SUMMARY OF THE REQUEST CASE: FILE NAME: ROYAL OAKS /DOAN Minor Land Partition MLP 96 -0001 Lot Line Adjustment MIS 96 -0002 PROPOSAL: A request for approval of the following development applications: 1.) Lot Line Adjustment to adjust two (2) parcels of approximately 16,117 and 28,113 square feet into two (2) parcels of approximately 15,878 and 28,352 square feet; and 2.) Minor Land Partition to divide one (1) parcel of approximately 28,352 square feet into three (3) parcels of approximately 7,500, 10,000, and 10,000 square feet. APPLICANT: Royal Oaks Development Co. LOCATION: 9795 SW Frewing Street (WCTM 2S1 2CA, tax lot 100) and 9765 SW Frewing Street (WCTM 2S1 2CA, tax lot 102). East of SW Pacific Highway, west of SW Ash Avenue and on the north side of SW Frewing Street. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.50.050, 18.88, 18.162.040, 18.162.050, 18.162.060, 18.164.030, 18.164.090 and 18.164.100. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions: NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001/MIS 96 -0002 PAGE 1 • • • CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO RECORDING THE PLAT. UNLESS OTHERWISE NOTED, THE STAFF • CONTACT FOR ALL CONDITIONS SHALL BE BRIAN RAGER, ENGINEERING DIVISION: 1. The final plat shall indicate additional right -of -way will be dedicated to the public to provide a 25 feet from centerline adjacent to this site. 2. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Frewing Street. 3. The applicant shall extend the 8 -inch public sanitary sewer line in Frewing Street across the full frontage of the site. 4. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. 5. Two (2) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. 6. A joint use and maintenance agreement shall be executed and recorded on a City standard form for a common driveway. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 7. Final Plat Application Submission Requirements: A. Three mylar copies of the final plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. Copy of recorded boundary survey for site. C. Copy of a current preliminary title report (within the last six months). D. The final plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. The applicant shall submit a plan approved by Tualatin Valley Fire and Rescue indicating that hydrant location complies with Fire Code requirements. 9. Wetland delineation to determine boundary of the wetlands on the adjoining property. A 25 foot buffer is required from the boundary of that delineated wetland. This delineation will determine the extent, if any, of development constraints on parcel 1. To the extent the buffer encroaches within parcel 1, the partition plat shall note that boundary on the plat and restrict its usage to those allowed by USA R &O 91-47. Revision of the square footage on lot 2 shall also be required to the width adjustment of lot 3. 11. Location of the existing residence and any structures on tax lot 102. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED: 12. Building permits will not be issued and construction of proposed public improvements shall not commence until after the Engineering Department has reviewed and approved the public improvement plans and a construction compliance agreement has been executed. A 100 percent performance assurance or letter of commitment, a developer- engineer agreement, the payment of a permit fee and a sign installation /streetlight fee is required. • 13. Provide the Engineering Department with a recorded mylar copy of the partition plat. 14. The applicant shall provide for roof and pavement rain drainage to the public storm water drainage system or by an on -site system designed to prevent runoff onto the adjacent property. BACKGROUND INFORMATION Property History: No development applications were found to have been filed with the City. Site Information and Proposal Description: The subject properties are currently developed with one (1) single - family residence. The property slopes from an elevation of approximately a 204 foot elevation at the southeast corner to approximately a 186 foot elevation at the northwest corner of the property. The applicant is proposing a Lot Line Adjustment to adjust two (2) parcels of approximately 16,117 and 28,113 square feet into two (2) parcels of approximately 15,878 and 28,352 square feet. The adjustment will involve approximately 239 square feet and located at the rear of tax lot 102. The applicant is then seeking Minor Land Partition approval to divide the one (1) parcel of approximately 28,352 square feet into three (3) parcels of approximately 7,500, 10,000 and 10,000 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS LOT LINE ADJUSTMENT Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however, an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500' square foot minimum lot size requirement of the R-4.5 zone. All site development improvements applicable to these lots will remain consistent with code requirements. NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001/MIS 96 -0002 PAGE 4 • • Section 18.162.050. In addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through • the Minor Land Partition process. 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and /or development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001/MIS 96 -0002 PAGE 5 • • a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. • ' Criteria 1 is satisfied as the lot widths will be approximately 99 and 165 feet, exceeding the minimum 50 foot lot width requirement of the R-4.5 zone. Criteria 2 is satisfied as the proposed lot areas are approximately 15,878 and 28,352 square feet, meeting the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as the lots contain approximately 169 and 99 feet of frontage on SW Frewing Street, exceeding the minimum 15 foot minimum width requirement. The plan does not show the location of the existing residence on tax lot 102. While this adjustment is only for an approximately 239 square foot portion of the rear corner of the lot, compliance with setbacks must be verified. Therefore, a revised site plan shall be submitted which shows the location of the existing residence, thereby, satisfying Criteria 4. Criteria 5 and 6 are not applicable as this adjustment is not creating a flag lot. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as these lots do not share a common driveway. Criteria 9 is satisfied on lot 102 as it will continue to use an existing driveway. Lot 100 is currently vacant, but accessways will be satisfied on tax lot 100 when the lot is developed. Criteria 10 is not applicable as neither parcel is within the floodplain. SECTION IV.(cont'd.) APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; .2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83 -52). The proposal conforms with the City's Comprehensive Plan in that the newly created lots will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001/MIS 96 -0002 PAGE 6 I partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are available • to serve the proposal or shall be made available through conditions of approval. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Criteria 1 is partially satisfied as the proposed lots 1 and 2 exceed the minimum required 50 foot minimum lot width requirement of the R-4.5 zone. The proposed lot 3 would provide a 46 foot lot width, which does not meet the minimum width requirement. A revised plan shall be submitted which provides for a 50 foot lot width for lot 3. This revision would effect the size of parcel 2, this change should also be reflected on the revised plan. Criteria 2 is satisfied as the proposed lot areas are approximately 7,500, 10,000 and 10,000 square feet, meeting the 7,500 minimum lot size requirement of the R-4.5 zone. Section 18.164.060 (Lots) states that the depth of all lots shall not exceed 2 -1/2 times the average lot width, unless the parcel is less than 1 -1/2 times the minimum lot size of the applicable zoning district. The depth to width ratio for lots 1, 2, and 3 are approximately 2.8, 2.5, and 3.4, which either equal or exceed this standard. One and one -half (1 -1/2) times the minimum lot size of the R -4.5 zone would be 11,250 s.f.. All three lots are less than the 1 -1/2 times the minimum lot size requirement of 11,250 square feet. Therefore, the creation of lots which exceed the 2 -1/2 ratio is allowed. Criteria 3 is satisfied as the lots contain approximately 59, 63, and 46 feet of frontage on SW Frewing Street, exceeding the minimum 15 foot minimum width requirement. Criteria 4 shall be satisfied as setbacks will be reviewed during building permit application review. Criteria 5 and 6 are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as these lots will not share a common driveway. Criteria 9 shall be satisfied as driveways shall be reviewed through the building permit application process. Criteria 10 is not applicable as none of the parcels are within the floodplain. Section 18.88.010 Solar Access states that; all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. The proposed lots are able to provide a 90 foot lot depth but are unable to orient the lots within the required north -south dimension due to the existing street pattern. The proposed lots may be exempted from meeting the basic standard due to the existing orientation of SW Frewing Street. It should be noted that new structures must comply with the Solar Balance Point Ordinance even if a lot has been exempted from the basic solar requirement. NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001 /MIS 96 -0002 PAGE 8 0 0 Sections 18.164.030 Streets: 18.164.090 Sanitary Sewer: and 18.164.100 Storm Drains have been addressed and are satisfied as specified below: Streets: The subject parcel lies adjacent to SW Frewing Street which is classified as a local residential street. There is presently 40 feet of right -of -way (ROW) adjacent to this site (20 feet from centerline). When full development in this area occurs, this roadway will be subject to a traffic load of over 1,500 average daily trips (ADT). Because of this, a total of 50 feet of ROW is required, which will require a 5 -foot dedication from this site in order to provide 25 feet from centerline. The applicant's plan indicates this dedication will be made as a part of the partition. SW Frewing Street is currently unimproved. Section 18.164.030(A)(1)(c)(v) of the Tigard Development Code (TDC) states that the Director may accept a future improvement guarantee in lieu of street improvements if the improvement is associated with an approved land partition on property zoned residential and the proposed land partition does not create any new streets. Since this property is zoned residential and the approval will not result in the creation of new streets, the applicant will be required to enter into an agreement which will guarantee their participation in future improvements in SW Frewing Street. This agreement shall be executed prior to approval of the final plat. Sanitary Sewer: The closest public sanitary sewer line to this site is an 8 -inch line located approximately 100 feet to the northwest in Frewing Street. There is a manhole in the street with an invert elevation of 178.0 feet. In order to serve this site, the applicant must extend the 8 -inch public sanitary sewer line in Frewing Street to the subject site. In order to provide a logical extension of the public sanitary sewer system, the applicant shall extend the sewer line across the full frontage of the site. A public improvement permit will be required for this work along with a construction compliance agreement. Storm Drainage. Storm water from this site flows to the north. There is an existing natural drainage located just to the north where a culvert crosses Frewing Street. There are no existing public storm drainage improvements available. The applicant will be required to submit a storm drainage plan indicating how the proposed lots will be served by a public drainage system. This plan shall be approved by the City Engineer prior to approval of the final plat. NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001 /MIS 96 -0002 PAGE 9 • • The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. R &O 91 -47 allows and exception to this rule when single family residences are proposed. Therefore, there will be no water quality requirements for this approval. SECTION V. OTHER STAFF COMMENTS The City of Tigard Building Division states that all storm water shall be conveyed to the public system (ditch) in SW Frewing Street or to the drainageway to the west via a private easement. The City of Tigard Maintenance Services Division, City of Tigard Police Department and City of Tigard Water Department, have reviewed the proposal and have offered no comments or objections. SECTION VI. CIT AND AGENCY COMMENTS The Unified Sewerage Agency states that a wetland exists on the lot north of parcel 1. The required 25 foot buffer may impact parcel 1 if the wetland is within 25 feet of the property line. Tualatin Valley Fire and Rescue states that plans cannot be approved at this time. The applicant shall provide information showing existing or proposed fire hydrants within 500 feet of these parcels. GTE and Portland General Electric, have reviewed the proposal and have offered no comments or objections. NOTICE OF DECISION ROYAL OAKS / DOAN - MLP 96- 0001 /MIS 96 -0002 PAGE 10 • SECTION VII. Appeal: Any party to the decision may appeal this decision in accordance with Section 18.32.290(A) and Section 18.32.370 of the Community Development Code which provides that a written appeal must be filed with the City Recorder within 10 days after notice is given and sent. Condition #6 required the applicant to provide a joint use and maintenance agreement for a common driveway to serve the three -lot partition. Upon review, I am not sure why such a condition was ever placed on this partition. SW Frewing Street is a local residential street. Commonly, each residential lot on a local residential street is allowed to have its own individual driveway. In addition, I read the findings attached to the Director's decision and found nothing there supporting such a condition. It also does not appear that the applicant was proposing such a joint driveway. It may have been that the condition was intended to show what would need to be done if the applicant were to implement a joint driveway. As a professional wetland ecologist with thirteen and one -half years of experience in the wetland sciences and wetland regulatory analysis, and a good rapport with the Oregon Division of State Lands and the US Army Corps of Engineers, my professional opinion is that the areas likely subject to regulation by Oregon's Removal /Fill Wetland l.,aw and Federal Section 404 Wetland Regulation are as shown on the professional land survey. This wetland boundary survey was also performed by David Evans and Associates, Inc. (DEA) surveyors immediately alter completion of the delineation. The delineation of the palustrinc forested wetlands bordering the on -site creek was done according to the 1987 Corps n Engineers lWetlwuI Delinen! ion AManrur methodology. This methodology is the 1 ! = � gY• gY accepted methodology of DSI, and (ACOE). I constructed 0.01 - acre sampling plots to characterize the vegetation, soils, and hydrology at locations about the suspected wetland limits and adjusted the • line according to wetland presence or absence at these plots. Datasheets for these plots have not been prepared but the data is in our files. I found the delineation of the boundary to be straightforward, with no controversial areas. Because of this and the need to move rapidly ahead, DS!, and ACOE personnel have not reviewed the wetland limit we have established. Should wetland permitting become necessary, we would prepare a delineation report and conduct a field concurrence review with them at that time. • • A survey map was prepared showing the property boundary, the existing building and driveway, the top of bank of the creek, the City of Tigard's 25 -foot wetland setback, and the wetland limit. The location of the subject site is 9765 SW Frewing Street, which is east of SW Pacific Highway, west of SW Ash Avenue and north of and adjacent to SW Frewing Street. Once adjusted, Tax Lot 100 will contain 0.65 acres and Tax Lot 102 will contain 0.39 acres. Findings: 1. Streets: The subject parcel lies adjacent to SW Frewing Street which is classified as a local residential street. There is presently 40 feet of right -of -way (ROW) adjacent to this site (20 feet from centerline). When full development in this area occurs, this roadway will be subject to a traffic load of over 1,500 average daily trips (ADT). Because of this, a total of 50 feet of ROW is required, which will require a 5 -foot dedication from this site in order to provide 25 feet from centerline. The applicant's plan indicates this dedication will be made as a part of the partition. SW Frewing Street is currently unimproved. Section 18.164.030(A)(1)(c)(v) of the Tigard Development Code (TDC) states that the Director may accept a future improvement guarantee in lieu of street improvements if the improvement is associated with an approved land partition on property zoned residential and the proposed land partition does not create any new streets. Since this property is zoned residential and the approval will not result in the creation of new streets, the applicant will be required to enter into an agreement which will guarantee their participation in future improvements in SW Frewing Street. This agreement shall be executed prior to approval of the final plat. ENGINEERING COMMENTS MLP 96- 01/MIS 96 -02 ROYAL OAKS PAGE 1 • • 2. Sanitary Sewer: The closest public sanitary sewer line to this site is an 8 -inch line located approximately 100 feet to the northwest in Frewing Street. There is a manhole in the street with an invert elevation of 178.0 feet. In order to serve this site, the applicant must extend the 8 -inch public sanitary sewer line in Frewing Street to the subject site. In order to provide a logical extension of the public sanitary sewer system, the applicant shall extend the sewer line across the full frontage of the site. A public improvement permit will be required for this work along with a construction compliance agreement. 3. Storm Drainage: Storm water from this site flows to the north. There is an existing natural drainage located just to the north where a culvert crosses Frewing Street. There are no existing public storm drainage improvements available. The applicant will be required to submit a storm drainage plan indicating how the proposed lots will be served by a public drainage system. This plan shall be approved by the City Engineer prior to approval of the final plat. The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91 -47, as amended by R &O 91 -75) which require the construction of on -site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. R &O 91 -47 allows and exception to this rule when single family residences are proposed. Therefore, there will be no water quality requirements for this approval. Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639- 4171). 1. The final plat shall indicate additional right -of -way will be dedicated to the public to provide a 25 feet from centerline adjacent to this site.. 2. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Frewing Street. The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. 5. Two (2) sets of detailed public improvement plans and profile construction drawings shall be,submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. 6. A joint use and maintenance agreement shall be executed and recorded on a City standard form for the common driveway. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 7. Final Plat Application Submission Requirements: A. Three mylar copies of the final plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. Copy of recorded boundary survey for site. C. Copy of a current preliminary title report (within the last six months). D. The final plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard. E. The street dedication for SW Frewing Street shall be made on the partition plat. THE FOLLOWING CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF THE BUILDING PERMITS: 1. Building permits will not be issued and construction of proposed public improvements shall not commence until after the Engineering Department has reviewed and approved the public improvement plans and a construction compliance agreement has been executed. A 100 percent performance assurance or letter of commitment, a developer- engineer agreement, the payment of a permit fee and a sign installation/streetlight fee are required.
