information and Proposal Description: The property is presently undeveloped. No significant natural features or landforms were noted. The property is level with a slight slope towards the existing private street that serves this development. The applicant has proposed to partition one existing lot into two, a variance has also been requested to exceed the two and a half to one, maximum lot depth to width ratio. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Variance - Approval Standards: Section 18.134.050 requires that the following findings be made in order to approve a variance. The applicant has requested a variance to the two and one half, to one, lot depth to lot width maximum ratio. The proposed lot width is 66 feet. The proposed lot depth is 175.25 feet. Therefore, the lot depth exceeds two and one half, to one, by 10.25 feet. NOTICE OF DECISION MLP 96- 0007NAR 96 -0003 - DURDEL PARTITION PAGE 3 • 1. The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity; Due to its limited nature the variance does not impact other applicable development standards. The design aspect that this standard is in • place to address, the creation of buildable sites and allowing future partitions to occur where feasible, is not significantly impacted by this variance. The proposed 66 foot lot width complies with the 50 foot minimum average width requirement of the R-4.5 Zoning District. The site does not have the lot area to create a third lot. By allowing both lots to have direct frontage to the private street, more costly and difficult to maintain utility extensions would not be necessary. Screening and buffering of a flag lot type residence will also not be necessary. Adjoining properties in this area are also not presently developed as flag lots. This variance will not require the development of a flag lot, instead the site could be developed similar to the existing surrounding development. 2. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The existing private street and lot widths and depths are established in this area. This site is a remainder vacant property within a subdivision that was created under different development standards than are permitted today. 3. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; The applicant has not proposed to vary the use type. The variance will not preclude development of the site for the permitted, residential uses of the property. 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified by this title; and The variance is of a limited nature such that the aforementioned natural and man made systems are not impacted by this request. 5. The hardship is not self imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship is not self imposed in that the existing private street and lot widths and depths are established in this area. The additional 10.25 feet of lot depth is the minimum variance necessary to address this issue given the largely built -out nature of this area under its current zoning. Minor Land Partition - Approval Standards: Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; NOTICE OF DECISION MLP 96- 0007NAR 96 -0003 - DURDEL PARTITION PAGE 4 • 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). Each of the proposed parcels would exceed the 7,500 square foot minimum. The proposed parcels comply with the R-4.5 Zoning District. The parcels, as proposed, would allow the development of an additional detached single - family residential dwelling unit on the newly created parcel. This lot size and type of development conform with the Comprehensive Plan as required by Criteria 1 in terms of the development standards that implement the Comprehensive Plan designation for this property. The development, as proposed, does not exceed the maximum residential density allowed within the R-4.5 Zoning District for a 23,133 square foot property. The site yields the opportunity to partition a maximum of two lots as proposed. Upon completion of the appeal period and subsequent plat recording, the proposal will have complied with the statutory requirements for development review as required by Criteria 2. Adequate public facilities are available or have been required to be provided to serve this site as set forth in Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria 3. These requirements are reviewed by the Engineering Departments in this report. The new parcels exceed a two and one -half, to one, depth to width ratio. A variance has been requested that addresses this standard. The R-4.5 Zoning District has an average width requirement of 50 feet. Each proposed parcel would average at least 66 feet in width, in compliance with this requirement. For these reasons, the proposed parcel configurations conform with the size and dimensional requirements of the R-4.5 Zoning District as required by Criteria 4. The existing and future site improvements comply, or will comply with the applicable City and Agency development standards in satisfaction with Criteria 5. The parcels cannot comply with the Basic Solar Access requirements because of existing development constraints such as the size of adjoining parcels and the north to south orientation of the existing private street. Future development of structures on the new parcel will require compliance with Solar Balance Point Standards of Section 18.88 to ensure access to solar energy. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: NOTICE OF DECISION MLP 96- 0007NAR 96 -0003 - DURDEL PARTITION PAGE 5 • 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area • calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criterion's 1, 2, 3, and 4 are satisfied. The parcels will exceed the area requirement of 7,500 square feet set forth for properties zoned R-4.5. The newly created parcel would have in excess of 15 feet of direct frontage on a private street, in satisfaction of the lot frontage requirement in Criteria 3. The standards for Setbacks and Clear Vision requirements will be reviewed for new structures at the time of Building Permit Review satisfying Criteria 4. NOTICE OF DECISION MLP 96-0007NAR 96-0003 - DURDEL PARTITION PAGE 6 • Criteria 5 can be addressed prior to the issuance of Building Permits. Criteria 6 requires screening of flag lots. The newly created lots are not flag lots. Prior to the issuance of Building Permits, fire hydrants shall be made consistent with the Uniform Fire Code spacing standards, thereby, satisfying Criteria 7. Criteria 8 requires a reciprocal access and maintenance agreement. An agreement is not required because direct access to the existing private street can be provided. Criteria 9 will be satisfied prior to the issuance of Occupancy Permits through the requirement for construction of 10- foot -wide minimum paved driveway to serve the new parcel. Criteria 10 has been met because the parcel is not located within the 100 -year flood plain or in areas with slopes exceeding 25 percent. Because the site does not adjoin the 100 -year flood plain, dedication of areas for pathway purposes is not applicable. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: STREETS: This site does not have street frontage on SW Walnut Street. Rather, access to Walnut Street is currently taken via a 50 -foot wide private driveway easement that is shared among several tax lots. The easement itself is on Tax Lots 2800 and 4600. The driveway surface is presently dirt and gravel with minimal roadside ditches for drainage. To the north, the 50 -foot easement meets a barricade marking the present terminus of SW 129th Avenue, a City street. In the future, it is possible that right -of -way (ROW) will be dedicated from Tax Lots 2800 and 4600 for the southern extension of SW 129th Avenue so the City street will make a formal connection to SW Walnut Street. The applicant's proposal will result in one additional house, which will not result in a significant increase in traffic. Because of this, Staff does not believe it is warranted to require the applicant to pave the existing access driveway out to Walnut Street. However, since 129th Avenue will likely be extended in the future, Staff recommends the applicant be required to enter into an agreement with the City that will obligate him to participate in any future improvements to the roadway. This agreement should be executed prior to approval of the final plat. The City will also require the applicant to provide a copy of the existing access easement over Tax Lot 4600 (the 50 foot access easement) to ensure that access rights will also apply to any newly created lot from the subject property. SANITARY SEWER: There is an existing eight inch public sanitary sewer line that presently terminates at the end of the 129th Avenue improvements north of this site. The applicant proposes to extend the public line southerly within the existing 50 -foot joint access easement. The line will be extended to the south boundary of the site for future extension and service to NOTICE OF DECISION MLP 96- 0007NAR 96 -0003 - DURDEL PARTITION PAGE 7 adjacent parcels. The applicant will be required to obtain a public sanitary sewer and access easement from the owner of Tax Lot 4600 (the 50 foot driveway easement) prior to construction. • STORM DRAINAGE: This site is fairly flat and there is no public storm drainage system directly adjacent to the site. However, there is an existing storm system in SW 129th Avenue that appears to be at an elevation where this site could drain. The applicant is required to direct the storm drainage (footing and roof drains) from the new lot to an approved public drainage system. Drainage from the one new house will not be significant in quantity. The applicant proposes to direct the house drainage into a private storm pipe to be located within the 50- foot driveway easement and convey the storm water to the north. At the north end of the gravel driveway, and the terminus of SW 129th Avenue, the private pipe will discharge into the gutter line of the street where the storm water will simply run down the curb line to the nearest catch basin which is approximately 250 to 300 feet north of the barricade on 129th Avenue. This concept is acceptable, but a specific plan will need to be approved by the Engineering Department prior to construction. In addition, the applicant must obtain a private storm drainage easement from the owner of Tax Lot 4600 (the 50 foot driveway easement) in order to complete the work. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. Because this proposal is only adding one additional buildable lot, a water quality facility is not practical. Rather, the applicant should pay the fee in -lieu of constructing a facility. The fee for one single - family house is $180.00 and is payable prior to issuance of the building permit. GRADING AND EROSION CONTROL: USA R &O 91 -47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity that accelerates erosion. Per R &O 91 -47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. NOTICE OF DECISION MLP 96- 0007NAR 96 -0003 - DURDEL PARTITION PAGE 8 • SECTION V: OTHER STAFF COMMENTS The Water Department reviewed this application and stated that the City has a fire hydrant on SW 129th Avenue, however, a barricade at the end of SW 129th Avenue prohibits access to the fire hydrant from the undeveloped street. In order for this property • to have fire protection the barricade must either be removed or a new fire hydrant will need to be installed at the intersection of SW 129th Avenue and SW Walnut Street. The Police Department reviewed this application and had no comments or objections. SECTION VI: AGENCY COMMENTS The Tualatin Valley Fire District has reviewed this proposal and stated that the access road may not be less than 20 feet of unobstructed driving surface. Hydrants are required per the fire Code. Submit plans showing the above to this office for review and approval. The Unified Sewerage Agency and Portland General Electric reviewed this proposal and had no comments or objections. Be filed by the applicant in conjunction with an application for a subdivision or partition. For the purpose of identifying trees related to exemption requests, a map showing existing trees which are at least 30 fee tall and over 6 inches diameter at a point 4 feet above grade shall be submitted. This map shall include the following: a. Height. b. Diameter. c. Species. d. A statement declaring that they are to be retained. 4. Copies of all private restrictions relating to solar access. The design characteristics of a developed solar - oriented lot are high levels of wintertime sun striking the south walls and roofs o the house, house orientation maximizing south window area, and a south-sloping roof area. To achieve this, one may utilize thi following: 1. Protected Solar Building Line • The solar building line must: a. Be oriented to within 30 degrees of a true east -west axis. b. Provide a minimum distance of 70 feet from the middle of the lot to the south property line. c. Provide a minimum distance of 45 feet from the northernmost buildable boundary of the subject lot to the nortt property line. 2. Performance Options . There are two performance options which may be utilized as follows: a. The house to be oriented within 30 degrees of an east -west axis and have at least 80% of the ground floor's souti wall protected from shade. b. At least 32% of the glass and 500 square feet of the roof area face south and be protected from shade. Please contact the Building Division for further information regarding the Protected Solar Building Line and Performance Options relating to building height and construction. PARKING AND ACCESS All parking areas and driveways must be paved. • Single family: Re uires 2 off- street parking spaces per dwelling unit. • Multiple ami y: Requires 1.5 parking spaces per unit for 1 bedroom. Requires 2 parking spaces per unit for 1+ bedrooms. Multi- family dwelling units with more than 10 required spaces shall provide parking for the use of guests and shall consist of 15% of the total required parking. (Refer to Code Section 18.106.030) No more than 40% of required spaces may be designated andlor dimensioned as compact spaces. Parking stalls shall be dimensionec as follows: • Standard parking space dimensions: 8 ft. 8 inches X 18 ft. • Compact parking space dimensions: 8 ft. CLEAR VISION AREA The City requires that clear vision areas be maintained between three and eight feet in height at roadldriveway, roadlrailroad, an roadlroad intersections. The size of the required dear vision area depends upon the abutting street's functional classification. (Refer to Code Section 18.102) BUFFERING AND SCREEN. G In order to increase ivacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments especially between diffe •nt land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer area are described by the Code terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees anc shrubs and must also achie • a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advis.ble even if not required by the Code. The required buffer areas may o� be occupied by vegetation, fences, utilities, and walkways. \Additional information on required buffer area materials and sizes may be found in the Community Development Code. Street trees must be placed either within the public right-of-way or on private property within six feet of the right -of -way boundary. Street trees must have a minimum caliper of at least two inches when measured four feet above grade. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one tree for every seven parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. The Traffic Impact Fee program collect fees from new development based on the development's projected impact upon the City's transportation system.
